Please accept this Notice of Intent application for a proposed addition to the existing single-
family home located at 36 Bentbluff Lane in Yarmouth (the site). The Town of Yarmouth
Assessors Department references the site Parcel ID# 117-5. The proposed project occurs within
the 100-foot buffer zone to a Bordering Vegetated Wetland. This application is being submitted
in accordance with the Massachusetts Wetlands Protection Act and Town of Yarmouth Wetland
Bylaw.

Administrative Checklist
Notice of Intent
General Information:
All filings must be made on Town of Yarmouth forms. The filing deadline is two weeks prior to the next
scheduled Conservation Commission meeting for new applications. Failure to follow this Checklist shall
result in an Administratively Incomplete Application and will not be advertised for a Public Hearing. Refer to
the meeting schedule. Contact the Conservation Office if you need assistance.
Submitting an Application:
Does the property have any outstanding/expired Orders of Conditions? If so, please file a Request
for Certificate of Compliance for each outstanding/expired Order, as the Commission may not issue a
new Order until any outstanding/expired Orders have been closed and recorded. (*see page 2)
Hardcopy filing dropped off or mailed to the Conservation Office including:

1 complete NOI application WPA form 3 with original signatures. Typed signatures will not be accepted.
Detailed narrative of the project including existing & proposed conditions, construction sequence, type of
equipment, staging locations, drainage and stormwater, erosion controls, invasive species management
and alternative analysis. The narrative shall include how the project meets performance standards per
310 CMR 10.0 & TOY Wetland Regulations, delineation sheets (if BVW or vegetated wetlands are
present) or other resource area calculations, and supporting information.
1 100’ radius map, current abutters list identifying the property owners who are to be notified per 310
CMR 10.00 and abutter notification form. Abutters list must be certified by the Town Assessor’s office.
The Assessor’s office requires 7 days advance notice. All abutters must be notified via certified mail.
Certified Mail Receipts (PS Form 3800) for all abutters. Green cards to be submitted at the hearing.
1 original and 6 copies of the plan, folded separately, right side out with title and project address visible.
All plans shall reference NAVD1988 unless otherwise noted. See plan requirements

If you are filing with MassDEP using eDEP, please include a copy of the submittal confirmation with your
application.
If not filing via eDEP, a PDF of your application, plan, and all other supporting information must be sent
VIA EMAIL the same day to DEP, Southeast Region at SERO_NOI@mass.gov with the subject line in
the email per DEP’s request listed as “YARMOUTH - NOI - Street Address - Applicant Name” and
copied bdirienzo@yarmouth.ma.us and jjerolimo@yarmouth.ma.us. We must receive a copy of
this email with the application as proof that it has been submitted to DEP.

I CERTIFY that all on-site requirements will be completed by noon on the Friday prior to the hearing
date. All proposed structures must be staked, and all relevant resource areas and buffer zones must be
staked or flagged.
Please consult the Yarmouth Wetland Regulations, page 17. Without proper staking your project may be
deemed incomplete and be continued to the next hearing date.

Waterway’s jurisdiction – Any coastal projects such as, but not limited to, docks, piers, bulkheads,
revetments, dredging and boardwalks shall require submittal of all Notice of Intent, plans and
supplemental information to the Town of Yarmouth Waterways/Shellfish Committee via the Natural
Resources office by certified mail or hand delivery. The applicant or his/her representative must provide
the Conservation office with proof that this has been done or the filing will not be accepted.
Other Requirements
o Does the proposed project meet the applicable regulations of the Town of Yarmouth Zoning bylaws? Do
you need to file with the Yarmouth Board of Appeals? If so, you must file with ZBA after conservation
permitting is completed.
o If a vacant lot, have you completed and received a determination for the Building Department for a lot
inquiry form?

PROJECT NARRATIVE
1. Introduction
This Notice of Intent (NOI) has been submitted to the Yarmouth Conservation Commission (the
Commission) to permit the construction of an addition to the existing single-family home located at
36 Bentbluff Lane in Yarmouth (the site). The Town of Yarmouth Assessors Department references
the site as Parcel ID #117-5. The proposed work occurs within the 100-foot buffer zone to a
Bordering Vegetated Wetlands. Prior to the start of work, erosion controls will be installed to protect
wetland resource areas. This application is being submitted in accordance with the Massachusetts
Wetlands Protection Act and the Town of Yarmouth Wetlands Protection Bylaw.
2. Site Description
The site consists of a single-family home with a paved driveway, deck, hot tub and patio to the rear,
maintained lawn, landscaped areas, etc. The site is located to the north of Bentbluff Lane and south
of Wier Road, surrounded by similar residential properties to the south and east. A Bordering
Vegetated Wetland (BVW) is located to the west/rear of the home within a naturally wooded area.
Environmental Consulting & Restoration, LLC (ECR) performed a wetland delineation at the site on
September 20, 2024. ECR located the landward limit of the BVW that follows along the western
property limit. BVW flags (pink and black ribbon) #A1 to #A7 were hung along the landward limit of
the wetland system nearest the site to identify the limit of the wetland and the associated 100-foot
buffer zone that extends over a portion of the site. ECR also located a Potential Vernal Pool (PVP)
within the wetland system. ECR placed blue ribbon #PVP1 to #PVP3 in the field to mark the limit of
the PVP for reference. As a result of the field work and review of available environmental databases,
ECR confirms the site contains the following wetland resource areas and areas of Conservation
Commission jurisdiction:
• Bordering Vegetated Wetlands
• 100-foot buffer zone to BVW
Also, a review of the MassMapper database reveals the following:
1. The site is not located within an area mapped as Priority Habitat & Estimated Habitat for Rare
Species according to the Massachusetts Natural Heritage & Endangered Species Program
(MaNHESP).
2. The site does not contain or is near a Certified Vernal Pool according to the MaNHESP.
However, there is a mapped Potential Vernal Pool located offsite to the west.
3. The site is not located within an area mapped as Land Subject to Flooding according to the
FEMA Maps.
4. The site does not contain or is near a U.S.G.S. mapped stream.
5. The site is not located within an Area of Critical Environmental Concern (ACEC).
3. Proposed Activities
The purpose of this application is to authorize the construction of an addition to an existing single-
family home. The proposed addition is located within the 100-foot buffer zone of the BVW. The
proposed project will involve the following activities:
• Installation of Erosion Controls – Prior to the start of work a siltsock will be installed along the
proposed limit of work to protect the downgradient BVW.

• Proposed Addition – The construction of a 20’ by 20’ addition is proposed at the southwest
corner of the existing single-family home. The proposed addition is within the 100-foot buffer
zone to BVW, but entirely landward of the 50-foot buffer zone. Furthermore, the proposed
addition is located entirely within a portion of the site that currently exists as maintained lawn.
• Landscape Activities - All disturbed areas surrounding the proposed addition will be restored
and stabilized as lawn and/or landscape beds. All landscape plant materials proposed within
the 100-foot buffer zone at the site will consist of native plant species. The proposed lawn
will consist of environmentally friendly grass seed mix that requires little maintenance needs
such as irrigation and fertilization. ECR recommends using a grass seed mix with a high
content of tall fescues, which requires less irrigation and fertilization needs.
4. Summary
The proposed addition has been designed to minimize impacts to the site and comply with the
requirements of the MA Wetland Protection Act Regulations and the Town of Yarmouth Wetland
Regulations. Specifically, the proposed addition complies with Part 6 of the Yarmouth Wetland
Regulations, which relate to the Buffer Zone Requirements. To comply with these requirements the
proposed addition is located landward of the 50-foot buffer zone, no work is proposed within the 35-
foot buffer zone, and no new lawn is proposed onsite. To protect the nearby wetland, erosion and
sediment control measures will be implemented and maintained throughout the duration of the
construction process to prevent the conveyance of sedimentation into environmentally sensitive
areas. Disturbed areas will be stabilized upon the completion of work, and if intense rainfall is
expected, reinforcing control measures will be installed as needed to protect all wetland resource
areas. The stockpiling of soil, if any, shall be located beyond the 50-foot buffer zone and surrounded
by erosion controls as necessary. Erosion control measures shall remain in place and be maintained
until such time that a Certificate of Compliance has been issued by the Yarmouth Conservation
Commission, stating that the project has been constructed in accordance with the conditions set forth
in the Order of Conditions.
As a result, it is my opinion that the project protects the Interests of the Massachusetts Wetlands
Protection Act and the Town of Yarmouth Wetlands Protection Bylaw for the adjacent Resource Area
and the Applicant is entitled to an Order of Conditions approving the project.
