When we found out about the dock in the summer of 1995 as it was installed, we did protest it to Conservation Commission (Brad Hall) and DEP memorializing our protest in the attached letter that October. If you look in Brad’s old files maybe there is some more information there on our communications with him as we called him about it. I do not believe it ever went to Con Comm for approval from what we have in our records. This was right after Hurricane Bob and there was a statewide push to license all docks so Waterways was likely a bit overwhelmed. As an FYI we were not notified as abutters in the comment period and because that had period had passed Margaret Finn said the permit could not be revoked and we must oppose again it in 30 years. The original application was full of manner errors and lies that we pointed out in 1995. We are trying to dig up that response from Margaret. We did not get any response from Yarmouth but we did try to notify all entities at the time. I see that you have our most recent filing and with DEP Waterways. Our opposition then and still has always been that the easement is for all the homes on the street and one home cannot usurp that right for their personal betterment. The use must be equally shared for all to enjoy as we stood by helplessly while the dock block common access to the water and enjoyment for other residents. To that end we would like to have the structure removed and original stairs be built for the residents to access the river as it existed before they removed it for their own good. We have many new neighbors; we hope they can see and enjoy Bass River now for the great resource it is. Thank you for and the commission for taking up and understanding the situation. The dock blocking access and sitting on the beach has long been an issue we wanted to rectify. We are here for any other questions or information needed on this situation.
