Although a file # is being issued, please note the following:
NHESP Determinations with comments and TOYs for Estimated Habitat and Rare Species
needed. As per 310 CMR 10.27 (3) any project on a coastal beach shall not have an
adverse effect by increasing erosion, decreasing the volume or changing the form of any
such coastal beach or an adjacent or downdraft coastal beach.
ADDITIONAL REQUIREMENTS:
A Chapter 91 license may be required. Application and transmittal forms are available on
the MassDEP website
