Sorry for the delay in response.Thank you for following up after my question from last Friday.
After review of the attached documents and the bylaw from 1972, I agree that the property is protected from
merger.As you have indicated,the pre-existing, non-conforming dimensions are protected per section 104.3.4
para. 5 of the zoning bylaw.

Mark, I went back to the prior plan and the covenants attached to it and could not find any reference to a
dedicated conservation area being part of the subdivision.
