RE: 125 Route 6A Yarmouth Port,MA 02675—BLDR-23-672- Certificate of Occupancy
Dear Mr. Brooks,
This letter is to inform you that 125 Route 6A is being occupied without a valid certificate of occupancy.The permit
holder was granted a temporary certificate of occupancy on August 28,2024,which expired on October 31,2024. We
have not received the required information, and the final work needed to issue a permanent certificate of occupancy has
not been inspected. This is a violation of section 111.1 of the Massachusetts State Building Code.
111.1 Use and Occupancy. "No building or structure shall be used or occupied, and no change in the existing occupancy
classification of a building or structure or portion thereof shall be made until the building commissioner, or inspector of
buildings, or when applicable, the state inspector, has issued a certificate of occupancy therefore as provide herein." ...
102.8.1 Owner Responsibility. The owner shall be responsible for compliance with the provisions of 780 CMR.
To remedy this violation make arrangements to have the proper inspections for a certificate of occupancy. You are
required to respond within 7 days of this letter.You are hereby directed to cease and desist occupying this building until a
valid certificate of occupancy permit is issued.
Failure to comply with the MA State Building Code 780 CMR is subject to fines and penalties as prescribed in MGL CH
143 section 91. Each day constitutes a new violation.
You may appeal this letter to the Building Code Appeals Board in accordance with M.G.L. c. 143 §100, within 45 days of
this letter.
