On behalf of our clients, Dennis &Darcie MacDonald, J. M. O'REILLY AND ASSOCIATES, INC. is submitting
the attached Notice of Intent for the above -referenced property. The Notice of Intent is for the removal
of the existing dwelling and construction of a replacement dwelling. Please refer to the Site Plan for
details.
The property is approximately 750' to the north of Lewis Bay. A portion of the property is within Land
Subject to Coastal Storm Flowage: Flood zone AE with Base Flood Elevation of 11 per FEMA flood map
#25001C0569J. There are no other wetland resource areas or buffer zones that intersect the property.
The site is developed by an existing single-family dwelling with a Title 5 septic system.
The project proposes the removal of the existing dwelling and construction of a replacement dwelling.
The proposed dwelling's footprint is approximately the same size as the existing dwelling (1,140 SF+/ -
and 1,160 SF+/-, respectively). The proposed dwelling is sited in approximately the same location as the
existing dwelling, as shown on the attached Site Plan. There is no increase in septic usage at the site, and
the existing Title 5 septic system will remain in use. A gravel driveway is proposed to replace the existing
paved driveway and is sited in approximately the same location. Two rear sheds are also proposed, as
shown on the Site Plan.
The property owner recently cut and removed (6) mature trees on the property in preparation for the
upcoming planned site work. He was not aware at that time that the property was partially within
Conservation jurisdiction and that any tree removal required prior approval from the Conservation
Commission. (5) of the (6) trees that were removed are within the flood zone. The property owner is
proposing (5) new trees and (2) shrubs as mitigation for the tree removal. Species and locations are shown
on the Site Plan.

Performance Standards:
310 CMR 10.57 Land Subject to Flooding:
(4) General Standards
New dwelling is approximately the same size as the existing dwelling and will be sited in
approximately the same location as the existing dwelling. New dwelling will be flood -zone
compliant with basement flood vents. No fill is proposed, so this project will actually increase the
flood zone storage capacity of the property.

Step 4/Subtotal Activity Fee: Multiply the number of activities (identified in Step 2) times the fee per category
(identified in Step 3) to reach a subtotal fee amount. Note: If any of these activities are in a Riverfront Area in
addition to another Resource Area or the Buffer Zone, the fee per activity should be multiplied by 1.5 and then
added to the subtotal amount.
Step 5/Total Project Fee: Determine the total project fee by adding the subtotal amounts from Step 4.
Step 61Fee Payments: To calculate the state share of the fee, divide the total fee in half and subtract $12.50. To
calculate the city/town share of the fee, divide the total fee in half and add $12.50.

In accordance with the second paragraph of the Massachusetts General Laws Chapter 131, Section 40,
you are hereby notified of the following:
A. The name of the applicant is Dennis and Darcie MacDonald.
B. The applicant has filed a Notice of Intent with the Yarmouth Conservation Commission, seeking
permission to remove, fill, dredge or alter an Area Subject to Protection under the Wetlands
Protection Act (MGL c. 131 s. 40 & Town of Yarmouth Wetland By -Law, Chapter 143).
C. The address of the lot where the activity is proposed is 25 Sagamore Road.
D. Proposed work is to remove and replace the existing dwelling. Proposed dwelling will be sited in
approximately the same footprint as the existing dwelling.
