All filings must be made on Town of Yarmouth forms. The filing deadline is two weeks prior to the next
scheduled Conservation Commission meeting for new applications. Failure to follow this Checklist shall
result in an Administratively Incomplete Application and will not be advertised for a Public Hearing. Refer to
the meetinq schedule. Contact the Conservation Office if you need assistance.

y- Detailed narrative of the project including existing & proposed conditions, construction sequence, type of
equipment, staging locations, drainage and stormwater, erosion controls, invasive species management
and alternative analysis. The narrative shall include how the project meets performance standards per
310 CMR 10.0 & TOY Wetland Regulations, delineation sheets (if BVW or vegetated wetlands are
present) or other resource area calculations, and supporting information.
1 100' radius map, current abutters list identifying the property owners who are to be notified per 310
CMR 10.00 and abutter notification form. Abutters list must be certified by the Town Assessor's office.
The Assessor's office requires 7 days advance notice. All abutters must be notified via certified mail.
Certified Mail Receipts (PS Form 3800) for all abutters. Green cards to be submitted at the hearing.
1 original and 7 copies of the plan, folded separately, right side out with title and project address visible.
All plans shall reference NAVD1988 unless otherwise noted. See plan requirements

this email with the application as proof that it has been submitted to DEP.

the Conservation office with proof that this has been done or the filing will not be accepted.

Notice of Intent project narrative
Project summary
The Applicant proposes improvements to the property at 50 Heritage Drive, West
Yarmouth to include: interior renovation; construction of second -story addition, garage
with finished second floor, two covered entries, rinse station, and pool with spa and pool
apron, retaining wall; deck reconstruction and expansion; shed relocation; driveway
reconfiguration; installation of exterior doors and windows; new siding and roofing, and
upgrade of septic system.
Resource areas
Bordering vegetated wetland
A bordering vegetated wetland occurs adjacent to and upgradient of a salt marsh bordering
a tidal creek off Lewis Bay. The edge of wetland was delineated at the limit of the plant
community supporting 50 percent or greater wetland indicator species: groundselbush
Baccharis halimifolia FAcw), climbing nightshade (Solanum dulcamara FAc), soft rush
Ouncus effusus oBL), bayberry (Morelia pensylvanica FAc), poison ivy (Toxicodendron
radicans FAc), Virginia rose (Rosa virginiana FAc). There is a narrow band of upland
between the BVW and the managed landscaping, which supports black cherry (Prunus
serotina FAcu), honeysuckle (Lonicera sp. FAcu), red cedar Quniperus virginiana FAcu) and
bayberry (Morella pensylvanica FAc).
Land subject to coastal storm flowage
The boundaries of LSCSF occur at the limits of the 100-year flood zones as mapped on the
Federal Emergency Management Agency's National Flood Hazard Layer Map: Flood Zone
AE, elevation 11 feet; and VE, elevation 13 feet (FIRMette attached).
Riverfront
The untitled creek is a tidal river and in accordance with 310 CMR 10.58 (2)(a)(2)c, the
edge of the river is located at the mean annual high-water line, coincident with the mean
high water line determined under 310 CMR 10.23 to be defined as:
the line where the arithmetic mean of the high water heights observed over a
specific 19-year metonic cycle (the National Tidal Datum Epoch) meets the
shore and shall be determined using hydrographic survey data of the
National Ocean Survey of the U.S. Department of Commerce.
The boundary of the riparian zone occurs at the 200-foot setback from the mean annual
high-water line, and encompasses a large portion of the locus property.
Project description
The interior house renovation is entirely within the footprint of the existing dwelling. The
second story addition will be over the westerly side of the house, adjacent to the proposed
pool area. The building footprint will be expanded by the construction of two small
covered entries, and a new attached garage. The irregular shape of the garage's northeast
corner addresses Building Code concerns with proximity to the velocity zone boundary.
The proposal includes the installation of new doors and windows, as well as new siding and
roofing.
The existing patio is to be reduced, removing the spa area, which will be incorporated into
the pool design. The elevated deck is to be replaced and minimally expanded to provide
access to the proposed pool area.
The pool will be elevated above grade on the northerly side, supported by a —2.5 retaining
wall. The pool is to be maintained with salt chlorination and cartridge filters. The pool
equipment is to be located on the pool patio. If the pool needs to be emptied for
maintenance/repairs, the water will be pumped and removed from site, or emptied into the
proposed drainage pit. Surface run-off from the patio is to be directed into a drain
discharging below grade.
The existing septic system was designed to service the 4 existing bedrooms in the dwelling.
There will be no increase in bedroom number with the proposed renovations, but the
septic system is to be upgraded to an H2O 1500 gal septic tank, H-20 distribution box, and
leaching field. The soil absorption system will provide 5.4 feet of vertical separation
between the bottom of the field and adjusted ground water. Two local Variances are being
requested from the Health Department, Regulation 3.7: a 6-foot variance that requires the
septic tank to be 100 feet from the BVW, and a 3-foot Variance that requires the SAS to be
100 feet from the BVW. No Title 5 Variances are required.
The existing paved drive, located on the street side of the structure is to be expanded and
reconfigured to accommodate the new garage.
The house renovations constitute a substantial improvement to the existing dwelling.
Appendix 120.G of the Massachusetts State Building Code defines substantial improvement
as any reconstruction, rehabilitation, addition, repair or improvement of a structure, the
cost of which equals or exceeds 50% of the market value of the structure before the "start
of construction" of the improvement. Accordingly, the foundation is to be upgraded with
breakout panels to conform to flood zone standards for construction in the AE Flood Zone.
The BFE of the AE Flood Zone is 11 feet. The existing first floor elevation is 13.2 feet,
compliant with the current regulations. No living area or utilities are to be located below
the first floor elevation.
A work limit line is to be established with siltation fencing secured at grade and backed by
staked coir logs as shown on the Site Plan, prior to any site work being done, and shall be
maintained until project completion, to include the stabilization of sediments. All disturbed
areas are to be revegetated upon completion of construction. The WLL may be removed to
plant the mitigation area.
Equipment is to access the property from the street side of the dwelling. There is to be no
staging of materials in the rear yard.

Performance standards
PART 6 BUFFER ZONE REQUIREMENTS 6.01 Setbacks and Buffer Zones
1) Notwithstanding section 6.01(2) below, no new structures, including chicken coops and
swimming and spa pools (with the exception of water dependent structures), will be allowed
within 50 feet of the following Resource Areas. ...coastal vegetated wetlands....
2) Minor structures up to 140 square feet total coverage such as sheds, decks, and pervious
patios may be allowed closer than 50 feet to a Resource Area but no closer than 35 feet
All new construction has been located outside of the 50-foot buffer zone. In addition, the
total impervious area within the 35-foot buffer zone will be reduced by the removal of the
patio spa area. A majority of the existing lawn within the 35-foot buffer zone to the BVW
will be restored with native plants as mitigation for the proposed project.
3) Where a 50 foot undisturbed buffer zone does not exist prior to the proposed work, any
work proposed within the 100 foot buffer zone shall be subject to mitigation planting
requirements intended to restore, in so far as is possible, both the dimensions of a 50 foot
undisturbed buffer and its vegetation. For work proposed within the 100 foot buffer zone, the
calculation of mitigation is set forth as follows:
a) For proposed, new or replacement hardscape or structure, whether pervious or
impervious, within the 50-1 00foot buffer zone, mitigation shall be 2:1. b)
For proposed new or replacement hardscape or minor structure, whether pervious or impervious
within the 35-50 foot buffer zone, mitigation shall be 3:1. There
is a proposed 2307 square -foot net increase of hardscape located in the 50-100-foot buffer
zone, and a 128 square -foot reduction of hardscape in the 35-50-foot buffer zone. Applying
the 2:1 mitigation requirement for the increase in the 50-100-foot buffer zone, the
mitigation area would be 4614 square feet. However, a credit of 384 square feet was applied
for 3X the reduction of hardscape in the 35-50-foot buffer zone, leaving a total mitigation
area requirement of 4230 square feet. The existing lawn, which occupies a majority
of the 50-foot buffer zone, is to be replaced with native woody plantings, as shown on
the Proposed Mitigation Plan prepared by Hamlyn Consulting, dated May 20, 2025. 4)
Planting requirements Where
mitigation or restoration of buffer zone vegetation is proposed or required under a Notice
of Intent, it shall meet the following requirements: a)
Locally native and climate adapted plant species suited to the local growing conditions will
be used, refer to the approved plant lists posted on the Conservation website. Mitigation areas
should contain a diversity of woody species with varying heights sufficient for the space at
least 3 species when the required mitigation area is >300 sgft) and may be supplemented by
an understory of native grasses and fortis (including ferns, herbs, groundcovers, and perennials).
Native grasses and fortis alone cannot be used as mitigation. b)
The recommended plant spacing and densities will be used as shown on the approved plant
lists available on the conservation website 3
c) Only temporary use of mulch may be applied under the drip line of each plant at the time
of planting for moisture retention, soil stabilization, and weed control during establishment
Native groundcovers will be utilized in the spaces between larger plantings. At no time shall a
mitigation or restoration area be sheet mulched. Hand weeding is allowed.
The Mitigation Plan proposes 16 different species of native trees and shrubs that will
provide a diverse community beneficial to the interests of the resource areas. Species were
chosen from Conservation reference sources relative to their native status, and optimal size
and spacing. Rather than stripping the lawn and reseeding the area, grass is to be removed
around each planted shrub or tree. Mulch may be placed under the drip line of the new
vegetation when planted. The densely spaced planting protocol will result in the removal
of most of the lawn, but will leave some grass in place to stabilize the soil. The grass is not
to be mowed, but may be cleared by hand from around the planted material to encourage
optimal growth of the shrubs and trees. Temporary irrigation is to be used for the first two
growing seasons, to establish the plants.
d) Foundation landscape beds within the buffer zone: Proposed foundation landscape bed
plantings should appear on all plans if within resource areas and the 100 foot buffer zone.
Foundation beds are defined as directly abutting a dwelling/structure and are a maximum of
5 feet in width. These areas may be planted with native species, native cultivars, or non-
invasive non -natives with approval from the Commission or the Conservation Administrator.
The Applicant has not decided on foundation plantings. A Condition could be included in
an approval that would require a foundation planting plan to be submitted for approval by
the Conservation Administrator before implementation.
Construction in land subject to coastal storm flowage
The property is located within land subject to coastal storm flowage, Flood Zones VE,
elevation 13 feet; and AE, elevation 11 feet. All proposed construction is located outside of
the velocity zone. The project complies with Town of Yarmouth performance standards for
construction in land subject to coastal storm flowage, Section 4.10(3)a of the Regulations:
a) General Performance Standards
Any activity within land subject to coastal storm flowage which will result in the building upon,
removing, filling or altering of land shall not have an adverse effect on the interests protected by
the bylaw by:
i. reducing the ability of the land to absorb and contain flood waters;
The property is located within a residential subdivision, and supports a single-family
dwelling and appurtenances, to include an attached garage. The existing garage is
proposed to be replaced with a new garage. The net increase in hardscape is 2179 square
feet. This increase in impervious area will not affect the land's ability to absorb flood
waters. The property gently slopes to the buffer zone, vegetated wetland, marsh, and river.
Flood waters will continue to recede to the northwest, and absorb into the ground. Roof
run-off is to be directed to subsurface drywells or stone trenches along the dripline.

i. reducing the ability of the land to buffer more inland areas from flooding and wave damage,
The locus fronts a small tributary off Lewis Bay. All construction occurs beyond the
landward boundary of the VE flood zone. The proposed garage and pool will not impact the
ability of the land to buffer inland areas from flooding and wave damage.
ii. increasing the elevation or velocity offlood waters, or by redirecting or increasing flows or
causing channelization, in each case at the project site, adjacent or nearby properties, or any
public or private way.
The property renovations will not increase the elevation or velocity of flood waters, nor
will it result in channelization. The house foundation will be upgraded to comply with MA
Building Code for construction in a flood zone, and will incorporate breakout panels.
iii. displacing or diverting flood waters to other properties or resource areas. Fences and
privacy walls, including walls separating one property from another, may obstruct or divert
flood flow and waves toward buildings and protected areas. Solid fences (stockade and
similar) must be constructed with 6 inches of clearance below to allow the passage of
floodwaters and wildlife;
The project will not result in the displacement or diversion of waters to other properties.
The pool elevation is below the Flood Zone elevation, so in an extreme flood event, water
would flow over the pool area. The pool fence will be located within the elevated area of
the pool apron. Any other proposed fencing shall be elevated a minimum of 6 inches above
grade.
iv. causing, or creating the likelihood of, damage to other structures on land within the flood
plain as debris (collateral damage);
There will be no increase in the likelihood of debris damaging other property. During
construction, building debris is not to be left on the property overnight.
v. causing ground, surface or saltate pollution triggered by coastal storm flowage;
There will be no increase in pollutants associated with the project. If necessary, pool water
will be pumped and removed off -site, or discharged into the proposed drawdown pit.
vi. reducing the ability of the resource to serve as a wildlife habitat and migration corridor
through activities such as, but not limited to the removal of substantial vegetative cover
and/or installation offencing and other structures which prevent wildlife migration across
property.
The property is located within in a residential neighborhood and does not provide
significant wildlife habitat, nor is it a migration corridor. A large expanse of existing lawn
within the buffer zone is to be restored with native, woody plantings, which will
significantly increase the interest of wildlife habitat. The pool fence will be located within
the elevated area of the pool apron. Any other proposed fencing shall be elevated a
minimum of 6 inches above grade.
vii. prevention of the migration of resource areas such as salt marshes due to sea level rise.
The proposed construction occurs significantly beyond the salt marsh, more than 50 feet
from the bordering vegetated wetland upgradient of the salt marsh.

viii. Ifflood control and storm damage protection functions have already been impaired,
redevelopment must improve existing conditions by reducing impervious surfaces, restoring
flood control and storm damage protection functions, installing native plantings, or by
restoring or creating other wetland resource areas. And shall meet the following
requirements;
ix. Existing septic system and cesspool repairs will be allowed provided they meet all Title 5
and local Board of Health thresholds.
The existing 4-bedroom septic system is to be upgraded to incorporate a 1500 gallon septic
tank and leaching field elevated 5.4 feet above the adjusted groundwater elevation. There
is to be no increase in bedroom number. Two local Variances are being requested for the
minimal reduction in the setback requirements from the resource area to the SAS and
septic tank.
x. All groundwater elevations shall incorporate seasonable adjustments if test holes and or
leaching components are 100 feet or closer from major estuaries.
The adjusted ground water elevation was decided in the field by Health Department Staff.
xi. Any proposed deck, shed, or other similar structure must be securely anchored to a footing
or foundation.
The existing shed is to be relocated outside of the 100-foot buffer zone and securely
anchored.
xii. Any activity shall preserve existing soils, vegetation, and other natural conditions that
serve as buffers to coastal flooding and storm surges.
The property is a developed residential site. The required mitigation will replace existing
lawn with 4230 square feet of native vegetation in the 35 and 50-foot buffer zones,
providing increased flood zone benefits.
c) Additional Performance Standards within the MoWA
Within the MoWA, in addition to the general performance standards set forth in Section 4.10
3)(a), the following additional performance standards shall apply.
i. The new construction and footprint expansion of any building or other structure, road,
impervious surface, or septic system shall be permitted, subject to the other provisions of the
Bylaw and Regulations, provided that any building or occupied structure shall be elevated at
least two (2) feet above the BFE.
The construction is to be compliant with MA State Building Code Standards for
construction in a flood zone. There is no living area or utilities below elevation 13 feet.
ii. No new construction or expansion of any structure that redirects or channelizes floods
including retaining walls, fences, and sea walls shall be permitted.
The proposed construction will not redirect or channelize flood waters. Flood water will
flow over and around the pool area.
0
iii. With respect to any building or other structure, in the event of any substantial repair of the
foundation, any substantial improvement, the entire building or structure shall be elevated at
least two (2) feet above the BFE.
The proposed construction is considered substantial improvement. The existing first floor
is elevated 2.2 feet above the BITE of the AE Flood Zone.
Construction in a riverfront area
The entire project footprint is located within the outer riparian zone of the riverfront area of an
unnamed tributary off Lewis Bay - Massachusetts Mouth of Coastal River Maps attached. In
accordance with 310 CMR 10.58(5), Redevelopment Within Previously Developed Riverfront
Areas; Restoration and Mitigation:
Notwithstanding the provisions of 310 CMR 10.58(4)(c) and (d), the issuing
authority may allow work to redevelop a previously developed riverfront
area, provided the proposed work improves existing conditions
Redevelopment means replacemen4 rehabilitation or expansion of existing
structures, improvement of existing roads, or reuse of degraded or previously developed
areas. A previously developed riverfront area contains areas degraded prior to August 7,
1996 by impervious surfaces from existing structures or pavement, absence of topsoil,
junkyards, or abandoned dumping grounds. Work to redevelop previously developed
riverfront areas shall conform to the following criteria:
a.) At a minimum, proposed work shall result in an improvement over existing conditions
of the capacity of the riverfront area to protect the interests identified in M.G.L. c. 131 § 40.
The Applicants propose to replace 4230 square feet of lawn adjacent to the coastal
resource areas with a diverse native plant community.
Roof run-off is to be directed to subsurface drywells.
The septic system is to be upgraded to incorporate a 1500 gallon septic tank and a
leaching field elevated 5.4 feet above adjusted ground water. There is to be no
increase in the existing bedroom number.
Breakout panels are to be installed in the foundation
c) Within 200 foot riverfront areas, proposed work shall not be located closer to the river
than existing conditions or 100 feet, whichever is less, or not closer than existing conditions
within 25 foot riverfront areas, except in accordance with 310 CMR 10.58(5)(f) or (g).
The existing dwelling is located closer to the river than the proposed construction: The
minimum setback from the deck to the edge of river is 130.8 feet; the pool retaining wall
is proposed a minimum of 131.3 feet from the river. The proposed garage is located on
the boundary of the 200-foot Riparian Zone.
d) Proposed work, including expansion of existing structures, shall be located outside the
riverfront area or toward the riverfront area boundary and away from the river, except in
accordance with 310 CMR 10.58(5)(f) or (g).
The proposed pool construction was revised to be located further from the river than

existing construction. It is proposed within existing lawn and parking area.
g) When an applicant proposes mitigation either on -site or in the riverfront area within
the same general area of the river basin, alteration may be allowed notwithstanding the
criteria of 310 CMR 10.58(5)(c), (d), or (e) at a ratio in square feet of at least 2:1 of
mitigation area to area of alteration not conforming to the criteria or an equivalent level
of environmental protection where square footage is not a relevant measure.
There is a net increase in the post -construction footprint within riparian zone of 1173 sf,
requiring 2346 sf of mitigation. However, the proposed mitigation area is 4230 square feet,
based on the requirements of the Town of Yarmouth Wetlands Protection Regulations, which
more than doubles the mitigation required in the Riverfront Regulations.

MASSACHUSETTS WETLANDS PROTECTION ACT &
TOWN OF YARMOUTH WETLAND BY-LAW, CHAPTER 143
In accordance with the second paragraph of the Massachusetts General Laws Chapter 131, Section 40,
you are hereby notified of the following:
A. The name of the applicant is Christos Kounadis.
B. The applicant has filed a Notice of Intent with the Yarmouth Conservation Commission, seeking
permission to remove, fill, dredge or alter an Area Subject to Protection under the Wetlands
Protection Act (MGL c. 131 s. 40 & Town of Yarmouth Wetland By -Law, Chapter 143).
C. The address of the lot where the activity is proposed is 50 Heritage Drive, West Yarmouth, MA
D. Proposed work is proposed improvements to the property at 50 Heritage Drive, West
Yarmouth to include: interior renovation; construction of second -story addition, garage with finished
second floor, two covered entries, rinse station, and pool with spa, pool apron, and retaining wall;
deck reconstruction and expansion; shed relocation; driveway reconfiguration; installation of exterior
doors and windows; new siding and roofing; and upgrade of septic system.
E. Copies of the Notice of Intent may be examined at the Yarmouth Town Hall at the Conservation
Commission office between the hours of 9:00 a.m. and 4:00 p.m. Monday thru Friday. For more

Step 1/Type of Activity: Describe each type of activity that will occur in wetland resource area and buffer zone.
Step 2/Number of Activities: Identify the number of each type of activity.
Step 3/Individual Activity Fee: Identify each activity fee from the six project categories listed in the instructions.
Step 4/Subtotal Activity Fee: Multiply the number of activities (identified in Step 2) times the fee per category
identified in Step 3) to reach a subtotal fee amount. Note: If any of these activities are in a Riverfront Area in
addition to another Resource Area or the Buffer Zone, the fee per activity should be multiplied by 1.5 and then
added to the subtotal amount.
Step 5/Total Project Fee: Determine the total project fee by adding the subtotal amounts from Step 4.
Step 6/Fee Payments: To calculate the state share of the fee, divide the total fee in half and subtract $12.50. To
calculate the city/town share of the fee, divide the total fee in half and add $12.50.
