Dear Yarmouth Conservation Commissioners,
BSC Group, Inc. (BSC) is pleased to submit this revised scope letter associated with the Notice of Intent (NOI)
application submitted on behalf of Robert and Maureen Kelly (the Applicant), for a project located at 146 Mayflower
Terrace, South Yarmouth, MA (the Site). The proposed project involves the replacement of an existing pier, which
does not reach beyond the existing salt marsh or MLW, with a new pier, ramp and float system which will now extend
80’ seaward from MHW. The project scope has been revised to exclude the coastal revetment replacement work, and
the configuration of the pier has been altered at the request of the Yarmouth Waterways Committee, who requested
that the structure not exceed the 80’ length limit under 3.01 (10). Pier reconfigurations included the elimination of 34
feet of fixed pier, to bring the structures into compliance with maximum length required of a pier system, as well as a
ramp at the landward side of the pier, which has been extended slightly to provide access to the elevated pier from
the sloped lawn.
This reduction in pier length has reduced the berthing depth seaward of the float from 3.6 to 2.1 MLW. As a result, the
variance request (included as a separate document) has been revised to request that the Commission waive the
requirement that the proposed structure meet 3 feet at MLW beneath the seaward side of the float under 3.01 (11).
Although the proposed pier system has been altered, it is not anticipated that the change in scope will increase
impacts or result in new impacts to jurisdictional resource areas. Due to the reduced water depths float stops will be
added to prevent the float from coming into contact with the substrate. The shortened pier will cover less area over
Land Under Ocean and Shellfish Habitat and will reduce the total number of piles required by 6. Overall, the revised
scope will reduce impacts to jurisdictional resource area and their associated buffer zone and will still meet all other
performance standards under the Yarmouth Bylaws and associated Regulations, as well as the Performance
Standards under the Massachusetts Wetland Protection Act 310 CMR 10.00.
