We are writing to request official review of what we believe to be non-compliance of OKH and
Yarmouth Zoning By laws at
90 Freeboard Lane,
Book & Page 29667/0298
Recently two new split face concrete block retaining walls and a stair of the same material were
constructed in a very visible location at the front of the house, and a camper is parked in the new
driveway that was created with the project. Creating the driveway required excavating a portion
of the yard. A photo taken on July 26, 2025 is attached.
Per OKH regulations:
1. A certificate of appropriateness is required for a project of this scope. Non was obtained.
2. Per Recommendations to Applicants, Item 6. C; "Large, exposed concrete foundations
require covering with vegetation or appropriate siding material. There should be not
more than 12 inches of exposed concrete." This whole wall is concrete and very exposed.
3. Per 3.04 Exemptions; A certificate of exemption is only allowed for natural fieldstone
walls under 30" in height. This is a split face concrete block wall, not field stone, that is
over 30" in height.
Per Town of Yarmouth Zoning
1. The camper has been permanently parked at the new driveway for over a week and it
seems that the project was designed and built specifically to contain the camper. As
shown in the photo the camper is located completely in front of the "front building line
of the lot" not " stored to the rear" as indicated below. It is in non-compliance of:
Article 4; Special Regulations, 401 Accessory Uses;
401 ACCESSORY USES.401.1 Camping and Recreational Equipment.
401.1.2 If camping or recreational equipment is parked or stored outside of a
garage, it shall be parked or stored to the rear of the front building line of the lot,
except for loading and unloading.
We request that any variance be denied and that the owner be required to locate the camper to the
rear of the front building line or off property. If each and every owner in the district were
provided the opportunity to store a camper like this, it would severely alter the nature of the
district. Additionally, we request that vegetation be required that limits the exposure of the
concrete wall to 12".
