Dear Ms. Reda:
Please be advised that this office, together with Cape Cod Engineering, Inc.,
represents the above -referenced Applicant, Rosangela Caloiero ("Applicant'). This
serves as a Request for a Superseding Order of Conditions ("SOC"), pursuant to 310
CMR 10.05(7)(b), on grounds that the Yarmouth Conservation Commission
("Commission") did not hold a public hearing on the Notice of Intent ("NOI") within
twenty-one days of the date that the NOI was filed as required by M.G.L. c. 131, §
40 and 310 CMR 10.05(5). A Two Hundred and Forty -Five Dollar ($245.00) filing
fee was sent on this day to the DEP Lock Box in Boston via certified mail. Copies
of the transmittal form and the check are attached hereto as Exhibit 1.
INTRODUCTION
The Applicant is the owner of the land and single-family dwelling at 29 Oyster
Cove Road in South Yarmouth. A copy of the deed of record is attached as Exhibit
2. The property has an appurtenant right to use an area of land identified as "Beach
Area" on a plan recorded in the said Registry of Deeds in Plan Book 136, Page 27.

Exhibit 3. The deed explicitly states that the property conveyed includes "the right
to use the beach area as shown on the plan."
The land that is subject to the easement is owned by Ayacht, LLC, a Florida
limited liability company with an address of 352 Harbor Drive, Naples, Florida. The
deed of record of the property states that the land is "[s]ubject to the rights of all
persons lawfully entitled to use the Beach Area and Oyster Cove Road." Exhibit 4.
The Applicant's predecessor -in -interest, Richard Bates, maintained a pier on
the Beach Area. This is evidenced by Chapter 91 Interim Approval No. 4215 issued
to Richard Bates on November 7, 1994, and recorded in the said Registry of Deeds
in Book 9444, Page 94. Exhibit 5. Further evidence of this pier is set forth in the
aerial imagery attached hereto showing the pier in 2010, 2014 and 2021. Exhibit 6.
When the Applicant purchased the property in December of 2022, the
purchase included the Chapter 91 License. The Applicant has since submitted an
application with the DEP for a new Chapter 91 License.
The pier is damaged and only remnants remain. The Applicant seeks renovate
the pier, and to properly permit it under the wetlands Protection Act (M.G.L. c. 131,
§ 40) and properly license it under the waterways Program (M.G.L. c. 91).
THE PROPOSED PROJECT
A. Project Description.
The proposed project is to remove the remnants of the existing dock facility
and to construct and maintain a new pier, ramp and float in its place. The new dock
will extend from the shore over an existing seawall to the line of MHW, and then
seaward to a point 80 feet from MHW. The dock will be comprised of a 4' x 64' pier
elevated on timber pilings, a 2.5' x 14' ramp, and a 6' x 20' float. The project is
depicted on the plan entitled: "Plan Showing Proposed Modification and
Maintenance of a Pile Supported Pier, Ramp and Float in Bass River at 0 Oyster Cove
Road, South Yarmouth MA," dated September 5, 2024, prepared by Cape Cod
Engineering, Inc., Robert M. Perry, PE, which plan is part of the NOI. A copy of the
plan is attached as Exhibit 7.
The work to implement the proposed project involves removal of all portions
of the existing facility and, thereafter, installation of a pile -supported elevated pier,
seasonal ramp, and pile -held float. The existing floats and some debris from recent
damage have already been removed. Remaining debris materials can be hand -carried
out and transported away. Replacement pilings and new pilings shall be installed

with portable tripod and barge -based driving methods to install the pier. Following
that, hand carpentry methods to fit and affix the pier frame. Planking and railings
follow by similar hand work activities. Lastly the seasonal ramp and float will be
delivered via the waterway and attached to the pier end with attachment to the two
anchor pilings. Water depth is available to float small vessels offering an
improvement over existing conditions for clearance to the bottom. The ramp and
float shall be removed seasonally and stored in an upland location.
B. Wetland Resources.
Coastal wetland resources in the area include Coastal Bank (310 CMR 10.30),
Coastal Beach (310 CMR 10.27), Salt Marsh (310 CMR 10.32), Land Containing
Shellfish (310 CMR 10.34), Land Subject to Coastal Storm Flowage (310 CMR
10.04), and Riverfront Area. The project involves activities subject to M.G.L. c. 91,
so the proposed activity is exempt from the Riverfront Act.
C. The Pro osed Pro'ect Com lies with AiDnlicable Performance
Standards.
The project involves work in Coastal Bank (310 CMR 10.30), Coastal Beach
(310 CMR 10.27), Salt Marsh (310 CMR 10.32), Land Containing Shellfish (310
CMR 10.34), Land Subject to Coastal Storm Flowage, and Riverfront Area. The
work will have no significant adverse impacts to wetlands resource areas and meets
all applicable performance standards.
PROCEDURAL HISTORY
The NOI was filed with the Commission on February 5, 2025. The
Commission scheduled the NOI for a public hearing on February 20, 2025. However,
the Commission was unable to hold a public hearing because of a lack of quorum.
The twenty-first date after filing the NOI was February 26, 2025. The Commission
failed to hold a hearing on or before February 26, 2025. This appeal is timely filed
within 10 business days of the twenty-first day after the NOI was filed.
ALLEGATION OF ERROR
M.G.L. c. 131, § 40 and 310 CMR 10.05(5) require the Commission to hold a
public hearing within 21 days of receipt of a Notice of Intent. In this case, an NOI
was filed on February 5, 2025, and the Commission failed to hold a public hearing
within 21 days, or on or before February 26, 2025. The Applicant did not waive her
right to timely hearing.

The Supreme Judicial Court ruled in Oyster Creek Preservation, Inc. v.
Conservation Commission of Harwich, 449 Mass. 859 (2007), that, when a
conservation commission does not hold a public hearing within the required twenty-
one -day period and the Applicant appeals to the DEP, it is the DEP's superseding
order that controls the project.
Since the Commission did not hold a public hearing within 21 days after the
filing of the NOI, the Commission forfeited the right to enforce the Yarmouth
Wetlands Protection Bylaw and Yarmouth Wetlands Protection Regulations and the
Applicant is eligible to request the Department to issue a Superseding Order of
Conditions under M.G.L. c. 131, § 40. See, Oyster Creek Preservation, Inc. v.
Conservation Commission of Harwich, 449 Mass. 859 (2007).
CONCLUSION
The NOI and supporting documentation demonstrate that the proposed work
will meet the applicable performance standards set forth in the Wetlands Protection
Act and the Regulations and, as a result, the Applicant asserts that the project should
be approved. Accordingly, the Applicant requests that the Department issue a SOC
approving the project.

Interim Approval to -- maintain stairs, a pier, ramp, and pile -held floats

and has submitted plans of the same; and whereas due notice of said
application has been given to the -- Board of Selectmen -- of the Town of
-- Yarmouth.
NOW, said Department, having fully considered said application, hereby,
authorizes the said -- Richard Bates --, subject to the provisions of 310
CMR 9.10, to -- maintain stairs, a pier, ramp, and pile -held floats -----
in and over the waters of -- Bass River -- in the Town of -- Yarmouth --
and in accordance with the locations shown and details indicated on DEP
Interim Approval Plan No. 4215 (3 Sheets), original of which is on file in
the office of said Department.
The structures hereby authorized shall be limited to the following
use: noncommercial docking and boating access to navigable waters.
This Interim Approval is valid for 30 years from the date of issuance. If
the affected property is transferred to a new owner, for valuable
consideration, this approval shall expire one year from the date of
transfer.
This Interim Approval shall be void unless the same is recorded within 60
days from the date hereof, in the Registry of Deeds for the County of
-- Barnstable --.

1.) In accordance with any license condition, easement, or other public
right of lateral passage that exists in the area of the subject
property lying between the high and low water marks, the Licensee
shall allow the public in the exercise of such rights to pass freely
over all structures within such intertidal area.
Accordingly, the Licensee shall place and maintain, in good repair, a
ladder and public access sign on both the northerly and southerly
sides of the pier authorized herein, adjacent to the mean high water
shoreline. The ladders shall be constructed of durable materials,
shall be fixed to the pier in such a manner so as not to rest on the
marsh, shall have a minimum width of 2.0 feet, and shall have adequate
railings extending above the pier decking in order to facilitate safe
passage.
The signs shall include any statement and/or logo specified by the
Department and shall otherwise conform to the "Signage Specifications
of the Waterways Regulation Program", as may be amended hereafter. A
Licensee's copy of such written specifications is provided with this
license, and an additional copy shall be kept in the Department's
permanent license file (No. 4215) . Nothing in this condition shall be
construed as preventing the Licensee from excluding the public from
portions of said structure or property not intended for lateral
passage.
2.) The floats shall be taken out of the water and stored in a secure
upland location in the event a Hurricane is forecasted.
3.) The project authorised herein has been completed in conformance with
the accompanying License Plan. The issuance of this License,
therefore, fulfills the Licensee's obligation to obtain a Certificate
of Compliance pursuant to 310 CMR 9.19.

1. Nothing in this Interim Approval shall be so construed as to impair the legal rights
of any person.
2. Any change in use or any structural alteration of any structure or fill authorized
herein shall require the issuance of a Waterways License. Any unauthorized change in use
or unauthorised structural alteration of any structure or fill authorized herein shall
reader this Interim Approval void.
3. This Interim Approval authorizes structures) and/or fill on:
.L Private Tidelands. In accordance with the public easement that exists by law on
private tidelands, the licensee shall allow the public to use and to pass freely

JL Commonwealth Tidelands. The Licensee shall not restrict the public's right to use

water mark. Said lands are held in trust by the Commonwealth for the benefit of
the public.
a Great Pond of the Commonwealth. The Licensee shall not restrict the public's
right'to use and to pass freely upon lands lying seaward of the high water mark
for any lawful purpose.
No restriction on the exercise of these public rights shall be imposed
unless otherwise expressly provided in this Interim Approval.
4. Unless otherwise expressly provided by this Interim Approval, the licensee shall not
limit the hours of availability of any areas of the subject property designated for public
passage, nor place any gates, fences, or other structures on such areas in a manner that
mpede or discourage the free flow of pedestrian movement thereon.
