On behalf of our client, Irene Holmes, J. M. O'REILLY AND ASSOCIATES, INC. is submitting the attached
Notice of Intent for the above -referenced property. The Notice of Intent is for the construction of an
elevated stairway with landings stairs to Elisha's Pond. Please refer to the Site Plan for details.
Wetland Resources:
The wetland resources associated with the property include, Land Under a Waterbody (Pond), an Inland
Bank at the Pond's edge and a Bordering Vegetated Wetland (B.V.W.). The most landward resource is the
B.V.W. The 50 and 100-foot Buffer Areas have been shown from the B.V.W. Please find a set of DEP Data
forms outlining the wetland flagging and delineation. The flags have been set in the field, please refer to
plan.
Project Narrative:
The owners have used a foot path for access to the Pond for a number of years. The footpath is about 3
feet wide and meanders within the existing 10 foot wide panhandle from the dwelling to the pond. The
pathway has become more difficult due to the steepness of the slope adjacent to the pond. The intention
is to construct an elevated set of stairs over the sloped area while continuing to utilize the pathway to the
pond. The stairway will allow for safe access to the pond. The stairway will also mitigate potential erosion
along the slope.
The stairway and landing with be open risers and provide 3/8 inch gaps in the decking to allow for sunlight
penetration. The structure will be supported by 4x4 pasts. The posts will be to about 48-inches below
grade and be installed by hand. The storing and cutting of the lumber will occur beyond the 100-foot
buffer zone. Please refer to the Site Plan for additional details and protocols.

The existing footpath within the B.V.W. has veered off the panhandle. The proposal is to simply trim the
existing vegetation to allow for the pathway to be within the 10-foot panhandle. The existing pathway,
off property, will be abandoned and allowed to naturalize. No alteration is proposed on the abutting
property other than letting nature naturalize the area.
We look forward to the Conservation Public Hearing set for August 7, 2025, to present the project. Please

In accordance with the second paragraph of the Massachusetts General Laws Chapter 131, Section 40,
