The below has been confirmed by a DEP wetlands employee. The original OOC was issued and recorded in ‘96. This was superseded by the amended order that was issued in ‘98, which was issued under both the Yarmouth Wetland bylaw and the MA Wetland protection act, and only appealed under the Wetlands protection act. This means the AOOC persisted under the local bylaw, so 083-1352 requires COC requests with both the Town and State (which you have submitted). Currently, this bylaw COC request with the Town is incomplete and requires a statement from a professional land surveyor or engineer certifying the project was completed in accordance with the permit and its special conditions, or detailing any departures from the approved plan, if they exist. Additionally, the AOOC will require recording at the registry of deeds. The next filing deadline is 7/24/2025 for the 8/ 7 meeting, but COC requests can usually be accepted up to a week prior to a scheduled meeting. The SOC was issued by the state DEP, which will also require recording. The SOC requires an as-built plan as you noted, so please provide that to us as well unless the DEP grants your relief request from this requirement. Hello Joe, Can you provide a letter stating that OOC recorded in Book 10204, Page 80 and Amended ORder recorded in Book 12929, Page 180 do not necessitate a COC from the Town, that the DEP has jurisdiction over this amended order by way of the SOC?
