This letter follows up on the materials I sent you earlier regarding the Morin property in
West Yarmouth and the question of whether the property fronting on Maine Avenue can
be built upon separately.
The deeds to the parcels shown on the sketch I sent you earlier in yellow (portions of
Lots 129, 133, and 130), purple (Lot 135), blue (the easterly half of Lot 137), light blue
(Lot 136), and light green (the easterly half of Lot 130) all refer only to the plan entitled
"Plan of Lots at Englewood Beach, West Yarmouth, Mass. June 15, 1903,"which is re-
corded in Plan Book 25, Page 49, at the Barnstable County Registry of Deeds. A copy of
that plan is enclosed. The plan bears no planning board endorsement because the subdivi-
sion control law, which requires such endorsements, was not enacted until 1953.
The deeds to the parcels shown on the sketch in dark green (the westerly half of Lot 131)
and beige (Lot 134, excepting a piece at the southeast corner of the lot with 15 feet of
frontage on Maine Avenue and 58 feet of depth from Maine Avenue) refer to the 1903
plan but also refer to a plan entitled "Plan Showing Existing Buildings on Lot#132 A &
B at `Englewood Beach' West Yarmouth, Mass. as located for Frank H. Kelley, August
9, 1963, Ed Kellogg, Civil Eng'r.," which plan is recorded in Plan Book 179, Page 11, at
the Barnstable County Registry of Deeds.
I don't have a copy of the latter plan but, since it was prepared in 1963, I presume it was
also endorsed by the planning board in 1963. I will check the plan at the registry to con-
firm the endorsement date, however, and will let you know as soon as possible.

As far as the dimensions of the lots are concerned, I am enclosing an enlarged (2X) copy
of the 1903 plan and a sketch prepared by Mrs. Morin. The plan shows the dimensions of
the lots, and the sketch shows the dimensions of the parcels that comprise the Morin
property.

P.S. The letter and sketch I sent you earlier indicated that Mr. and Mrs. Morin acquired
the easterly half of Lot 137 in 1950. That was in error. Actually, they acquired that
parcel in 1946. I have enclosed three copies of a revised sketch showing the correct
acquisition date.

Enclosed are three copies of a sketch of the Morin property in West Yarmouth. Through
use of different colors, the sketch shows how the several parcels were assembled over the
years. The sketch is not to scale. Also enclosed is a check for$25.00 payable to the town
for the fee to determine whether the property fronting on Maine Avenue can be built
upon separately.
The lot numbers on the sketch refer to lots shown on a plan entitled "Plan of Lots at
Englewood Beach, West Yarmouth, Mass. June 15, 1903," which is recorded in Plan
Book 25, Page 49, at the Barnstable County Registry of Deeds.
The Morin house and garage are located on the parcel shown in yellow on the sketch.
This parcel, consisting oof pions of is ,29i 133, and 130, was conveyed by Philias T.
Morin to Francis L. Morin in 1931. Francis L. Morin conveyed this property to himself
and Myrtle H. Morin in 1955.

The easterly half of Lot 130, shown on the sketch in light green, was conveyed by John
A. Kelley and Catherine E. Kelley to Francis L. Morin and Myrtle H. Morin in 1960.
Lot 131 was conveyed by James M. Horan to Myrtle H. Morin in 1970. Mrs. Morin later
disposed of the easterly half of Lot 131, leaving her with the westerly half, which is
shown in dark green on the sketch.
Lot 134 was conveyed by Felix C. Frabotta and Stella J. Frabotta to Myrtle H. Morin in
1970. Mrs. Morin later disposed of a small piece of Lot 134 (a piece at the southeast cor-
ner of the lot with 15 feet of frontage on Maine Avenue and 58 feet of depth from Maine
Avenue), leaving her with the parcel shown in beige on the sketch.

gust 9, 1963, Ed Kellogg, Civil Eng'r.," recorded in Plan Book 179, Page 11, at the Barn-
stable County Registry of Deeds. This plan is referred to in the deeds to the parcels
shown on the sketch in dark green (the westerly half of Lot 131) and beige (Lot 134, ex-
cepting a piece at the southeast corner of the lot with 15 feet of frontage on Maine Ave-
nue and 58 feet of depth from Maine Avenue) on the sketch I sent you earlier. (The deeds
also make reference to an earlier 1903 plan.)
As you can see, the date of the planning board endorsement on the 1963 plan is illegible
but appears to be August 1963.

Dear Mr.Neitz,
Reference is hereby made to your lot inquiry received September 27,2000 concerning a portion of
Lot 356 shown on Assessors Map 22.
As you are aware a request was made for a copy of a plan dated August 9, 1963 referred to in
Attorney William Butler's letter. Upon review of this and all the pertinent information, I have
determined that the remaining portion of the lot in question does not qualify under the provisions of
Zoning Bylaw section 104.3.4 paragraphs 1, 2, or 5 because it appears that portions of the original
lot created by the aforementioned plan were conveyed by deed only and separated from the original
lot configuration, thus changing the configuration in terms of area.
