I, Stephen Ferguson, do depose and state under the pains and penalties of perjury as
follows:
1. 1 am over the age of 18. of sound mind, and the facts contained in this affidavit are
of my own personal knowledge.
2. 1 reside at 42 Iroquois Bivd West Yarmouth, Massachusetts.
3. 1 have Personally known Jon Tolley since, 1962.
4. 1 also personally knew Jon Tolley's father, Frederick ("Fred") W. Tolley, who resided
at 23 Irogouis Blvd since 1957.
5. lam well aware of Mr. Tolley's business selling his catch at his personal residence
at 23 Iroquois Blvd, West Yarmouth, Massachusetts.
6. Mr. Tolley currently sells fish, shellfish, and lobsters at 23 Irogouis Blvd, and has
been principally involved in such sales continuously and regularly since
approximately 1975.
7. Prior to 1975, Mr. Tolley assisted his father in catching and selling fish, shellfish,
and lobsters. Mr. Tolley has been involved in the catching and selling fish, shellfish,
and lobsters since he was a little boy.
8. Mr. Tolley's father Fred sold fish, shellfish, and lobsters at 23 Irogouis Blvd
continuously and regularly for approximately 32 years during his ownership of 23
Iroquois Blvd, from 1957 to 1989.
9. The sale offish, shellfish, and lobsters from 23 Iroquois Blvd by the owners of the
property has gone on continuously and uninterrupted since 1962 to the present.
