RE: 443 Winslow Gray Rd—shed without proper setbacks — storage collintainer
Dear Mr. Kosta,
This letter constitutes a formal zoning enforcement order under MGL Ch 40A.
The Building Department has been in contact with you over the last year about the shed on your property. The
shed was moved into the setback, and part of the shed is not on your property according to the site plan that you
presented. You have made numerous visits to the Building Department, and have indicated that you intend to
apply for a permit or seek relief from the Zoning Board of Appeals. To date we have not received an application
for a permit, nor has the Board of Appeals received an application for relief from the Zoning Bylaws.
This is a violation of the Town of Yarmouth Zoning Bylaws section 203.3
203.5 Table of Dimensional Requirements note E
E. Side and Rear setbacks for accessory buildings less than one hundred fifty (150)square feet and single story
shall be six(6)feet in all districts, but in no case built closer than twelve (12)feet to any other building.
You are hereby ordered to abate or correct said violations within thirty(30) days. Failure to do so may result in
criminal /civil complaints being filed against you. You may be subject to fines as prescribed by pertinent laws
and regulations. You also have the right to appeal this decision with the Zoning Board of Appeals.
You are subject to daily fines of up to three hundred dollars for this continued violation.
101.3 Penalties.Any person violating any of the provisions of this bylaws shall be fined not more than three
hundred($300.00)for each offense. Each day that such violation continues shall constitute separate offense.
This order may be appealed to the Zoning Board of Appeals as prescribed under MGL c.40A, §§7 8 and 15T
There is also a storage container that has been placed without the benefit of the proper permit. This is a violation
of Section 105.1 of the Massachusetts State Building Code;
R105.1 Required. It shall be unlawful to construct, reconstruct, alter, repair, remove or demolish a building or
structure; or to change the use or occupancy of a building or structure; or to install or alter any equipment for
which provision is made or the installation of which is regulated by 780 CMR without first filing an application
with the building official and obtaining the required permit.
R114.4 Violation Penalties.Any person who violates a provision of 780 CMR or fails to comply with any of the
requirements thereof or who erects, constructs, alters or repairs a building or structure, or makes a change of
use in violation of the approved construction documents or directive of the building official, or of a permit or
certificate issued under the provisions of 780 CMR, shall be subject to penalties as prescribed by M.G.L. c. 143,
§94(a).
To remedy this violation make proper application for the required permits, and receive the proper permits for
this violation.

Dear Mr. Kosta,
The Building Department has been in contact with you about the shed on your property. The shed was moved
into the setback, and part of the shed may not be on your property.
This is a violation of the Town of Yarmouth Zoning Bylaws section 203.3
203.5 Table of Dimensional Requirements note E
E. Side and Rear setbacks for accessory buildings less than one hundred fifty (150)square feet and single
story shall be six (6)feet in all districts, but in no case built closer than twelve (12)feet to any other building.
To date the shed has not been moved or demolished, nor has any application for relief been applied for from
the Zoning Board of Appeals.
You are subject to daily fines of up to three hundred dollars for this continued violation.
101.3 Penalties.Any person violating any of the provisions of this bylaws shall be fined not more than three
hundred($300.00)for each offense. Each day that such violation continues shall constitute separate offense.
To abate this violation, make proper application for relief from the Zoning Board of Appeals, or a permit to
demolish/move the shed to conform with the Town of Yarmouth Zoning Bylaws.

Dear Mr. Kosta,
This letter constitutes a formal zoning enforcement order under MGL Ch 40A.
The Building Department has been in contact with you over the last year about the shed on your property. The shed was
moved into the setback,and part of the shed may not be on your property.You have made numerous visits to the Building
Department, and have indicated that you intend to apply for a permit or seek relief from the Zoning Board of Appeals. To
date we have not received an application for a permit,nor has the Board of Appeals received an application for relief from
the Zoning Bylaws.

RE: 443 Winslow Gray Rd—shed without proper setbacks
Dear Mr. Kosta,
This letter constitutes a formal zoning enforcement order under MGL Ch 40A.
The Building Department has been in contact with you over the last year about the shed on your property. The shed was
moved into the setback, and part of the shed is not on your property according to the site plan that you presented. You have
indicated that you intend to demolish this shed,but to date the shed is still in violation.
This is a violation of the Town of Yarmouth Zoning Bylaws section 203.3
203.5 Table of Dimensional Requirements note E
E. Side and Rear setbacks for accessory buildings less than one hundred fifty(150)square feet and single story shall be six
(6)feet in all districts, but in no case built closer than twelve(12)feet to any other building.
You are hereby ordered to abate or correct said violations immediately. Failure to do so may result in criminal/civil
complaints being filed against you. You may be subject to fines as prescribed by pertinent laws and regulations. You also
have the right to appeal this decision with the Zoning Board of Appeals.
You are subject to daily fines of up to three hundred dollars for this continued violation.
101.3 Penalties.Any person violating any of the provisions of this bylaws shall be fined not more than three hundred
($300.00)for each offense. Each day that such violation continues shall constitute separate offense.
This order may be appealed to the Zoning Board of Appeals as prescribed under MGL c.40A, §§7 8 and 15T
To remedy this violation the shed must be moved or demolished.
