Dear Mr, Tolley, March 7. 2025 The Building Department has been in contact with you (letter dated M412024) regarding the retail sales of lobsters From this address. There is a Zoning Board of Appeals decision #5134 which voted to uphold the decision of the Building Commissioner and deny the request for a variance. It has come to our attention that lobsters arc still being offered for sale; at this address. This is a violation of Section 202 of the Town of Yarmouth Zoning Bylaw; 202.1 Application. No building or structure shall he erected and no premises shall he used, except as set firth in the Lac Regulations .Schedule, or in other sections of this hrlmv. If a use is not speciflical1v allowed by right or special permit, it shall be considered to he not allowed tutless an appeal is taken under .section 102.2.3 and it is shown be.mnd a reasonable doubt to he of similar nature and at least no snore noxious nor detrimental to the welf ire of the neighborhood than :r specifically allowed use. Failure to comply with the provisions of the zoning bylaw may result in penalties as prescribed. 101.3 Penalties. An-v person violating arty of the provisions of this bvlcni, shall be fined not more than three hundred dollars (a�3t70.00) fair each offense. Each clan that such violation continues shall constitute a separate offense. You are hereby ordered to abate and correct said violations or seek relief from the Zoning Board of Appeals as allowed by MGL Ch 40a §7 & § 15.
