The filing deadline is two weeks prior to the next scheduled Conservation Commission meeting for new applications. Failure to follow this Checklist shall result in an Administratively Incomplete Application and will not be advertised for a Public Hearing. Refer to the meeting schedule. Contact the Conservation Office if you need assistance. Submitting an Application: Does the property have any outstanding/expired Orders of Conditions? If so, please file a Request for Certificate of Compliance for each outstanding/expired Order, as the Commission may not issue a new Order until any outstanding/expired Orders have been closed and recorded. (*see page 2) Hardcopy filing dropped off or mailed to the Conservation Office including: 1 Administrative Checklist 1 complete NOI application WPA form 3 with original signatures. Typed signatures will not be accepted. Detailed narrative of the project including existing & proposed conditions, construction sequence, type of equipment, staging locations, drainage and stormwater, erosion controls, invasive species management and alternative analysis. The narrative shall include how the project meets performance standards per 310 CMR 10.0 & TOY Wetland Regulations, delineation sheets (if BVW or vegetated wetlands are present) or other resource area calculations, and supporting information. 1 100’ radius map, current abutters list identifying the property owners who are to be notified per 310 CMR 10.00 and abutter notification form. Abutters list must be certified by the Town Assessor’s office. The Assessor’s office requires 7 days advance notice. All abutters must be notified via certified mail. Certified Mail Receipts (PS Form 3800) for all abutters. Green cards to be submitted at the hearing. 1 original and 6 copies of the plan, folded separately, right side out with title and project address visible. All plans shall reference NAVD1988 unless otherwise noted. It is classified as a coastal bank in Yarmouth, therefore, the resource area boundary is a BVW and Top of Coastal Bank plus coastal beach and salt marsh.. The surrounding bank is stable (non-eroding) and vegetated with Black Cherry, Sassafras, Black Oak, Pitch Pine, Scrub Oak, Poison Ivy, Swamp Maple, American Holly, Bayberry, Greenbrier, Sweet Fern, and Inkberry. Some invasive species; namely Oriental Bittersweet, Bush Honeysuckle, and Multiflora Rose are proximate and have been removed. All work on this site has been approved and permitted by Building Dept, Conservation Commission, and Zoning Board of Appeals. The applicant has worked actively with Waterways committee for approx 10 meetings in the last year to massage this final application into action with a conservation permit. The proposed project is to construct a 42’ dock (from MHW), over the pond. This project is mitigated by strong advice from the Yarmouth Waterways committee of which, there has been no less than 10 meetings from 2024 to the present. The meetings have produced a refined structure and went through the following changes (amonst others). Of the 8 interests of the Wetands Prootection Act and the Town of Yarmouth By-laws, only 4 of the interests pertain to a dock (Flood Control, Prevention of pollution, Protection of Fisheries, and Storm Damage Prevention). placed in the water. The other 4 interests are listed below and are unaffected by the dock construction, and listed as “insignificant” for this report. (2) Groundwater Supply; There is no significance to Groundwater Supply, due to location of dock; (3) Prevention of Pollution The project involves 12 (x10” diam) piles treated with ACQ (Alkaline Copper Quaternary), and not CCA; minimal leaching is expected as this wood treatment is the accepted type in all town districts, including Yarmouth; installation of PVC can be discussed. (4) Protection of Fisheries; According to the professional shellfish report, no shellfish exist within 40’ of “shore”; the shellfish consultant stated that they started their measurement on the “downside of the saltmarsh shelf” which is approx 20’ more seard than the Mean High Water (MHW) boundary. This places the area void of shellfish approx 60’ from MHW. With the reconfigured proposed dock at 42’ PLUS a 5’ perimeter buffer zone, the proposed dock falls approx 13’ of any known shellfish beds. (5) Wildlife Habitat; There is no significance to Upland Wildlife Habitat, due to location of dock below MHW; Also, shellfish is not located in the area of the dock and its buffer zone; (6) Protection of Public water supply; There is no significance to Public water supply, due to location of dock; (7) Private Water Supplies; wells are unaffected by this project; There is no significance. (8) Storm Damage Prevention; There can be no adverse affects given the few vertical piles (12) and subsequent Suggested location of the fixed dock above MHW. Public access and sunlight penetration have also been addressed in the plans with proper elevation above MHW (1.5x width) and Thruflow surface (for sunlight penetration) with Public access along the beach, under the fixed dock structure. All State and local performance standards have been met. Please see attached list of Yarmouth Performance Standards for docks with response for each. Since all work performed is the installation of one (1) major feature(s) usually requested by new homeowners, and that work has a net negative effect on the 8 interests of the act, we request that the Conservation Commission vote to allow these optimistic, and environmentally sound project, with the inherent mitigation, to go forward. The resulting project would be harmless to conservation interests. We suggest that a yearly maintenance schedule be outlined using photographs and a report, if needed.
