Administrative Checklist
Notice of Intent
General Information:
All filings must be made on Town of Yarmouth forms. The filing deadline is two weeks prior to the next
scheduled Conservation Commission meeting for new applications. Failure to follow this Checklist shall
result in an Administratively Incomplete Application and will not be advertised for a Public Hearing. Refer to
the meeting schedule. Contact the Conservation Office if you need assistance.
Submitting an Application:
Does the property have any outstanding/expired Orders of Conditions? If so, please file a Request
for Certificate of Compliance for each outstanding/expired Order, as the Commission may not issue a
new Order until any outstanding/expired Orders have been closed and recorded. (*see page 2)
Hardcopy filing dropped off or mailed to the Conservation Office including:
1 Administrative Checklist
1 complete NOI application WPA form 3 with original signatures. Typed signatures will not be accepted.
Detailed narrative of the project including existing & proposed conditions, construction sequence, type of
equipment, staging locations, drainage and stormwater, erosion controls, invasive species management
and alternative analysis. The narrative shall include how the project meets performance standards per
310 CMR 10.0 & TOY Wetland Regulations, delineation sheets (if BVW or vegetated wetlands are
present) or other resource area calculations, and supporting information.
1 100’ radius map, current abutters list identifying the property owners who are to be notified per 310
CMR 10.00 and abutter notification form. Abutters list must be certified by the Town Assessor’s office.
The Assessor’s office requires 7 days advance notice. All abutters must be notified via certified mail.
Certified Mail Receipts (PS Form 3800) for all abutters. Green cards to be submitted at the hearing.
1 original and 7 copies of the plan, folded separately, right side out with title and project address visible.
All plans shall reference NAVD1988 unless otherwise noted. See plan requirements

application.
If not filing via eDEP, a PDF of your application, plan, and all other supporting information must be sent
VIA EMAIL the same day to DEP, Southeast Region at SERO_NOI@mass.gov with the subject line in
the email per DEP’s request listed as “YARMOUTH - NOI - Street Address - Applicant Name” and
copied bdirienzo@yarmouth.ma.us and jjerolimo@yarmouth.ma.us. We must receive a copy of
this email with the application as proof that it has been submitted to DEP.

Waterway’s jurisdiction – Any coastal projects such as, but not limited to, docks, piers, bulkheads,
revetments, dredging and boardwalks shall require submittal of all Notice of Intent, plans and
supplemental information to the Town of Yarmouth Waterways/Shellfish Committee via the Natural
Resources office by certified mail or hand delivery. The applicant or his/her representative must provide
the Conservation office with proof that this has been done or the filing will not be accepted.
Other Requirements
o Does the proposed project meet the applicable regulations of the Town of Yarmouth Zoning bylaws? Do
you need to file with the Yarmouth Board of Appeals? If so, you must file with ZBA after conservation
permitting is completed.

Performance Standards Narrative, Alternatives Analysis, and Construction Protocol
Property Description
The property is in Mill Creek on the interior of Cape Cod. The project is located on the North shoreline of the creek off
Lewis Bay. The proposed work is not located in the direct flow area of the waterway and is not in any restricted areas as
shown on the prohibited area map. The site has an existing single-family dwelling built in or around 1959 (assessors
records) with no existing state licenses. There is an existing wood bulkhead and a staircase that accesses the shoreline
which needs replacement due to age.
The area along the shoreline consists of coastal bank, LSCSF, coastal beach, salt marsh. The purpose of this project is to
remove and replace the wood bulkhead which is all above mapped MHW.
Project Description
This Notice of Intent filing proposes the construction of a new vinyl bulkhead with helical anchors to replace
the existing wood bulkhead. The equipment anticipated for the project will be an excavator with vibratory
hammer that will be utilized to remove the existing wall, dive the helical anchors and the new vinyl sheeting.
The work will be done from the lawn area which includes removing all the plantings along the wall and
replacing them after the work is completed. The existing plants are Rosa Ragosa which will be removed and
replaced with native plantings and a drainage strip with pervious material.
Resource Area Determination
The project site is located on the North shoreline of the salt creek off Lewis Bay. Mean High Water and Mean
Low Water were calculated based on the nearest tidal benchmark and visual resource areas being looked at.
The grass at the base of the wall has all died and or washed away.
Performance Standards
The project proposes the construction of a new vinyl bulkhead to replace the existing wood bulkhead as
shown on the project plans. The areas directly affected by the project is a man-made coastal bank, LSCSF,
coastal beach, salt marsh. The project as proposed will not have any permanent adverse effects to the
surrounding resource areas which include the areas listed above.310 CMR 10, sections 10.21 through 10.37.
The work proposed in this area consists of removing and driving some sheet piles. The area consists of the
coastal beach and artificial coastal bank. The construction is in the footprint of the bulkhead. Therefore, the
project as proposed can be permitted under 310 CMR 10.30 (6) through (8).
Coastal Beach – A portion of the project is within a coastal beach area. The temporary disturbance to the
coastal beach consists of reconstructing the existing bulkhead. The disturbance to the area from the
construction effort is expected to be minimal. The project will not change the role for the beach in storm
damage prevention, flood control, or protection of wildlife habitat. The sheet piles also will not change the
volume or form of the beach sediments, the ability of the beach to respond to wave action, or the effect for

any down drift beach. Therefore, the project as proposed will not have any significant adverse impacts to the
coastal beach can be permitted under 310 CMR 10.27 (1) through (7).
Salt Marsh – Both types of high and low marsh were encountered and are shown on the project plans. The
sheeting will be driven in the old footprint next to the salt marsh. There will be only temporary impacts on the
marsh. Therefore, the project as proposed can be permitted under 310 CMR 10.32 (5).
Alternatives Analysis
The proposed work consists of replacing the existing wood bulkhead with a vinyl sheet pile wall. The project as
proposed occupies only a small area of the resource areas where the sheet piles are driven and the entire
structure is located. As such, the following analysis is offered to describe the available options for this project.
OPTION 1: Do Nothing – If nothing is done the wall will eventually fall and could cause damage to the resource
area. Therefore, this is not the preferred option.
OPTION 2: Replace the older wood on the wall that is dry rotted and failing. To replace pieces of wood the
entire wall would have to be taken apart due to the wood tie backs. This will not work. Therefore, this is not
the preferred option.
OPTION 3: Project as proposed -Construct a new sheet pile wall utilizing vinyl sheeting that will last over 50
years with no further work done. Therefore, this is the preferred option
CONSTRUCTION PROTOCOL
The proposed work shall be performed with the minimum amount of equipment required to obtain the
project objectives. The staging area for materials will be from the owner’s property. All equipment shall be
stored on the driveway when not in use. All means will be taken to keep material from going onto the beach.
Pre-Construction Meeting
Prior to construction, a pre-construction meeting shall be held on-site with the Contractor, Property Owner,
Conservation Commission and/or agent, and the Project Manager (WRS Engineering LLC). The purpose of the
meeting is to clearly delineate the limits of work and access, as well as the staging area. The Contractor will
describe the proposed means and methods for performing the work within the requirements of the plans,
order of conditions and construction protocol. The Contractor will comply with mitigation measures as
established by the Conservation Commission.

To be discussed at this meeting:
u Existing property conditions, necessary precautions to be taken by the contractor.
u Means and methods for construction.
u Necessary post-construction reparations and conditions.
u Procedure for post-construction inspection.
u WRS Engineering’s responsibilities for inspection and project coordination.
During Construction, the site shall be accessible for inspection during reasonable hours by all parties,
members of the conservation commission and their agents, and the Project Manager.
Post-construction meeting
Upon completion of construction, but prior to equipment being removed from the site, a post-construction
meeting shall be held on-site with the Contractor, Property Owner, Conservation Commission and/or agent,
and the Project Manager (WRS Engineering). The purpose of this meeting is to determine that the project has
been satisfactorily completed in accordance with all permits, and that no additional work or mitigation is
required by the Contractor.
Restoration of project area
Upon completion of construction, all areas disturbed by the construction effort shall be returned as much as
practical to their pre-construction conditions to the satisfaction of the property owner and conservation
agent. All disturbed areas of the beach and upper lawn will be graded to match pre-construction conditions for
the surrounding areas, or as determined during the pre-construction meeting.
