HomeMy WebLinkAboutAbutter letter 6.3.2025 Dear Ms. Brittany DiRiezo,Conservation Administrator and the Yarmouth Conservation Commission June 5 2025 Conservation Committee meeting Proposed Elisha's Pond treatment project by Crawford Land Management My name is Steven Wilson and with my wife, Laurel Wilson have lived at 14 Elishas's Pond Road for 47 years since building our home in 1978. We have issues about the proposed project and have several concerns including the following questions: 1. Who is paying for the project, what is the cost and who is financially responsible for payment? 2. Who is signing the contract with Crawford Land Management;what is the duration of the project now and for future years? 3. What is the responsibility of abutters on the pond both in terms of finances and cleanup of dead debris including raking? 4. As an abutter, does the Town of Yarmouth and Conservation Commission agree to any terms of financial responsibility, raking or removal of dead debris? 5. How often will the Conservation Commission receive treatment reports from Crawford beyond the initial three phase treatments? 6. What testing, monitoring and evaluation of results or outcomes of this project will the Conservation Commission conduct this summer, fall or in subsequent years? 7. Does the Commission expect project impact reports from Crawford or will the town conduct independent testing and monitoring of the health of Elisha's Pond as a result of the proposed project later this year and next spring? 8. According to the Crawford Land Management Fluridone information sheet (5/15/25): "Treatment must be repeated consistently and consecutively in following years in order to be effective". Will the Conservation Commission review and approve any future treatments based upon updated testing ? 9. What impact will the chemical treatment have on other plants growing in the pond or animals using the pond including Plymouth Gentian which is listed by the Massachusetts Endangered Species Program as a species of"special concern" and are "legally protected from activities that would destroy habitat"? 10. Review of the Town of Barnstable, Indian Pond Association and Cape Cod Commission websites indicate chemical and physical removal of hydrilla from ponds in Barnstable in previous years including 2010, 2017 and 2022. Can Mr. Hooper provide information regarding his knowledge or best practices regarding these efforts and results to control invasive plants? 11. How many other ponds in Yarmouth and the Cape have reported invasive hydrilla and what treatment options have been used successfully? 12. The western most side of the pond, bordering West Yarmouth Road, is extremely shallow and becomes over grown with water lilies and plants which become so thick in August that a small boat or kayak can barely paddle through this area. What will be the effect of chemical treatment in this area, since there is virtually no way the abutters could possibly hand rake several feet of thick mud and dead plant debris? 13. As an older senior citizen, it is not reasonable to expect me to rake, bag and then carry hundreds of pounds of wet hydrilla from the pond, up the hill to the street for removal to the dump. 14. Although some areas around the pond provide water access, many areas have thick plant growth of bushes and no water access such that raking debris to shore for removal would not be possible. 15. In the initial proposal from Crawford,swimming would be restricted for one week after each treatment application. In the most recent revised proposal of additional information, there was no restriction of swimming.What has changed? 16. With regard to the most recent Crawford mapping of Plymouth Gentian, in addition to these maps, we have photos of Plymouth Gentians along additional properties along the southern edge of the pond not recognized. Plans for Elisha's Pond My husband and I live across the pond in full sight of Camp Wingate-Kirkland. Joel and Pearl Wolfson sold us our lot in 1978. We had worked with them for several summers taking older campers north to hike in the mountains and to explore Nova Scotia. The Wolfsons valued people who would protect the pond as well as keep an eye on the children that splashed in the water. They also knew that we are people who care deeply about the environment and keeping the woods, water, and the many creatures that depend on and around the pond. Joel and Pearl were gracious and wonderful neighbors. We have a small wetland behind our house that has red maples and highbush blueberries that are protected by state and town law and a visible sand plain on the water's edge where there are Plymouth Gentians and several other salt plain plants protected by the state law as an endangered species. The Gentians grow beneath the water in small patches of green until July when the flowers bloom and can be more easily seen and most drop two seeds a summer that propagate more flowers for the following summer season. Then they go back under the water in early September. Amongst warnings are some that might be relevant to changing conditions in the pond due to chemical treatments is a warning stating that Plymouth Gentians are protected from "killing, collection, possession, or sale AND "activities that destroy habitat and thus directly or indirectly cause mortality or disrupt critical behaviors". We have seen many changes in the 47 years we have lived here. More and more houses have been built along the shores. Some have added docks, cut down many trees both inland and on the pond's edge, widened small beaches, cut down bushes so they can see the water better, pushed landscaping down to within ten feet of the water's edge and made trails for people and bike riders near the town- owned parcel. Part of the problem for the cove next to the camp is that new residents that live on it are unaware of the town's laws regarding the environment and tend to do whatever they want. Some are putting yards where there had been bushy areas and are now too near the water's edge. Water from run off of nutrients used in yardwork changes chemical balance in the pond itself. No one from the town has come out to see the changes. When we asked why the town no longer look at property changes, we were told it was too hard for one or two people to do. Unlike Joel and Pearl, the camp now runs several school groups in a program called Outdoor Classroom in the fall and spring in addition to the eight or so weeks of summer campers. It has widened its beach and now built a much larger dock. We have seen damage when wind and waves have pushed across the pond to our shore or a summer storm floods the water's edge. At times rafts of hydrilla near the cove and camp are blown across to the south side making raking and cleanup more difficult. We were told that not all of the hydrilla will die in a year or few. Some will always be present. It can survive in the deepest places where chemicals have not spread and it grows very quickly despite little light or oxygen. As a kettle pond that has a deep area where glacial ice sat until melted, there is an indentation that could easily become the hydrilla's hiding place. Hydrilla can survive with little light and oxygen. Will the chemicals scattered all over the water be sufficient without caused trouble for the plants, animals, birds, fish, insects, and amphibians? Have studies been made of how the chemical being chosen affects all of these? As a former ten-year guide for the Cape Cod Museum of Natural History in Brewster, I am aware how quickly an environment can change from one season or year at a time. It is clear that one change leads to another and often not for the best. I am concerned about the use and abuse that can occur in an instant. At great risk of the proposed project are all of the plants, animals, birds, insects, amphibians, fish and possibly humans that will be affected. Everything is connected in a natural setting by the need for food, shelter, or some special requirements. If a duck dives for a weed and eats a contaminated mouthful of treated water, will it die? Will it float to the shore? If a Tree Swallow scoops up water and insects, will they too die? Will there be a greater number of mosquitoes in our yards as a result? If a flower protected by law is ignored when rising sea water and chemicals mix to overwhelm it, will be able to come back? Plymouth Gentian can only withstand at most six years of high water before it dies. Sometimes fishermen or others troop over the vegetational portion of its cycle when it looks like a small green disc and is easy to be passed by. It produces only two seeds per flower in the best of years. It has survived from a time dating back to the glacial period and is found in only a few places in the world. Looking into this further and reading all the papers supplied to the conservation panel by Mr. Rubenstein, a few things are very clear. He wants to keep the camp area free of the chemicals by what looks like a barrier. That is understandable, but why is it okay if the rest of the pondside residents have to give up several weeks of swimming and might be unknowingly harmed by chemicals? Chemicals flow everywhere and some people are more prone to changes in the water. It also seems the wildlife that are dependent on an important ecosystem appear unimportant. If some die it doesn't seem to matter. We have not been told how much the entire project will cost or who decides when and where to start or end. Mr. Rubenstein sent note of meetings to some people around the pond and has sent many notices to people who abut his property but no complete plans for those who have lived for years on the pond's edge. Many of the people abutting his camp in his listing are not residents ON the pond. That makes a difference because some will not be affected. It seems there is an assumption that every person on the south and west side of the pond can pay someone else to rake, carry and deposit dead weed or to pay all the expenses already run up. Some pond side residents are elderly and live on limited retirement dollars, some are young families with kids just learning to swim, and some have other health challenges when exposed to unusual substances. Will there be a limit to how many years this treatment with chemicals will be used? The original proposal in April was that applying the herbicide would be applied in three sessions starting in May or June. May has passed and paperwork is only ongoing. It makes one wonder why the company selected to spray appears unprepared, unfamiliar with the process and may not be the best choice. How many other businesses in the area were consulted? Owners of land on the pond would like to swim in the summer months. It is a reason most built or bought houses around the pond. This includes youngsters just learning to swim who want to swim like the camp kids they can look across and see having fun. Other people want to have summer visitors join them and would like to offer swimming as entertainment in place of beaches with high parking rates. Some people come only in the summer. Have they been notified that things will be different and they may not be able to swim unless they pay to go to a beach and park this year because hydrilla and the vote made by the conservation panel may not allow swimming after the chemicals are in the water and moving around? Many come to this pond to fish, swim, and explore. My family which includes a full general in the army, his wife, and three grandchildren can only come in the summer because they live in Virginia. They have always treasured swimming in the pond. Our other daughter and her husband live in St. Thomas and cannot visit here often. Summer is the only time they can get away from their jobs. Because of some health issues I am unable to visit them. Additionally, some people on the south and west part of the pond may not be able to pay for treatment of the hydrilla plants because they are elderly, are not able to rake, carry or deposit bags of dead weeds, or are sensitive to changes in water and dead weeds. Treatments are likely to require six more years. Can a limit be put on treatment or can the hydrilla be removed in September? Hydrilla, we were told, can NEVER be totally eradicated. If so, can a limit be set? What happens if someone moves before everything is completed? Property value is apt to drop as long as the pond is treated. We would prefer that no signs be placed on our property or in the water near the shore. Some people may not recognize the Plymouth Gentians in its dormant winter stage beneath the water. Enough damage is being done to the Plymouth Gentians, other treasured plants, environments and wildlife. We do not want any strangers on our property without our permission. Thank you for carefully answering and weighing all the questions and facts. I am not in favor of this plan because it is too disruptive and there are few answers. A few people appear to think they can change everything. Hydrilla is a problem but I have not seen or heard of a convincing permanent solution. I appreciate the time you have taken to address these issues and the other work you have done for the town.
