(ILEX) is requesting a Certificate of Compliance for the restoration of former cranberry bogs at the Cape Cod Hospital bogs in Yarmouth, Massachusetts approved by the Order of Conditions issued on August 13, 1997 (MassDEP File No. 83-1415). Supplemental restoration work was submitted under a separate Notice of Intent (MassDEP File No. 82-1525) issued in 2000. The wetland restoration work approved by the Order of Conditions was subject to an agreement between the Cape Cod Hospital and the US Environmental Protection Agency (EPA) in regard to enforcement action taken in 1996 and subject to a 1997 Compliance Consent Agreement. The Notice of Intent was submitted soon after the EPA agreement was approved. The restoration of previously-farmed bogs included modifications to flood control (or outlet) structures to maintain wetland hydrology, grading and seeding of upland areas, and removal of irrigation system components. Figure 3 included with the Notice of Intent is attached for your convenience which identifies outlet structures and areas where work was proposed and completed as summarized by the following bullets: • Outlet structures replaced with new flashboards (C1 and D1) • Outlet structures maintained with existing flashboards (A1, A2, and B1) • Outlet structure repaired with new flashboards (E1) • Rip-rap overflow channel installed (Area 1) • Dike stabilized with seed mix (Area 2) • Sand pit stabilized through grading and seeding (by Bog F) • Removal of irrigation system components • Installation of piezometers for five year long monitoring period All work proposed was performed in accordance with the Order of Conditions as supported by the enclosed 2002 Monitoring Report prepared by ENSR (dated May 2003) which details the fifth and final year of monitoring required by the EPA. As such, we request that the Yarmouth Conservation Commission issue a Certificate of Compliance for this Order of Conditions. Page 2 We have enclosed the filing fee of $150.00.
