DECISION #5070 - ONE-YEAR REVIEW

MEMBERS SITTING (February 13, 2025 hearing): Chairman Sean Igoe, Dick Martin, Jay
Fraprie, John Mantoni, and Dick Neitz.
DECISION 5070: Gabrielli dos Santos Rigo. Property Location: 48 Butler Avenue, West
Yarmouth, MA. Map & Lot #: 39.91. Zoning District: R-25. One-year review per condition
#4 of Decision #5070, dated February 22, 2024, allowing a family daycare for up to 6 children.
The petitioner, Gabrielli dos Santos Rigo, was granted a Special Permit at the January 25, 2024
hearing, to operate a family daycare, with several conditions:
1) Special Permit is restricted to this individual at this location for up to 6 children in the
daycare;
2) Hours of operation: Monday -Friday, 7am-5pm;
3) Child drop-offs and pickups must be in the driveway only; and
4) The Petitioner must return to the Board for a one-year review.
Per condition #4, the petitioner appeared before the Board on January 13, 2025 for a one-year
review to ensure compliance with all conditions.
The petitioner appeared at the hearing with Beatriz de Melo who served as interpreter.
After questioning the petitioner, the Board was satisfied that the petitioner had complied with the
conditions of the decision.
A motion was made by Mr. Fraprie and seconded by Mr. Martin that the Board was satisfied that
the petitioner had met the conditions of Decision #5070, dated February 22, 2024, and that the
petitioner did not need to return to the Board. On a voice vote (5-0), the motion was approved.
