Based on the court cases you provided, we concur the parcel in question, shown on Assessors Map 29 as parcel 233 and depicted as Lots 86& 88, on an amended November, 1930 subdivision plan,having combined total of 11,175 square feet is considered protected. This land area total was taken from a plot plan that accompanied a November 7, 1985 Building Permit application. This is somewhat different from the Assessor's records of.26 acre-11,325. As a footnote,the permit issued in 1985 was not exercised. The parcel is developed with a garage. Based on the Assessors records, it was constructed prior to the lot becoming non-conforming. Therefore, while it does not qualify for protection pursuant to the vacant lot provisions,because of merger; it does qualify as developed lot pursuant to MGL Chapter 40A, Section 6, para. 1 and Zoning Bylaw Section 104.3.2, para. 2 and/or 3. However, a Special Permit is required to construct a single family house in place of the existing garage. Very truly, James D.
