There was some legal issue with it and I think it was constructively approved although they wanted to deny it. Not sure on details, but there is something in the files. I don't think it really impacts the lot inquiry. Cummaquid, MA 02637 Re: Assessors' Map 122, Parcel 7, Lots 2 & 3, Thatcher Shore Road Dear Mr. & Mrs. Hopkins: This is to serve as follow up to our meeting of this morning, concerning the status of Lots 2 and 3, shown as Parcel 7 on Assessors Map 122. LOT DISCRIPTIONS The following is a recap of the lot descriptions and the issues discussed during our recent meeting: The lots in question were created via an ANR,by Land Surveyor Thomas E.Kelly;was endorsed by the Planning Board on May 7, 1969 and recorded at the Barnstable Registry of Deeds on May 29, 1969. This ANR plan created Lots 1, 2 & 3. Lot 1 is shown as having been developed with a single family dwelling. According to this plan: -Lot No. 2 contains 1.80 acres of land area and 156.75+/- feet of frontage -Lot No.3 contains 3.179 acres of land area and 218.63+/- feet of frontage Note: It is unknown as to the net upland/non-wetland area of each lot and is to be determined by a Certified Land Surveyor. MEETING DISCUSSION ITEMS and CONCLUSIONS 1. Future plans shall depict the net non-wetland/upland area for the lots in question. 2.Providing Lots 2 and 3 contain a minimum of 40,000 square feet of non-wetland area,combined with the frontage in excess of 150 lineal feet, each would comply with the minimum dimensional requirements of Zoning Bylaw Table of Dimensional Requirements 203.5, for Zoning District R-40. 3.In addition,plans submitted for permitting purposes,shall include the revised flood zone delineations and the proposed access easement/common driveway. Note: The Fire Dept. shall review the proposed access to determine adequate access for fire apparatus and emergency vehicles. - •4 —ye 1 Page 2—Mr.&Mrs.Hopkins---Re:Lots 2 and 3,Thatcher Shore Road,Yarmouth Port Nov. 19,2014 4.The proposed access easement/common driveway and the details thereof,shall also be reviewed and approved by the Conservation Commission. 5. A Building Permit checklist was provided during our meeting,outlining the required protocols when submitting a permit application. This plan shows that this parcel consists of two lots; Lot 2 and Lot 3. Lot 2 contains 1.800 acres with 135.18 feet of frontage and lot 3 contains 3.179 acres with 179.59 feet of frontage. I have been advised by Town Planner Kathleen Williams that these lots were created via an Approval Not Required under the Subdivision Control Laws,known as ANR plans,pursuant to the provisions of MGL Chapter 41, Section 81. Based on these factors,we have determined that Parcel 7 complies with Zoning Bylaw Section 104.3.4, Para. 5. This section provides that lots created prior to June 3, 1996, containing a minimum of 10,000 square feet of non-wetland area and a minimum of 75 feet of frontage, are protected for zoning building purposes. This determination is subject to the following and those categories checked on the Lot Inquiry Form: 1. The lot line separating lot 2 and 3 be expunged,thus creating one lot.This is accomplished by a perimeter plan or an ANR. 2. The Planning Board is to determine whether the lot has adequate access for emergency vehicles, provided for MGL Chapter 41. 3. A land surveyor and/or other qualified individual shall determine the "non-wetland area"and denote that calculation on a certified plot plan.
