This appeal is for a special permit for the rental of motor vehicles (use
L1) at 14 Iyanough Rd. (Route 28), West Yarmouth, Assessor's Map 30, Parcel
Dl. This location is located within the Aquifer Protection Overlay District.
The applicant understands that there shall be no vehicle washing, vehicle
repair, or any other hazardous materials stored or generated on site due
to the vehicle rental business. As a result of the location being in the
Aquifer Protection Overlay District, the Health Department would also recommend
paving of the area to be used for vehicle storage. Also all outside storage
of used tires must cease and storage should be kept inside.

As this site is in the Aquifer Protection Overlay District
and close to the wetlands, strict adherance to all requirements
of 406 and 405 should be maintained.

shown on Assessor's Map 30 as Parcel Dl.
PETITIONER REQUESTS: A special permit under section 202.5,
L1 and section 406, the Aquifer Protection District to allow the
renting of rotor vehicles. .
MEMBERS OF THE BOARD PRESENT AND VOTING: Leslie Campbell, Chairman,
Fritz Lindquist, David Reid, Richard Neitz, Jeanne Bullock.
It appearing that notice of said hearing has been given by sending
notice thereof to the petitioner and all those owners of property
deemed by the Board to be affected thereby and that public notice
of such hearing having been given by publication in the Yarmouth Sun,
the hearing was opened and held on the date first above written.
This petition carve before the Board on April 9, 1992. The petition
was represented by Mr. John Handle (treasurer of the corporation).
The initial issue raised by the petitioner was his request to proceed
without the benefit of a site plan conforming to the Board's rules
and regulations. The plan proposed to be accepted is a copy of a
1965 ANR plan, upon which the existing structure and set-backs have
been sketched. The consensus of the Board was that this plan would •
not provide the Board with the details necessary to adequately address
the issues involved in this petition. The petitioner therefore agreed
to request a continuance of the hearing in order to attempt to
supplement this plan.
A Notion was made by Mr. Oman, seconded by Mr. Schmidt, to continue
the hearing until May 28, 1992, and to require proper site plan to
be filed with the Board 24 hours before that hearing.
The Board members voted unanimously in favor and the matter was
postponed for a full new hearing on May 28, 1992.
On May 28, 1992 the matter was opened for a formal hearing. The
petitioner did not present a new plan, but did present photographs
of the site and did add additional information to the old plan, and
was permitted to proceed with his presentation (without any formal
waiver of the rules and regulations having yet been allowed) . The
petitioner proposed to cc:ruence, as a secondary business at the site,
a "U-Haul" truck and trailer rental business. The 'business would
•
• have no more than 20 rental vehicles on the site at any one time.
No maintenance or service of the rental vehicles would be done on
•
site. The rental vehicles would be stored behind the building, along
the northerly portion of the westerly boundary of the site. He
proposed to create 10' conforming buffer strips along both side and
rear lot lines, but no new buffers would be created in the front (Route
28). The petitioner indicates that he currently employs 3 persons,
and that this rental business would not involve any new employees.
The Board received reports from the Site Plan Review Team, Hazardous
Waste Inspector, W.Q.A.C. technical advisor, Route 28 Task Force; •
Planning Board and Conservation Commission. No one else appeared
at the hearing either in favor or in opposition to the proposal.
' Members of the Board expressed concern that this site was not
conforming to virtually all of the current buffer and parking
requirements of the by laws, and that without a full site plan, they
could not adequately assess the landscaping or buffer needs nor could
they adequately render a decision which could be readily enforceable.
Members, also, expressed concern that this particular location is
not a safe place for a truck rental business. It is located on the
curve of Route 28 in close proximity to the meager of Route 28 and
Main Street; a busy intersection all year round. To add amateur
weekend truck drivers pulling out of this site would compound the
danger to and impact upon the traffic situation. Other members felt
that, with adequate safeguards, the proposed use met the requirements
for the special permit needed.
After considerable deliberation and discussion, a Motion was made
by Mr. Neitz, seconded by Mrs. Bullock to deny the petition. After
further deliberations this Notion was withdrawn by Mr. Neitz with
the consent of Mrs. Bullock.
A second Motion was made by Mr. Reid, seconded by Mr. Lindquist, to
grant the APD special permit and the use special permit, on the
following conditions:
1) the rental business involves no more than 20 rental vehicles on
site at any time
2) the use permit be limited to the petitioner (and not be transferred
to any successor)
3) no rental vehicles shall be serviced nor washed on site
4) no additional hazardous wastes or materials shall be stored on
site
5) all rental vehicles shall be stored to the rear of the site (within
the fenced area)
6) employee parking shall be designated at the rear of the building
7) 10' buffers shall be created and maintained on both sides (east
and west) and along the rear (north) boundaries of the site, in
compliance with the buffer standards of the by law and
8) no rental signs shall be permitted to be attached to or displayed
on rental vehicles themselves.
Mr. Reid,aMr. Czmpbell and Mr. Lindquist voted in favor of the Motion,
Mr.LNeiti rand Mats. Bullcck voted against the Motion. The Motion
therefore failed- to pass by the required super-majority.
