Proposed Renovations and Flood Mitigation
50 Powers Lane
West Yarmouth, MA
SUMMARY
The Applicant, Matt Snoap of 88 West Architecture and homeowner, Melanie Tseng, propose
upgrades to the existing one and a half story, Cape Cod style house at the property located at 50
Powers Lane in West Yarmouth, Massachusetts. The proposed activities consist of: the lifting of
the existing house by approximately 2.3 feet for further flood protection, the installation of a
new foundation and new northern access addition, addition of handicap access ramps and
stairs, addition of fill soil to meet the higher house finish flood elevation, installation of
stormwater management chambers, installation of a retaining wall, laying of pervious patio, and
mitigation plantings. Existing native and landscape plantings bordering the property are to
remain. Other than an inspection to assure continued compliance with regulations, no changes
are proposed to the existing septic system which was installed in 2016.
The 50 Powers Lane parcel totals 8,712 sf of land. The footprint of the existing dwelling is 1,211
square feet (sf) with a 572 sf deck structure, and 20 feet of accessory structure for a total of
1,803 sf of structural coverage.
The proposed limit of work (LOW) totals approximately 5,000 square feet. The LOW excludes
the driveway, leach field and existing landscaping and plants.
The footprint of the proposed dwelling upgrades is 1,467 square feet (sf) with a 547 sf deck
structure, 20 feet of accessory structure, and 247 sf access ramp for a total of 2,281 sf of
structural coverage.
The proposed project would increase the lot coverage from the current 31.9% to a total of
33.8% lot coverage. This increase is mitigated by the proposed addition of the stormwater
management collection and infiltration system for the raised house’s roof as the existing house
currently discharges directly to the land surface, which surface flows to the adjacent streets.
Erosion and stormwater run-off control barriers (silt sock or wattle) will be installed at the inner
property boundary surrounding the parcel and/or the limit of work as shown in the Plans.

1.0 GENERAL SITE DESCRIPTION
The Site is located in Yarmouth at the intersection of Powers Lane to the south and Island Road
to the west. The proposed project Site, located at 41.63446 N, 70.22995 W, includes the 50
Powers Lane parcel identified by the Yarmouth Assessor ’s Office as Parcel Map ID 15-14. The
parcel is recorded in the Barnstable County Registry of Deeds under Deed Book/Page C148207,
dated April 23, 1998 and is located within a Yarmouth Residential Zoning District (R25). Per the
Property Record Card available on the Town website, the Site parcel is approximately 0.2 -acres
(8,712 sf) and contains a single-family, 3-bedroom dwelling. Powers Lane and Island Road are
paved, public roads providing access to the surrounding private, single-family residences.
Residences surround the Site in all directions. The Site is not located on or near any Town
Conservation Land. There are resource areas in every direction from the Site. The Lewis Pond
Salt Marsh is located approximately 400 ft to the north/northeast. The Sea Gull barrier beach is
located approximately 105 ft to the east. A coastal dune is located approximately 40 feet to the
south. A National Heritage Priority Habitat of Rare Species area (PH 2156) is located
approximately 105 ft to the east and 105 ft to the south of the Site, with the Sea Gull Beach
located beyond. Sea Gull Beach faces south towards the Nantucket Sound. (see Attachment A -
Figures).
The Applicant is proposing to raise the existing residential dwelling above the flood elevation,
along with other site improvements, including the elevated deck upgrade, a new foundation,
handicap access ramps and stairs, a pervious walkway to the driveway, a retaining wall, and a
small addition at the north side (outside of wetlands buffer zones). The entirety of the Site is
located within Land Subject to Coastal Storm Flowage, subject to jurisdiction of the MassDEP
under the MA Wetlands Protection Act (WPA) and the Yarmouth Conservation Commission
under the Yarmouth Wetland Regulations (Chapter 143) of the Code of the Town of Yarmouth,
Massachusetts.
The existing parcel area is relatively flat. (see Attachment A - Figures).
1.1 Soil and Groundwater
Based on available data and maps from the US Department of Agriculture (USDA) Natural
Resource Conservation Service (NRCS), the soils in the vicinity of the proposed house addition
project limits are anticipated to be Hooksan-Dune land complex, with 15 to 35% slopes (613C),
which are sands typically associated with dunes and formed from eolian deposits. According to
available data for the existing residence, high groundwater in the vicinity of the project is
estimated to be of approximate elevation 1.5’ +/- . The soil map is provided in Attachment A -
Figures.
1.2 FEMA Designation
According to the FEMA Flood Insurance Rate Map (Panel No. 25001C0588J, effective
07/16/2014), 100% of the property is within an AE Flood Zone with a base flood elevation (BFE)

of 11.0 feet. Flood Zone AE is an area of high-risk for flood. It represents 1% annual chance of
flooding, also known as the 100-year floodplain. Properties within this Zone face a significant
risk of flooding due to proximity to coastal areas. The Limit of Moderate Wave Action line is
located just south of the Site. (see attached, Figure 2- FEMA Flood Zone Map).
1.3 State-listed Rare Species Habitat, Estimated Rare Wildlife Habitat, and
Vernal Pools
According to the most recent version of the Massachusetts Natural Heritage Atlas (15thEdition,
August 1, 2021), per the Massachusetts Endangered Species Act (MESA), there are no Estimated
or Priority Habitats of Rare Species, as administered by the Massachusetts National Heritage
and Endangered Species Program (NHESP). - (see Attachment A - Figures). According to the
MassGIS data layer, there are no certified or potential vernal pools on or near the Site.
1.4 Areas of Critical Environmental Concern (ACEC)
According to Massachusetts Department of Conservation and Recreation (DCR) maps and
regulations, no portions of the property or proposed work areas are within an Area of Critical
Environmental Concern (ACEC) - (see Attachment A - Figures). There are no ACECs within 4
miles of the property parcel.
1.5 Wetlands and Other Resource Areas
The Site was evaluated for the potential presence of wetland resource areas at or near the
property, using available digital resources and based on observations made during Site survey
and elevation assessments conducted on January 24, 2025. Resource areas were evaluated in
accordance with Delineating Bordering Vegetated Wetlands (BVW) under the the Massachusetts
Wetlands Protection Act (WPA) (September 2022), the US Army Corps of Engineers Wetlands
Delineation Manual, Technical Report Y-87-1 (January 1987), the Regional Supplement to the US
Army Corps of Engineers Wetland Delineation Manual: Northcentral and Northeast Region
Version 2.0 (January 2012), applying the Massachusetts Coastal Wetlands Regulations (“Coastal
Manual”, October 2020), as well as the Yarmouth Wetlands Protection Regulations.
The Section below provides a detailed description of the wetland resource area
identified within the project area. Site photographs are provided in the Photographic Log,
included as Attachment B.
Description of Wetland Resource Areas
Wetland resource areas are depicted on the enclosed Site Plan (see Attachment C). Based on
the delineation methodology and information gained through Site research, the following
resource areas were identified:
• Land Subject to Coastal Storm Flowage (LSCSF): As defined in 310 CMR 10.04, Land Subject to
Coastal Storm Flowage (LSCSF) is the “land subject to any inundation caused by coastal storms
up to and including that caused by the 100-year storm, surge of record or storm of record,

whichever is greater.” The Yarmouth (Chapter 143) Wetlands Bylaw Regulations provide the
same definition for “Land Subject to Coastal Flowage”.
The Federal Emergency Management Agency (FEMA) flood map was consulted to evaluate the
presence of jurisdictional Land Subject to Flooding within the study area on the Site. According
to the FEMA Flood Insurance Rate Map (FIRM), 100% of the property falls within LSCSF. The
property falls within FEMA Flood Zone AE with a Base Flood Elevation (BFE) of 11.0 feet and
defined as “areas at high risk of flooding with a 1% chance of flooding each year, known as the
100-year floodplain.”
• Coastal Dune (D): As defined in 310 CMR 10.28(2), a Coastal Bank is “any natural hill, mound
or ridge of sediment landward of a coastal beach deposited by wind action or storm overwash.
Coastal dune also means sediment deposited by artificial means and serving the purpose of
storm damage prevention or flood control.” The Yarmouth (Chapter 143) Wetlands Bylaw
Regulations provide the same definition for “Coastal Dune”. One Coastal Dune (D) resource
area was identified approximately 35-40 feet to the south.
The southern located dune is a primary dune, with frontage on the Nantucket Sound. The
landward limit of Coastal Beach marks the transition point where the Coastal Dune begins. The
dune is moderately to steeply sloped. The landward limit of Coastal Dune overlaps the town
road and row of houses directly to the south of the Site.
Coastal Dune is afforded a jurisdictional 100-foot Buffer Zone under the WPA and under
Yarmouth (Chapter 143) Wetlands Bylaw Regulations.
No other jurisdictional wetlands areas were observed at or within 100 feet of the Site.
2.0 PROPOSED PROJECT
The Applicant proposes to raise and upgrade the existing Cape Cod style house. The proposed
activities consist of:
● the lifting of the existing house by approximately 2.3 feet for additional flood protection
● the installation of new foundation for the house lift
● new northern access addition with crawl space
● installation of handicap access ramps and stairs at the east and west sides
● addition of fill soil to meet house grading
● installation of two stormwater management chambers
● installation of a retaining wall along the south side
● laying of pervious patio at the southwest side of the house
● mitigation plantings at southwest corner

Existing native and landscape plantings bordering the property are to remain. Existing plantings
along the west side are native American Beachgrass (Ammophila brevilugata) plantings in sandy
soils.
No changes are proposed to the septic system, though a system inspection is proposed during
the redevelopment work. Should the septic system fail Title 5 inspections, a septic improvement
project will be proposed under future permitting. A staging area for equipment will be located
in the driveway.
The proposed project will involve the lifting of the existing house with the use of house-lifting
equipment. All utilities will be disconnected from the house prior to initiation of work. All
equipment to be used is fully inspected and maintained to reduce potential pollution and to
optimize protective performance. After the house is lifted, the existing concrete foundation will
be removed to allow the installation of the new foundation. A temporary container for the
deconstructed materials will be placed in the driveway. The proposed house footprint location
is in kind with the existing house footprint. Site retaining walls have been proposed at the south
side of the yard, just north of the bordering landscape, to raise the grade within the parcel to
suit the higher elevation of the house and to accommodate the installation of subsurface
stormwater chambers. Roof runoff will be collected via enclosed drainage pipe and directed to
the underground recharge chambers with a minimum of 2 foot separation to groundwater to
reduce runoff to the surrounding properties and roadways as the current house discharges to
the surface. A small to mid-sized excavator and skid steer will be used for follow-up work. Once
the home has been lifted, the surrounding ground will be filled to the proposed grades
indicated on the Site Plan (Attachment C) and the existing deck will be elevated. Additional
handicap access ramps, stairs, a northern addition and pervious patio are also proposed for
installation after the house raising has been completed. The Applicant intends to begin the
proposed Site work as soon as all relevant permitting has been acquired, with a tentative start
date of September 2025.
The existing home, slated for lifting and the proposed additional site redevelopment features
are presented on the attached Site Plan. An Architectural plan is also included in Attachment C.
2.1 General Erosion and Sedimentation Control
The Applicant will implement best management practices (BMP) for erosion and sediment
control to protect downgradient areas by implementing a sediment and erosion control
program during and immediately following construction activities. Silt socks will be placed along
the inside of the property boundary/limit of work. Details of the proposed project work limits
and established erosion control features are presented on the enclosed Site Plan.
3.0 ALTERNATIVES ANALYSIS
Alternative construction locations and configurations were investigated. Ultimately, the
preferred alternative was selected because it was the option that best met all the project goals

of the Applicant for elevating the home above the flood line, improving accessibility to the
house and to the driveway, improving stormwater retention capacity, property line setbacks,
clearing limits, and topography. Other layout alternatives that were considered but not
advanced include (but may not be limited to) the following, and the primary reason for
non-selection of each alternative is also described.
● Alternative 1: No action
Discussion: This alternative did not meet any of the Applicant ’s project goals.
Furthermore, the current elevation of the existing home is sensitive to regular flooding
and elevating the home is considered an improvement to floodland protections by
increasing available recharge area.
● Alternative 2: To slope the grade rather than installing a retaining wall
Discussion: The proposed slight increase in elevation/soil fill grade is proposed to aid in
the reduction of flooding at the property. A retaining wall is proposed in order to better
contain the existing and proposed fill soils while slowing down the flow rate of surface
water to the southern adjacent road and properties. The raise in grade will increase
available storage space in the two proposed stormwater recharge chambers, allowing for
approximately 2 feet of space above existing high groundwater elevations. Should the
property elevations remain as is with no increase in elevation, on-site flooding reduction
goals would not be met. Therefore, this alternative does not meet the significant project
goal of flood reduction.
● Alternative 3: To move or expand the house
Discussion: There is no reason to relocate the house from its present footprints. This is
due to the tight land use and in order to fulfill setback requirements. Setback limits do
not apply to the proposed handicap access expansions on the west side due to Yarmouth
Zoning Bylaws which stipulate that such features are allowable.
The preferred alternative is the lifting of the dwelling and improvement of accessibility features
per the Site Plan, included as Attachment C.
The following sections outline the proposed project’s compliance with the Yarmouth
Environmental Protection Bylaw.

4.0 PROTECTION OF RESOURCE AREA INTERESTS
Approximately 5,000 sf, or 100%, of the proposed construction project is in the LSCSF. The
Applicant proposes a series of measures to protect the integrity of the resource areas both prior
to and following construction. These include structural measures such as implementation of
erosion, sedimentation, stormwater, and runoff water controls. These measures will be
implemented throughout the duration of the project in order to protect downgradient and/or
nearby resource areas.
The homeowner proposes to raise the foundation of the house by approximately 2.3 ft
elevation. Proposed soils will be added in a gently sloped manner from the newly added
retaining wall and sloping upwards towards the base of the new foundation. The retaining wall
will be approximately 1.75 feet high. Approximately 2,000 square feet of the 5,000 LOW area is
proposed to be filled. With an average height change within the 1-1.75 foot range, we have
conservatively estimated that a total approximate volume of 115 cy ± fill soils will be needed to
fill the yard.
Anticipated construction project temporary disturbances are located within the State and Town
defined LSCSF area and overlapping the 50-100 foot Buffer Zone to the Coastal Dune. Table 1
details the temporary and permanent impacts by resource area and impact type.
A discussion of the proposed project as related to the Yarmouth Wetlands Protection
Regulations follows

4.1 Town of Yarmouth Regulations and Wetlands Protection Bylaws
The following section outlines the proposed project’s compliance with the Town of Yarmouth
Wetland Protection Bylaw (YWPB, Chapter 143).
YWPB 2.04 - Notices of Intent
Per Town Regulation 2.04, an abutters-notification letter has been prepared for all abutters
within 100 feet of the Site. This form will be sent out to abutters concurrently, on the same day,
as the Town and State NOI filing. A copy of the Assessor ’s list of Abutters and a copy of the
completed abutter-notification form are provided as Attachment D.
YWPB 2.05 - Submittal Requirements
Per Town Regulation 2.05, additional submittal requirements related to the Site Plan have been
considered and included. Proposed systems will include the necessary standards of continued
protective performance, as discussed throughout this filing. The Site Plan is signed and stamped
by a registered, professional engineer for performance of hydrology design and studies (see
Attachment C).
YWPB 4.03 - Coastal Dunes
Per Town Regulation 4.03(3), the proposed work is aimed to fulfill the Performance Standards
for an activity within 100 feet of Coastal Dune that indicates that no adverse effects occur to the

Dune as a result of the proposed work. Mitigation plantings are proposed at the southwest of
the property. Regulation 4.03 (3)(f)(a) allows for plantings compatible with the natural
vegetative cover. Due to the Applicant ’s efforts to minimize disturbance to the Dune and Buffer
area, STE requests a variance to the Town of Yarmouth Wetlands Regulation 4.03 (3).
YWPB 4.10 - LSCSF
Per Town Regulation 4.10(3)(a), the proposed work is expected to fulfill the General
Performance Standards for an activity within LSCSF that involves the building upon, removing,
filling or altering of land such that it shall not have an adverse effect on the interests protected
by the bylaw.
The proposed house location footprint will not change. All proposed work in the LSCSF resource
area will be minimally disruptive. The proposed upgrades in land use aims to reduce localized
flooding. The proposed work shall meet and improve upon the performance standards set out
in 4.10(3)(a)i and viii, in that it will increase the ability of the land to absorb and contain flood
waters and to buffer downgradient areas from flood damage. The proposed work shall restore
the interest of flood control by increasing the vadose zone at the property, allowing for greater
water retention while not compromising the dwelling structure.
The proposed work shall meet the performance standards set out in 4.10(3)(a)ix, whereby the
existing septic system will be inspected during proposed property development work and it shall
remain if it continues to meet all Title 5 and Board of Health thresholds.
The proposed work shall meet the performance standards set out in 4.10(3)(a)xi, whereby any
proposed deck must be securely anchored to a footing or foundation.
STE requests a variance to the Town of Yarmouth Wetlands Regulations which limit fill and
disturbance to the wetland resource area outlined above. The proposed work is meant to
improve the functions of the LSCSF by reducing impacts from flooding to the Site and
surrounding areas.

YWPB 6.02 - Mitigation and Restoration
According to Town Regulation 6.02(1), the proposed work is not located within 35 feet of the
Coastal Dune.

According to Town Regulation 6.02(2) “Where a 50-foot undisturbed buffer zone exists prior to
the proposed work, and shall remain intact upon project completion, further buffer zone
enhancement shall not be required.” Only a small portion of land within the 0-50 foot buffer
zone is located within property boundaries. Therefore, the Applicant proposes returning the
southwestern triangle of lawn area (located within 50 feet of the Dune) back to native land.
The Applicant requests a waiver to Town Regulation 6.02(3) which states that “Where a 50-foot
undisturbed buffer zone does not exist prior to the proposed work, any work proposed within
the 100-foot buffer zone shall be subject to mitigation planting requirements intended to
restore, in so far as is possible, both the dimensions of a 50-foot undisturbed buffer and its
vegetation.” Because a majority of the 0-50 foot Buffer Zone is located off of property land, and
because road and residential developments are located even closer/on the dune resource area,
we feel that the interpretation of the Mitigation regulations may be such that the addition of
mitigation in the southwestern lawn area and maintenance of existing native vegetation within
the Buffer zone reflect the most reasonable and beneficial mitigation efforts available for the
Site conditions.
4.2 Massachusetts Wetlands Protection Regulations

Per the Massachusetts Wetlands filing instructions, the WPA Form 3 and Filing Fee Transmittal
form are signed and included as Appendix F. This NOI will be filed electronically and a check
sent to the Massachusetts DEP at the same time as the town filing.

B. Fees
Fee should be calculated using the following process & worksheet. Please see Instructions before
filling out worksheet.
Step 1/Type of Activity: Describe each type of activity that will occur in wetland resource area and buffer zone.
Step 2/Number of Activities: Identify the number of each type of activity.
Step 3/Individual Activity Fee: Identify each activity fee from the six project categories listed in the instructions.
Step 4/Subtotal Activity Fee: Multiply the number of activities (identified in Step 2) times the fee per category
(identified in Step 3) to reach a subtotal fee amount. Note: If any of these activities are in a Riverfront Area in
addition to another Resource Area or the Buffer Zone, the fee per activity should be multiplied by 1.5 and then
added to the subtotal amount.
Step 5/Total Project Fee: Determine the total project fee by adding the subtotal amounts from Step 4.
Step 6/Fee Payments: To calculate the state share of the fee, divide the total fee in half and subtract $12.50. To
calculate the city/town share of the fee, divide the total fee in half and add $12.50.
