Quirk 750 Attucks Lane Hyannis, MA 02601-1811 Re: Parcel 216.2 Map 115/West Yarmouth Rd. Dear Attorney Quirk: Based on our office meeting I have reviewed Land Court Case Reg. No. 43317 to determine whether parcel 216.2, shown on Assessors Map 115 qualifies for protection provided in zoning bylaw Section 104.3.4,paragraph 5,Other Nonconforming Residential Lots. On October 9,2009 the court found that the parcel in question was in effect,retroactively reduced in size to 27,007+/-square feet with 103.11+/- feet of frontage by a 1941 tax taking, shown as "Lot 2" On November 22,2002 a similar inquiry was submitted,but because the Land Court case was pending, a determination could not be made at that time. However,based on the facts contained in the 2009 Land Court decision, I now find that parcel 216.2 (lot 2) in the configuration shown on the plan referenced in said decision, does qualify for protection pursuant to zoning bylaw Section 103.3.4, Para. 5. Finally, a recorded copy of this plan should be submitted to complete this compiled file and will substantiate future building permit applications.
