The following are responses to questions you posed in the previous email:
Is the proposed gangway fixed?
The license application proposes no changes to the 30’ fixed upper gangway. The lower gangway we are proposing to reduce from the 36’ permitted length to 30’ in length. This gangway
is hinged to accommodate tidal fluctuation.
The gangway and float may still be removed during the winter season. The lower Gangway will be connected with a pin-hinge attachment to the landing and there will be on rollers underneath
the lower end of the ramp where it rests on an extension of the float.
You are proposing a 436 square foot increase to the float size. Is this the smallest necessary increase to overcome your stability concerns? Is any increase in size necessary with the
newly proposed timber piles?
The proposed increase in float size will not change the impacts subject to review under the WPA, as occupation of the watersheet will not alter Land Under the Ocean. That said, the increase
in float size is proposed to provide the Town with a licensed footprint on the watersheet should there need to be adjustments to the float layout for stability or diversification of
access in the future based on usage. The actual float size to be constructed as part of this project will be within the limits of the proposed area.
What is the new proposed distance to the existing channel?
The new distance to the channel will be 42 feet.

Phase 1 of the Yarmouth Riverwalk Park and Event Space Project (File No. 083-2373) is under construction. During the shop drawing process, it became evident that enhanced stability for
the kayak launch float would be needed, when factoring the river currents, tides, and passing boat wakes. Additionally, concerns regarding the south facing zero-entry edge were identified,
specifically with the potential for tidal water to over wash the float under certain conditions.
For these reasons, the originally licensed kayak launch float design approved under the Massachusetts Public Waterfront Act (Chapter 91) has been updated to improve durability, stability,
and safety, while enhancing ADA accessibility. The revised design includes:
• Installation of two (2) 16-inch diameter wood piles to secure the float;
• Installation of a 30’ gangway for access to the float;
• Positioning of a float extension under the 30’ gangway; and
• Installation of a 760 sf float with a 4’ wide zero-entry kayak launch.
Because the proposed float configuration extends beyond the footprint of the originally-licensed float, a new Chapter 91 License is required due to the new design of the float. The project
will still adhere to all conditions previously included in the permits and authorizations including turbidity controls, time of year restrictions, and slow-start installation of the
proposed piles. Please see attached, the proposed design of the kayak launch float and anchor system.
As part of the review process for a new Chapter 91 license, the Town must document compliance with the Massachusetts environmental regulatory programs. On behalf of the Town, BETA is
requesting written confirmation from the Yarmouth Conservation Commission that no additional review or approval is required from your office as a result of the float reconfiguration.
