The requirements do not apply to you since you did not build it in violation of the wetland’s protection act. Usually, violations take place with the owner’s permission by hired workers, and the owner is usually responsible for work authorized on their property. This case is different since you did not authorize the work, so you won’t be held responsible. Brittany Reading the enforcement order and seeing property owner listed. We are of course owners of Ayacht LLC who owns 59 Oyster Cove Rd. The platform has not been removed yet and we want to make sure we are not supposed to be doing that. I know this is a tricky one and just want to make sure we are doing what we are supposed to be doing. We obviously did not build it and have been by Rose Caloiero that it is her private property so we are going to leave it alone unless instructed otherwise. I included her thread to us on the matter below. Do you need a property owner for 59 Oyster Cove at the meeting on the 18th? Mark Hello Barbara and Mark Thank you for the photos my husband will be coming this week to fix and remove what needs to be removed. I just want to remind you that my license is still pending. Until that is resolved, the Dock is my private property. I have tried to fix the issues but I have been stopped by others on the road. My husband will be more than happy to fix stairs going to the beach and whatever else is needed as long as everybody comes together with the cost of materials. I will not discuss the permit for the Dock or any issues that is pending till things are all settled. I believe the stairs to the water should be toward the center of sandbox at around 45-50 feet since the total length of the sandbox is around 80+ feet as shown by the property markers we put up this summer. The first picture was a few days after the last big storm we had before Christmas. The next two pictures happened when I left from Christmas Day until Wednesday. Although it is winter we should think about addressing this and repair the platform and stairs to water or we will have a big expense in replacing them. ( there were stairs directly below Mrs Bates dock but you couldn’t access). There are a few marks of stairs left. Do we want to plan a meeting to discuss this in the New Year? This requires the new portions be removed and attendance at our next hearing on Jan 18. Brittany I left a message for you but hear you a still very busy with storm issues so I figured and email would be best for now. The immediate issue of the dock platform rebuild I was told is being dealt with. We thought they were supposed to remove all the old dock components and were surprise when it collapsed and they started rebuilding verses removing on New Years Day. Guess I was late on getting that to you. Second item is we sent the attached to all of the street owners around the dock and as land owners and is our current position. We feel that the commission may want to know that. We would support an association-based dock and nothing less unless they were to get all the other land owners to sign over rights for Caloiero to pursue their own. An unlikely outcome but we would deal with that if it came. We have several new neighbors and even some older ones that were not sure of their deed right to access the water so we wanted them clear that they can enjoy it. That said with dock gone we would like to reinstall the stairs that went from the end of the platform to the beach, allowing them access to the beach. Previous owners at 29 Oyster Cove put the dock ramp right over them and then removed them while repairing that ramp after a storm. I want to discuss the proper process for that so we can relay it to others on the street. They have expressed interest in rebuilding them and we have a meeting on it coming up. So I would like to be prepared and as helpful as I can be to that process. As property owners we would be willing to support that effort for them. Happy to discuss further as needed. Third item that I have seeing as you will likely be visiting our property again is a dead tree at the top of the hill before you go down the stairs. With the recent storm it dropped some large branches and we are concern it will fall toward the home. It suffer some major damage during Bob and my father tried to save it but that effort failed in the long run. It is within the buffer zone (~70’) so we need your approval and I need to know what that process is for full removal. I though I saw a form on your site but I could not find it when I looked again. Not a super rush item but thought I would save you a trip only if you are back out. I can file and then we can deal with site visit or pictures later if you are not coming back out.
