Britany: Please accept my apology for the delay in my response. I have been home all week battling Covid. This serves to respond to your request for a status report. As you know, at the 2/1/24 meeting of the Conservation Commission, the Commission denied Ms. Caloiero’s request for more time and ordered that an NOI be filed by March 7, 2023. This deadline was completely unrealistic given how busy local engineers and land surveyors are these days. As of the 2/1/24 hearing, Ms. Caloiero had already retained BSC Group to perform a survey of the site, and she had retained Bob Perry of Cape Cod Engineering to design a new dock. Notwithstanding, it took BSC until Wednesday, April 24, 2024 to complete its survey work. (This demonstrates how unrealistic the March 7 deadline was). BSC will be transmitting the survey data to Mr. Perry and Mr. Perry will now begin to design a new dock. We anticipate having a plan ready in several weeks, and a Notice of Intent a few weeks after that. We hope to be before the Commission sometime this summer. In the interim, Ms. Caloiero has challenged the Commission’s enforcement decision. A civil action appealing the Commission’s decision and order was filed on 2/21/24. A copy of the Complaint is attached. Since the enforcement order was appealed, there should be no additional fines issued regarding the alleged violation.
