Sometimes the flood map is just wrong, sometimes it’s how the flood zone is delineated, and sometimes it’s because ground conditions were changed. This is a pretty straightforward delineation that should be based on ground elevation, so we can eliminate that presuming a professional land surveyor did the delineation. So either they added fill or the map is wrong. If fill has been added, they need to go through the process of pursuing a Letter of Map Change based on fill. If not, they should go through the Letter of Map Amendment process to have FEMA confirm that the property is not located in the floodplain. Until FEMA issues this letter, the property is still considered to officially be in the floodplain. When the flood zone line on the map and a surveyed delineated line are close, I go with the surveyed delineated line. But when they’re not, I would go through the official process to have FEMA approve it. That being said, it looks like the flood zone line still clips the house, meaning they have to build to floodplain regulations anyway. If your only concern is for the structure, I would consider having your board NOT approve the flood zone line but allow it to proceed since the structure is still considered to be in the flood zone. I’m on the Dennis ConCom and we’ve done that a few times when the outcome of an official delineation doesn’t actually make a difference for the outcome of the project. But if there are other concerns based on the flood zone delineation, I’d go the FEMA approval route. Does that make sense? I’m happy to have a call about it if that’s easier. I’m available the next two days and then away at a conference next week. Hello, We received an NOI and there is a discrepancy between the site survey and the FEMA flood map. The commission will have to approve the conditions and flood zone line, is the surveyed condition more accurate than the maps? Any guidance you can provide would be appreciated.
