PETITION 5155: Brendan and Rebecca Donovan. Property Location: 18-20 Wood Road, South Yarmouth, MA. Map & Lot #: 50.146.1C. Zoning District: RS-40. The Applicant seeks a Variance from §203.5 to create two nonconforming lots. The petitioners and owners of # 18 Wood Road, Brendan and Rebecca Donovan, appeared at the hearing. Marcos Pereira, the owner of 120 Wood Road, also attended the hearing. The petitioners are seeking relief to create two nonconforming lots with the intention of removing the condominium form of ownership from 18-20 Wood Road. In Decision #4720, dated January 16, 2018, a condominium form of ownership was created for the entire property. Previously, the parcel had two preexisting, nonconforming structures. The structure at #18 Wood Road was built in 1971 and the structure at #20 Wood Road was built in 1955. The petitioners want to subdivide the property to create two single family dwellings on two lots. In order to create the lots, the petitioners need to create a subdivision. If the lots are subdivided, the A18 Wood Road lot would contain 13,857 square feet of area and the #20 Wood Road lot would contain 13,558 square feet of area. The Board consensus was the petitioners did not meet the criteria for a Variance because the minimum lot size for this zoning district is 40,000 square feet of area for each lot. The petitioner requested to withdraw the Variance without prejudice. A motion was made by Mr. Fraprie and seconded by Mr. Martin to allow the petitioner to withdraw the Variance without prejudice.
