Dear Ms. Clark,
I am writing regarding 79 Cherry Lane and its current non-compliance with the Town of Yarmouth’s
rental regulations and the Massachusetts State Sanitary Code. You submitted a rental registration
application and I began an inspection with the understanding that the rental was a separate
apartment. It became clear during the visit that the space is a room within the home, not a
standalone unit. I was unable to complete the inspection due to padlocked doors blocking access,
and the areas I could inspect did not meet minimum health and safety standards.
Additionally, the property has a failed septic system on record. Renting property with a failed
system is strictly prohibited until it is repaired or replaced and approved by the Health Department.
During our conversation, you stated you were not planning to rent the property. However, I have
since found an active Airbnb listing advertising a room for short-term rental at this address. A copy
of that listing is attached.
Renting without a valid certificate is a violation of state and local regulations. You must
immediately remove all listings and cease rental activity until the property is fully compliant and
certified.
Please respond by August 15, 2025 to confirm whether you intend to withdraw your registration or
begin corrective steps.
