Dear Member of the Commission,
On behalf of the Town of Yarmouth, Bowman Consulting Group is hereby enclosing one (1) full set of the
Request for Determination of Applicability (RDA) package, one (1) digital copy, one (1) original and seven (7)
copies of the plans, and one certified list of abutters to fulfill the requirements of the Massachusetts Wetlands
Protection Act and the Town of Yarmouth Rules and Regulations. This submittal is a formal RDA for Buck
Island Road Sidewalk Improvements within the Town of Yarmouth. As part of the filing, we have attached
the following:
Appendix A: Project Description and Alternatives Analysis
Appendix B: Project Locus
Appendix C: Project Plan
Appendix D: Certified Abutters List and Abutter Notifications
The project proponent is the Town of Yarmouth and request that the filing fee be waived. The limits of the
wetland were obtained through MassGIS. The project limits start at the roadway edge to approximately 10
feet off the roadway edge. We request a reprieve from meeting the requirement to stake out the wetland
and project limits from the Town’s regulations.

Project Description
Buck Island Road Sidewalk Improvements
Buck Island Road Between Town Brook Road and Higgins Crowell Road
Work Description (use additional paper and/or provide plan(s) of work, If necessary):
The Town of Yarmouth is undertaking a project to improve pedestrian accessibility along Buck Island
Road. The proposed design meets the requirements of Public Right-of-Way Accessibility Guidelines
(PROWAG) and Americans with Disabilities Act (ADA). As part of this project, a portion of the proposed
sidewalk on the eastern end is located within the 200-foot Riverfront Area. The proposed work includes
the construction of approximately half a mile of sidewalk, including new curb ramps and crosswalks. The
portion within the Riverfront Area consists of approximately 60 square feet connecting the proposed
sidewalk to the existing curb ramp at Higgins Crowell Road. Sediment and Erosion control measures will
be employed in accordance with MassDOT specifications. Nearly all work will occur within the existing
road right-of-way.
No work will be within wetland resource areas. The project can be considered a limited project under 310
CMR 10.24(7)(c)1, which states “maintenance and improvement of existing public roadways, but limited to
widening less than a single lane, adding shoulders, correcting substandard intersections, and improving
drainage systems.”
The location of the wetlands was obtained from Mass GIS.
Scope of Alternatives
An alternatives analysis was conducted for this project. The purpose of the project is to improve
pedestrian accessibility along Buck Island Road. Since the purpose of the work within the Riverfront
Resource Area is to connect the proposed sidewalk with the existing curb ramp at Higgins-Crowell Road,
no other alternatives were identified that would serve the needs of the project and would fall outside the
Riverfront Resource Area.

GENERAL NOTES
1.PER MASSACHUSETTS LAW, CONTRACTORS SHALL CALL 1-888-DIG-SAFE,
(1-888-344-7233) AND TOWN OF YARMOUTH UTILITY DEPARTMENTS PRIOR TO ANY
UNDERGROUND EXCAVATION ON SITE. THE DIG-SAFE VERIFICATION NUMBER
SHALL BE SUBMITTED TO THE TOWN OF YARMOUTH PRIOR TO ANY
CONSTRUCTION WORK.
2.JOINTS BETWEEN NEW HMA ROADWAY PAVEMENT AND SAWCUT EXISTING
PAVEMENT SHALL BE SEALED WITH BITUMEN AND BACKSANDED.
3.ALTERATIONS TO EXISTING VEGETATION (TRIMMING, LIMBING, TRANSPLANTING,
ETC.) SHALL BE MADE IN A MANNER THAT MINIMIZES THE DAMAGE TO THE
VEGETATION AND MAXIMIZES ITS CHANCE FOR SURVIVAL. PROFESSIONAL
LANDSCAPING OR TREE TRIMMING SERVICES SHALL BE EMPLOYED FOR SUCH
WORK AT THE DIRECTION OF TOWN OF YARMOUTH OR ITS DESIGNATED AGENT.
THE CONTRACTOR SHALL TAKE SPECIAL CARE NOT TO DAMAGE ANY EXISTING
VEGETATION WHICH OVERHANGS OR IS ADJACENT TO THE CONSTRUCTION
ZONE. ANY DAMAGE THAT IS CAUSED BY THE CONTRACTOR'S NEGLIGENCE
SHALL BE FIXED AT HIS OWN EXPENSE.
4.THE CONTRACTOR SHALL BE RESPONSIBLE FOR ALL CONSTRUCTION LAYOUT
SURVEYS. THE CONTRACTOR SHALL EMPLOY A COMPETENT REGISTERED
SURVEYOR, REGISTERED IN THE COMMONWEALTH OF MASSACHUSETTS TO
COMPLETE ALL CONSTRUCTION LAYOUT.
5.FIELD SURVEY AND LAYOUT DURING CONSTRUCTION WILL BE PROVIDED BY THE
CONTRACTOR, AS REQUIRED TO PROPERLY PERFORM THE WORK. IT IS THE
CONTRACTOR'S SOLE RESPONSIBILITY TO ENSURE THAT THE EXISTING
CONDITIONS ARE NOT OBLITERATED BEFORE ADEQUATE SURVEY CONTROL
POINTS HAVE BEEN ESTABLISHED OR LOCATED, AND CONSTRUCTION LAYOUT
CAN BE COMPLETED. THE CONSTRUCTION LAYOUT SHALL BE PROVIDED IN
SUFFICIENT DETAIL, THEREBY ENABLING THE CONTRACTOR TO CONSTRUCT THE
PROJECT IN CONFORMITY WITH THE PLANS AND SPECIFICATIONS. THE CITY OR
ITS DESIGNATED REPRESENTATIVES WILL NOT AUTHORIZE CONSTRUCTION
ACTIVITIES TO BEGIN UNTIL IT IS SATISFIED THAT ALL GROUND CONTROL HAS
BEEN ESTABLISHED, TIED DOWN, AND DULY RECORDED IN STANDARD FIELD
BOOKS.
6.THE FREQUENCY AND APPLICATION RATES FOR DUST CONTROL ITEMS SHALL BE
SUFFICIENT TO PREVENT THE GENERATION OF AIRBORNE DUST FROM PROJECT
AREAS. THE TOWN OF YARMOUTH OR ITS DESIGNATED REPRESENTATIVE SHALL
HAVE AUTHORITY TO REQUIRE ADDITIONAL DUST CONTROL MEASURES AT THEIR
DISCRETION, WHICH SHALL BE PROMPTLY APPLIED BY THE CONTRACTOR.
7.ALL EXISTING CONDITIONS SHALL BE FIELD VERIFIED BY THE CONTRACTOR
PRIOR TO CONSTRUCTION.
8.WHERE AN EXISTING UTILITY IS FOUND TO CONFLICT WITH THE PROPOSED
WORK, THE LOCATION, ELEVATION, AND SIZE OF THE UTILITY SHALL BE
ACCURATELY DETERMINED WITHOUT DELAY BY THE CONTRACTOR, AND THE
INFORMATION FURNISHED TO THE ENGINEER FOR THE RESOLUTION OF THE
CONFLICT.
9.THE LIMITS OF CLEARING, GRADING, AND DISTURBANCE SHALL BE KEPT TO A
MINIMUM WITHIN THE PROPOSED AREA OF CONSTRUCTION, AREAS OUTSIDE OF
THESE LIMITS, AS DEPICTED ON THE PROJECT SITE PLANS, SHALL REMAIN
UNDISTURBED IN A COMPLETELY NATURAL CONDITION. AREAS OUTSIDE THE
LIMITS OF PROPOSED WORK DISTURBED BY THE CONTRACTOR'S OPERATIONS
SHALL BE RESTORED BY THE CONTRACTOR TO THEIR ORIGINAL CONDITION AT
THE CONTRACTOR'S EXPENSE.
10.ASPHALT EMULSION FOR TACK COAT SHALL BE PLACED PRIOR TO PAVEMENT
PLACEMENT ON THE CONCRETE BASE OR MILLED PAVEMENT, AND ON ANY NEW
COURSE WHICH HAS BEEN OPEN TO TRAFFIC, OR ANY NEW COURSE WHICH HAS
BEEN EXPOSED FOR MORE THAN 3 DAYS, AND/OR AS DIRECTED BY THE TOWN OF
YARMOUTH OR ITS DESIGNATED REPRESENTATIVE. IT SHALL ALSO BE APPLIED
TO VERTICAL PAVEMENT FACES BETWEEN ADJOINING PAVEMENT SECTIONS. ALL
APPLICATIONS ON BOTH HORIZONTAL AND VERTICAL SURFACES SHALL BE IN
ACCORDANCE WITH MASSDOT SPECIFICATIONS.
11.UNDER NO CIRCUMSTANCES WILL THE CONTRACTOR BE ALLOWED TO STOCKPILE
REMOVED PAVEMENT MATERIALS WITHIN OR OUTSIDE THE PROJECT LIMITS.
SUCH MATERIALS SHALL BE PROMPTLY REMOVED FROM THE PROJECT AND
DISPOSED OF PROPERLY AT AN APPROVED OFF-SITE LOCATION.
12.THE CONTRACTOR SHALL TAKE ALL NECESSARY PRECAUTIONS TO PREVENT
DAMAGE TO BUILDINGS, WALLS, FENCES, AND WALKS THAT ARE ABUTTING
SIDEWALKS AND DRIVEWAYS DESIGNATED FOR CONSTRUCTION OR
REPLACEMENT. WHERE INDICATED OR DIRECTED, NEW SIDEWALKS SHALL MEET
SAID BUILDINGS, WALLS, FENCES UNLESS OTHERWISE SPECIFIED.
13.ALL STAGED EQUIPMENT AND MATERIALS SHALL BE PLACED AN ADEQUATE
DISTANCE (AS DETERMINED BY THE ENGINEER) FROM THE ROADWAY TO AVOID
INTERFERENCE WITH VEHICULAR OR PEDESTRIAN TRAFFIC.
14.CLEANING AND SWEEPING OF PAVEMENT WILL INCLUDE REMOVAL OF ALL
PAVEMENT DEBRIS PRIOR TO THE PLACEMENT OF EACH BITUMINOUS PAVEMENT
LIFT. ALL CLEANING AND SWEEPING SHALL BE DONE TO THE SATISFACTION OF
THE TOWN OF YARMOUTH OR ITS DESIGNATED REPRESENTATIVE.
15.THE COST OF ANY CURB CUTTING REQUIRED TO INSTALL NEW CURB IS INCLUDED
IN THE PRICE FOR THE NEW CURB.
16.EXISTING CONCRETE WALKS (LEADING TO HOUSE FRONT DOORS) SHALL BE
SAWCUT AT THE JOINT NEAREST THE BACK OF SIDEWALK AND REPLACED TO THE
SIDEWALK LIMITS SHOWN.
17.THE CONTRACTOR SHALL BE RESPONSIBLE TO ENSURE THAT AT THE END OF
THE FINAL PAVING OPERATIONS, FLOW TO EXISTING AND PROPOSED DRAINAGE
STRUCTURES HAVE BEEN REESTABLISHED AND NO ISOLATED DEPRESSIONS
EXIST.
18.THE CONTRACTOR SHALL CAREFULLY COORDINATE ALL WORK WITH THAT OF ALL
SUBCONTRACTORS, THE CITY, UTILITY COMPANIES AND OTHER CONTRACTORS
WORKING WITHIN THE PROJECT LIMITS.
19.THE CONSTRUCTION SITE MUST BE ACCESSIBLE TO EMERGENCY VEHICLES AT
ALL TIMES. CONSTRUCTION ACTIVITIES SHALL NOT PREVENT EMERGENCY
VEHICLE PASS THROUGH
20.CONTRACTOR TO PROVIDE A SMOOTH, FLUSH TRANSITION BETWEEN ALL NEW
AND EXISTING PAVEMENTS.
21.CONTRACTOR SHALL GROUP OLD CURBING TO BE RE-SET TOGETHER IN ORDER
TO ACHIEVE A MORE COHESIVE APPEARANCE.
22.CONTRACTOR SHALL OBTAIN AND COMPLY WITH ALL TOWN OF YARMOUTH,
MASSACHUSETTS STREET OPENING REQUIREMENTS AS APPLICABLE.
23.THE TERM "PROPOSED" (PROP) MEANS WORK TO BE CONSTRUCTED USING NEW
MATERIALS. RE-USING EXISTING MATERIALS IS IDENTIFIED AS "REMOVE AND
RESET" (R&R).
24.BOLD TEXT AND LINES INDICATE PROPOSED WORK. LIGHT TEXT AND LINES
INDICATE APPROXIMATE EXISTING CONDITIONS.
25.THE CONTRACTOR SHALL READ, BECOME FAMILIAR WITH, AND ADHERE TO ALL
OF THE PROVISIONS, CONDITIONS, AND STIPULATIONS STATED IN ANY AND ALL
ENVIRONMENTAL APPROVALS ISSUED FOR THE PROJECT. COPIES OF THE
APPLICABLE PERMITS SHALL BE PROVIDED TO THE CONTRACTOR BY THE TOWN

26.DAY TIME WORK HOUR RESTRICTIONS FOR PEAK HOUR TRAFFIC INCLUDE 6:00 AM
TO 9:00 AM AND 3:00 PM TO 6:00 PM. WORK THAT DOES NOT REQUIRE A LANE
TAKING IS PERMITTED DURING PEAK HOURS.
27.ALL TRANSVERSE JOINTS, AND LONGITUDINAL JOINTS BETWEEN NEW SURFACE
PAVEMENT AND EXISTING SURFACE PAVEMENT TO REMAIN SHALL BE COATED
WITH A HOT POURED RUBBERIZED ASPHALT SEALER (ITEM 453.).
28.ALL EXISTING SIGNS WITHIN THE PROJECT LIMITS SHALL BE RETAINED UNLESS
NOTED OTHERWISE.
29.ALL NEW SIDEWALKS AND DRIVEWAY GRADES SHALL MATCH EXISTING GRADES
AT BACK OF SIDEWALK LINE UNLESS SHOWN OTHERWISE ON THE PLANS AND
CROSS-SECTIONS.
30.ON A DAILY BASIS, THE CONTRACTOR SHALL SWEEP BY MECHANICAL MEANS THE
EXISTING AND ADJACENT ROADS OR STREETS AND REMOVE SEDIMENT, SOIL,
VEHICLE TRACKING MUD OR DIRT, ASPHALT FRAGMENTS, AND AGGREGATE, ETC.
31.THE GENERAL CONTRACTOR SHALL COORDINATE WITH THE APPROPRIATE
MUNICIPAL DEPARTMENT OR UTILITY COMPANY FOR EXISTING AND PROPOSED
CONNECTION POINTS, TEMPORARY MEANS OF BY-PASS SERVICE, VERIFICATION
OF EXISTING UTILITY MATERIAL SIZE AND LOCATION, INCLUDING WATER,
SANITARY SEWER, STORM SEWER, GAS, ELECTRIC, CABLE OR FIBER. UTILITY
WORK BY OTHERS IS NOTED ON THE PLANS.

MARKINGS OR INDICATORS IN AREAS WHERE THE WORK WILL REMOVE THE

9.ANY DAMAGE TO EXISTING UTILITIES MARKED IN THE FIELD, OR AS A RESULT OF
FAILING TO CONTACT THE APPROPRIATE UTILITY COMPANY, SHALL BE REPAIRED

10.IN SOME CASES, UTILITY WORK BY OTHERS WITHIN THE PROJECT AREAS MAY
TAKE PLACE CONCURRENTLY WITH ROAD WORK; THE CONTRACTOR SHALL BE
RESPONSIBLE FOR COORDINATING AND COOPERATING WITH THE UTILITY
PROVIDER(S) AND/OR THEIR CONTRACTOR(S) DURING THE PERFORMANCE OF
SUCH WORK.
DRAINAGE/STORMWATER MANAGEMENT NOTES
1.THE CONTRACTOR SHALL CLEAN ALL EXISTING STORM SEWER CATCH BASINS,
MANHOLES, AND PIPE AS NEEDED FOR THE CONFIRMATION AND ASSURANCE OF
EXISTING ELEVATIONS OR INVERTS, MATERIALS, AND SIZES PRIOR TO ORDERING
OF NEW MATERIALS.
2.THE CONTRACTOR IS RESPONSIBLE FOR VERIFYING THE HORIZONTAL AND
VERTICAL LOCATIONS OF ALL EXISTING DRAINAGE PIPES AND/OR STRUCTURES
THAT ARE TO BE MODIFIED, AND ANY VARIATIONS FROM THE PLANS DISCOVERED
BY THE CONTRACTOR MUST BE BROUGHT TO THE ATTENTION OF THE TOWN OF
YARMOUTH OR ITS DESIGNATED AGENT PRIOR TO DRAINAGE AND UTILITY
CONSTRUCTION. WORK CAN COMMENCE ONLY WITH TOWN OF YARMOUTH
AUTHORIZATION.
3.ALL DRAINAGE AND UTILITY STRUCTURES WITHIN THE PAVED ROADWAY SHALL
BE ADJUSTED TO GRADE WITH THE SURROUNDING PAVEMENT PRIOR TO THE
WINTER SHUTDOWN.
4.DURING CONSTRUCTION, THE CONTRACTOR SHALL BE RESPONSIBLE FOR
MAINTAINING PIPED DRAINAGE AND SURFACE RUNOFF FLOWS DURING STORMS
AND PERIODS OF RAINFALL THROUGHOUT THE WORK AREA INCLUDING
PROVIDING ADEQUATE FLOW DIVERSION OR BYPASS MEASURES FOR PIPED
DRAINAGE AND RUNOFF, IF REQUIRED.
5.NO NEW POINT SOURCE DISCHARGES OR UNTREATED STORMWATER SHALL BE
DISCHARGED DIRECTLY INTO ADJACENT WATERBODIES AND WETLANDS.
6.AN ORDER OF CONDITIONS AND A STORMWATER PERMIT WILL BE ISSUED FOR
THIS PROJECT AND SHALL BE FOLLOWED IN ITS ENTIRETY.
7.DRAINAGE ELEVATIONS ARE PROVIDED FOR DESIGN PURPOSES ONLY. THE
CONTRACTOR SHALL VERIFY BY TEST PIT, THE LOCATION OF EXISTING UTILITIES
WHICH MAY CONFLICT WITH THE PROPOSED DRAINAGE DESIGN. ANY FIELD
ADJUSTMENTS REQUIRED WILL BE MADE AS APPROVED OR DIRECTED BY THE
TOWN OF YARMOUTH OR ITS DESIGNATED AGENT. ONLY AFTER THE
CONTRACTOR VERIFIES ELEVATIONS FOR THE CONSTRUCTABILITY OF THE

RESOURCE AREA NOTES
1.EXCESS SOIL, STUMPS, TREES, ROCKS, BOULDERS, AND OTHER REFUSE SHALL
BE DISCARDED OFF SITE IN AN APPROPRIATE UPLAND LOCATION, OUTSIDE OF
ALL REGULATED WETLAND AREAS BY THE CONTRACTOR.
2.THE COMPOST FILTER TUBE LINE CALLED FOR ON THESE PLANS IS TO BE
STAKED IN THE FIELD PRIOR TO CONSTRUCTION, AND SHALL SERVE AS THE
STRICT LIMITS OF DISTURBANCE FOR THE PROJECT WITHIN OR ADJACENT TO
REGULATED WETLAND AREAS, NO ALTERATIONS, INCLUDING VEGETATIVE
CLEARING OR SURFACE DISTURBANCE, SHALL OCCUR BEYOND THIS COMPOST

3.NO HEAVY MACHINERY MAY BE USED WITHIN THE RESOURCE AREAS.
4.NO FUEL STORAGE, VEHICLE REFUELING, OR EQUIPMENT STORAGE SHALL TAKE
PLACE WITHIN ENVIRONMENTAL RESOURCE AREAS, WITHIN 100' OF ANY WATER
BODY, OR WITHIN 50' OF ANY UNCOVERED STORM DRAINAGE INLET. THIS
REQUIREMENT SHALL NOT SUPERSEDE ANY FEDERAL, TOWN, OR LOCAL LAW,
ORDINANCE, RULE OR REGULATION THAT APPLIES TO THE SAME, UNLESS THIS
REQUIREMENT IS MORE STRINGENT THAN SAID LAW, ORDINANCE, RULE OR
REGULATION.
5.THE LIMITS OF CLEARING, GRADING, AND DISTURBANCE SHALL BE KEPT TO A
MINIMUM WITHIN THE PROPOSED AREA OF CONSTRUCTION, AREAS OUTSIDE OF
THESE LIMITS, AS DEPICTED ON THE PROJECT SITE PLANS, SHALL REMAIN
UNDISTURBED IN A COMPLETELY NATURAL CONDITION.
SOIL EROSION AND SEDIMENT CONTROL NOTES
1.THE CONTRACTOR SHALL BE RESPONSIBLE FOR PERFORMING ITS WORK AND
MAINTAINING PROJECT AREAS IN A MANNER THAT MINIMIZES THE POTENTIAL
FOR ON OR OFF-SITE SEDIMENTATION AND/OR EROSION TO OCCUR DURING THE
COURSE OF THE PROJECT WORK. THE CONTRACTOR SHALL BE RESPONSIBLE
FOR INSTALLING, MONITORING, AND REPAIRING SOIL EROSION AND SEDIMENT
CONTROLS AS INDICATED ON THE PLANS AS WELL AS DETERMINING AND
IMPLEMENTING ADDITIONAL APPROPRIATE MEASURES TO BE USED IN THE
PROJECT AREA AS NEEDED.
2.THE TOWN OF YARMOUTH OR ITS DESIGNATED AGENT SHALL RESERVE THE
RIGHT TO REQUIRE THE CONTRACTOR TO SUPPLEMENT OR MODIFY ITS
SEDIMENTATION AND EROSION CONTROL MEASURES, IF THE MEASURES ARE
DEEMED TO BE INADEQUATE OR INAPPROPRIATE TO THE PROJECT AREA OR
WORK CONDITIONS. THIS SHALL IN NO WAY RELIEVE THE CONTRACTOR OF ITS
SOLE RESPONSIBILITY FOR THE PREVENTION OF SEDIMENTATION AND EROSION
IN OR FROM PROJECT AREAS.
3.SILT SACKS AND ANY OTHER APPROVED INLET PROTECTION SHALL BE
INSTALLED AT ALL CATCH BASINS AND INLETS WHENEVER SUBBASE IS
EXPOSED, AND SHALL REMAIN IN PLACE UNTIL THE ABUTTING GROUND
SURFACES ARE STABILIZED.
4.ALL INLET PROTECTION DEVICES SHALL BE CLEANED OR REPLACED REGULARLY
UNTIL THE CONTRIBUTING AREA HAS BEEN STABILIZED, THE INLET PROTECTION
DEVICES ARE TO BE REMOVED AT THE END OF THE PROJECT OR AS DIRECTED
BY THE ENGINEER.
5.CONCRETE WASHOUT DISCHARGED INTO DRAINAGE SYSTEMS IS PROHIBITED.
THE CONTRACTOR MUST PROVIDE A CONCRETE WASHOUT AREA.
6.SEDIMENTS REMOVED FROM THE CATCH BASINS SHALL BE LEGALLY DISPOSED
OF BY THE CONTRACTOR.
7.THE CONTRACTOR SHALL PERFORM THE WORK IN STRICT CONFORMANCE WITH
ANY AND ALL CONDITIONS AND REQUIREMENTS OF THE ISSUED ORDER OF
CONDITIONS, STORMWATER PERMIT AND REQUIREMENTS OF SAID PERMITS,
AND IN ACCORDANCE WITH THE SEDIMENTATION AND EROSION CONTROL
MEASURES CALLED FOR ON THE PLANS IN THE PROJECT AREA.
8.PRIOR TO COMMENCING CONSTRUCTION ACTIVITIES, SEDIMENTATION AND
EROSION CONTROLS SHALL BE INSTALLED AT AREAS INDICATED ON THE PLANS.
NO GRUBBING, GRADING, FILLING, OR OTHER SOIL DISTURBANCE SHALL OCCUR
PRIOR TO INSTALLATION. THE LIMITS OF CLEARING AND SURFACE DISTURBANCE
SHALL BE STRICTLY ADHERED TO IN ALL AREAS.
9.THE TOE OF ANY FILL SLOPE IS TO REMAIN AT LEAST 1' INSIDE OF ALL EROSION
CONTROLS. UNDER NO CIRCUMSTANCES SHALL THE CONTRACTOR COVER ANY
PORTION OF THE EROSION CONTROL MEASURES WITH MATERIAL. MATERIAL
THAT IS PLACED ON EROSION CONTROLS BY THE CONTRACTOR, OR ANY AGENT
OF THE CONTRACTORS, SHALL BE IMMEDIATELY REMOVED BY THE
CONTRACTOR AND NECESSARY REPAIRS TO THE EROSION CONTROLS
ACCOMPLISHED.
10.NO UNDISTURBED AREAS SHALL BE CLEARED OF EXISTING VEGETATION AFTER
OCTOBER 15 OF ANY CALENDAR YEAR OR DURING ANY PERIOD, FULL OR
LIMITED, WINTER SHUTDOWN. ALL DISTURBED SOILS EXPOSED PRIOR TO
OCTOBER 15 OF ANY CALENDAR YEAR SHALL BE SEEDED OR PROTECTED BY
THAT DATE. AREAS THAT DO NOT HAVE ADEQUATE VEGETATIVE STABILIZATION
(AS DETERMINED BY MASSDOT OR ITS DESIGNATED AGENT) BY NOVEMBER 15
OF THAT CALENDAR YEAR MUST BE STABILIZED THROUGH THE USE OF EROSION
CONTROL MATTING OR STRAW MULCH, IN ACCORDANCE WITH THE
SPECIFICATIONS CONTAINED WITHIN THE TOWN OF YARMOUTH SOIL EROSION
AND SEDIMENT CONTROL HANDBOOK.
11.ALL SEDIMENTATION AND EROSION CONTROL MEASURES SHALL BE REMOVED
AT THE END OF THE PROJECT OR AS DIRECTED BY THE TOWN OF YARMOUTH OR
ITS DESIGNATED AGENT, AND LEGALLY DISPOSED OF AT AN OFF-SITE LOCATION
BY THE CONTRACTOR.
12.IT SHALL BE THE RESPONSIBILITY OF THE CONTRACTOR TO MAINTAIN ALL SOIL
EROSION AND SEDIMENT CONTROLS ON THE PROJECT SITE FOR THE ENTIRE
DURATION OF THE CONSTRUCTION PERIOD. THE CONTRACTOR SHALL FOLLOW
THE DIRECTION OF THE DETAILS, SPECIFICATIONS, SHOP DRAWINGS, AND
NOTICE OF INTENT WITH REGARD TO INSTALLATION, MAINTENANCE, AND REPAIR
OF ALL SOIL EROSION AND SEDIMENTATION CONTROLS ON THE PROJECT SITE.
TEMPORARY SOIL EROSION AND SEDIMENTATION CONTROLS (SILT SACK, AND
COMPOST FILTER TUBES) SHALL BE MAINTAINED UNTIL ALL EXPOSED SOIL ARE
SATISFACTORILY STABILIZED AS DIRECTED BY THE TOWN OF YARMOUTH OR
ENGINEER.
13.UNVEGETATED AREAS SHALL NOT BE UNATTENDED OR EXPOSED FOR PERIODS
IN EXCESS OF TWO (2) WEEKS, OR THROUGH THE WINTER SEASON. SUCH AREAS
SHALL BE SEEDED, UNLESS ACTIVITY IS TO RESUME WITHIN 21 DAYS.
14.JUTE MESH OR APPROVED EQUAL SLOPE STABILIZATION MATERIAL SHALL BE
USED TO STABILIZE PLANTABLE SOIL AND/OR LOAM IN ALL DITCHES, ON ALL
SLOPES ADJACENT TO WETLANDS AND WETLAND PERIMETERS, AND ON ALL
SLOPES WITHIN THE WATER QUALITY BASINS AND SWALES. JUTE MESH IN
DITCHES SHALL EXTEND TO AN ELEVATION 2 FEET ABOVE THE BOTTOM OF THE
DITCH.
15.STABILIZATION OF ONE FORM OR ANOTHER AS DESCRIBED ABOVE SHALL BE
ACHIEVED WITHIN TWO (2) WEEKS OF FINAL GRADING. ALL STRAW BALES, SILT
FENCE, COMPOST FILTER TUBES AND TEMPORARY EROSION AND SEDIMENT
PROTECTION SHALL REMAIN IN PLACE UNTIL AN ACCEPTABLE STAND OF GRASS
IS ESTABLISHED.
16.THE CONTRACTOR SHALL REPAIR AND/OR RESEED AREAS THAT DO NOT
DEVELOP WITHIN THE PERIOD OF ONE YEAR, WHICH SHALL BE DONE AT NO
ADDITIONAL EXPENSE TO THE TOWN OF YARMOUTH.
17.SOIL EROSION AND SEDIMENTATION CONTROL MEASURES SHALL BE INSPECTED
AT LEAST ONCE EVERY SEVEN CALENDAR DAYS AND WITHIN TWENTY FOUR
HOURS AFTER AN EVENT WHICH GENERATES 0.25 INCHES OF RAIN IN A TWENTY
FOUR HOUR PERIOD. MAINTENANCE SHALL INCLUDE CLEANOUT OF
ACCUMULATED SEDIMENT BEHIND THE COMPOST FILTER TUBES, SILT FENCE
AND STRAW BALES WHEN 1
2 THE ORIGINAL HEIGHT OF THE COMPOST FILTER
TUBES, SILT FENCE AND STRAW BALES BECOMES FILLED WITH SEDIMENT SILT
SACKS SHALL BE EMPTIED AND CLEANED WHEN THEY ARE HALF WAY FULL
WHEN RESTRAINT CORD IS NO LONGER VISIBLE.
18.AREAS HAVING SLOPES GREATER THAN OR EQUAL TO 3:1 SHALL BE STABILIZED
WITH EROSION CONTROL MAT OR BLANKET BY COMBINATION WITH SEEDING, AS
INDICATED ON THE DRAWINGS. SEEDING ON ALL SLOPES 4:1 OR STEEPER SHALL
CONSIST OF TYPE I SEEDING ENHANCED WITH ADHESIVE MULCH STABILIZER,
UNLESS OTHERWISE DIRECTED BY THE TOWN OF YARMOUTH OR ITS
DESIGNATED AGENT.
19.STORMWATER MANAGEMENT PERMIT APPLICANT: MASSDOT CERTIFIED
PROFESSIONAL IN EROSION AND SEDIMENT CONTROL CONTACT TBD BASED ON
AWARD OF CONSTRUCTION.
TREE PRESERVATION NOTES
1.TREES WITHIN THE LIMITS OF GRADING SHALL NOT BE REMOVED UNLESS
APPROVED BY THE TOWN OF YARMOUTH OR ITS DESIGNATED AGENT.
2.PRIOR TO CONSTRUCTION, PROTECT TREES WITHIN THE LIMITS OF WORK IN
ACCORDANCE WITH DETAIL.
3.PRIOR TO CONSTRUCTION, DETERMINE REQUIRED CLEARANCES AND PRUNE
TREES.
4.BRANCHES OR LIMBS DAMAGED DURING CONSTRUCTION SHALL BE CUT BACK
TO THE TRUNK OF A LATERAL BRANCH.
5.CONTRACTOR SHALL PROHIBIT EXCAVATION ACTIVITIES INSIDE LIMITS OF THE
TREE CANOPY.
6.ROOTS LARGER THAN 1.5" IN DIAMETER ENCOUNTERED IN EXCAVATIONS SHALL
BE CUT OFF SQUARELY USING A SHARP ARBORIST SAW.
7.MAINTAIN STORAGE OF EQUIPMENT AND MATERIALS A DISTANCE OF AT LEAST
TWO (2) TIMES THE DISTANCE OF THE RADIUS OF THE TREE CANOPY.
8.STRIP AND SEGREGATE TOPSOIL PRIOR TO EXCAVATING IN UNPAVED AREAS.
FOLLOWING BACKFILL OPERATIONS PLACE TOPSOIL BACK IN THE APPROPRIATE
PLACE WITHOUT COMPACTION AND VERTICALLY MULCH ROOT SYSTEM. NO
AMENDMENTS SHALL BE ADDED.
9.IMMEDIATELY FOLLOWING BACKFILL OPERATIONS PROVIDE DEEP WATERING OF
THE ROOT SYSTEM, APPLICATION OF FERTILIZER, AND VERTICAL MULCHING.
LANDSCAPING NOTES
1.TOPSOIL USED AS PLANTABLE SOIL SHALL HAVE A SANDY LOAM TEXTURE
RELATIVELY FREE OF SUBSOIL MATERIAL, STONES, ROOTS, LUMPS OF SOIL,
TREE LIMBS, TRASH OR CONSTRUCTION DEBRIS.
2.UNLESS SPECIFICALLY INSTRUCTED, ALL LANDSCAPING WORK SHALL BE
PERFORMED WITHIN RIGHT-OF-WAY OR WITHIN TEMPORARY CONSTRUCTION
EASEMENTS; NO WORK SHALL BE PERFORMED ON PRIVATE PROPERTY
WITHOUT THE PRIOR EXPRESS AUTHORIZATION OF THE TOWN OF YARMOUTH.
3.ALTERATION OR REMOVAL OF EXISTING VEGETATION WITHIN OR CLOSE TO
TOWN RIGHT-OF-WAYS SHALL BE AVOIDED TO THE EXTENT POSSIBLE, AND
WHEN REQUIRED , SHALL BE LIMITED TO ONLY THAT WHICH IS NECESSARY TO
COMPLETE THE REQUIRED WORK. ALL SUCH WORK SHALL BE PERFORMED BY
QUALIFIED PERSONNEL IN A NEAT AND PROFESSIONAL MATTER.
4.ALTERATIONS TO EXISTING VEGETATION (TRIMMING, LIMBING, TRANSPLANTING,
ETC.) SHALL BE MADE IN A MANNER THAT MINIMIZES THE DAMAGE TO THE
VEGETATION AND MAXIMIZES ITS CHANCE FOR SURVIVAL. PROFESSIONAL
LANDSCAPING OR TREE TRIMMING SERVICES SHALL BE EMPLOYED FOR SUCH
WORK AT THE DIRECTION OF THE TOWN OF YARMOUTH OR ITS DESIGNATED
AGENT.
MAINTENANCE AND PROTECTION OF TRAFFIC NOTES
1.ALL EXISTING TRAVEL LANES SHALL BE OPEN TO TRAFFIC WHENEVER
CONSTRUCTION IS NOT TAKING PLACE. SAFE ACCESS AND EGRESS TO
DRIVEWAYS AND SIDE STREETS SHALL BE MAINTAINED AT ALL TIMES, EXCEPT
AS PREVIOUSLY APPROVED BY THE ENGINEER.
2.CONTRACTOR IS RESPONSIBLE FOR MAINTAINING AT LEAST ONE ACCESS POINT
TO ALL BUILDINGS DURING CONSTRUCTION.
3.PEDESTRIANS SHALL BE CONSIDERED IN ALL MAINTENANCE AND PROTECTION
OF TRAFFIC SETUPS. THE CONTRACTOR SHALL PROVIDE TEMPORARY ACCESS
ROUTES/RAMPS THROUGH CONSTRUCTION AREAS TO ENSURE ACCESS. THE
TEMPORARY PEDESTRIAN ACCESS SHALL BE DETECTABLE AND INCLUDE
ACCESSIBILITY FEATURES CONSISTENT WITH THE EXISTING REQUIREMENTS
THROUGH WORK ZONES. THE CONTRACTOR MUST PROVIDE FOR PEDESTRIANS
TO SAFELY GUIDE THEM AWAY FROM BROKEN AND UNEVEN PAVEMENT, OPEN
EXCAVATIONS, DROP-OFFS, CONSTRUCTION OPERATIONS, AND OTHER
HAZARDS AT ALL TIMES. TEMPORARY CURB RAMPS SHALL BE PROVIDED FOR
SIDEWALK DIVERSIONS WHERE NECESSARY. THERE SHALL BE NO ADDITIONAL
COMPENSATION FOR THE PROVISION OF PEDESTRIAN WAYS. ALL COSTS SHALL
BE CONSIDERED INCIDENTAL TO THE CONTRACT.
PEDESTRIAN ACCESSIBILITY NOTES
1.ACCORDING TO THE MASSDOT STANDARD SPECIFICATIONS, THE SUBGRADE
FOR THE SIDEWALKS, RAMPS, AND DRIVEWAYS SHALL BE SHAPED PARALLEL
TO THE PROPOSED SURFACES OF THE WALKS, RAMPS, AND DRIVEWAYS AND
THOROUGHLY COMPACTED. ALL DEPRESSIONS OCCURRING SHALL BE FILLED
WITH SUITABLE MATERIAL AND AGAIN COMPACTED UNTIL THE SURFACE IS
SMOOTH AND HARD.
2.THE FOUNDATION SHALL BE AT LEAST 8 INCHES IN THICKNESS AND PARALLEL
TO THE PROPOSED SURFACE OF THE WALK.
3.CONTRACTOR SHALL NOTE THAT THE CITED ACCESSIBILITY REQUIREMENTS
ALLOW NO TOLERANCE FOR SLOPES GREATER THAN THE MAXIMUM SLOPE.
4.WALKWAYS SHALL HAVE CONTINUOUS COMMON SURFACE, NOT INTERRUPTED
BY STEPS OR CHANGES IN LEVEL GREATER THAN 1
4 INCH.
5.THE CURB RAMPS SLOPES AND SIDE SLOPES (TRANSITIONS) WILL BE
7.5% WITH A CONSTRUCTION TOLERANCE OF 0.5%±. HOWEVER, THESE SLOPES
MAY BE FLATTER WHEN WARRANTED BY SURROUNDING CONDITIONS.
6.WHERE THE ROAD PROFILE EXCEEDS 4%, THE HIGH SIDE TRANSITION LENGTH
UNDER ANY CONDITIONS NEED NOT EXCEED 15 FEET.
7.AT NO TIME IS ANY PART OF THE CURB RAMP, EXCLUDING CURB TRANSITIONS,
TO BE LOCATED OUTSIDE THE CROSSWALK. THE CURB RAMPS ENTRANCE IS
TO BE CENTERED IN THE CROSSWALK WHENEVER POSSIBLE.
8.THE ENTRANCE OF A CURB RAMP SHALL BE FLUSH WITH THE ROADWAY.
9.DETECTABLE WARNING PANELS ARE REQUIRED FOR ALL PROPOSED CURB
RAMPS AND ARE TO BE INSTALLED IN ACCORDANCE WITH THE CONSTRUCTION
STANDARD M/E 107.6.5R (OCTOBER 2017).
10.THE FINAL LOCATION OF ALL CURB RAMPS SHALL BE COORDINATED IN THE
FIELD WITH THE PROPOSED AND/OR EXISTING LOCATIONS OF DRAINAGE
STRUCTURES, UTILITY POLES, LIGHT POLES, AND OTHER APPURTENANCES TO

·When existing pedestrian facilities are disrupted, closed, or relocated in a TTC zone, temporary facilities shall be
provided and they shall be detectable and include accessibility features consistent with the features present in the
existing pedestrian facility.
·A pedestrian channelizing device that is detectable by a person with a visual disability traveling with the aid of a long
cane shall be placed across the full width of the closed sidewalk.
·When used, temporary ramps shall comply with Americans with Disabilities Act (see Figures Ped-1 & Ped-2).
·The alternate pathway should have a smooth continuous hard surface for the entire length of the temporary pedestrian
facility.
·The protective requirements of a TTC situation have priority in determining the need for temporary traffic barriers and
their use in this situation should be based on engineering judgment.
·Audible information devices should be considered where midblock closings and changed crosswalk areas cause
inadequate communication to be provided to pedestrians who have visual disabilities.
AUDIBLE DEVICES
For long term sidewalk closures (at a minimum overnight) a form of speech messaging for pedestrians with visual
disabilities shall be provided. Audible information devices such as detectable barriers or barricades and other passive
pedestrian activation (motion activated) devices should be considered for these cases. These audible devices can be
mountable or stand alone.

Yarmouth Assessor’s locator map highlighting parcel(s) where work is proposed, including map and
parcel numbers.
1 current abutters list identifying the property owners who are to be notified and abutter notification form.
All abutters to be notified via certified mail, Certified Mail Receipts (PS Form 3800) must be provided.
1 original and 7 photocopies of the plan/sketch, folded separately, right side out with title and address
visible. All plans shall reference NAVD1988 unless otherwise noted. Landscape plans shall be detailed to
show proposed and existing conditions, native species, quantity, size and spacing.

I CERTIFY that all on-site requirements will be completed by noon on the Friday prior to the hearing
date. All proposed structures must be staked, and all relevant resource areas and buffer zones must be
staked or flagged. Please consult the Yarmouth Wetland Regulations, page 17.
I understand that in person representation is required at the scheduled hearing to present to the
conservation commission.

Please submit a signed Site Access Authorization Form; AND
The owner must be sent a copy of the application via Certified Mail on the same day it is filed with this
office. Please submit a copy of the Certified Mail receipt with application.
