Chapter 148: Section 30 Violations; notice and enforcement of orders or regulations
Section 30. Violation ofany lawfirl rule. order or regulation of the board or ofany
laufirl order of the marshal or la*firl rule or order of the head of a fire department,
punishment whereof is not otherwise provided for, shall be punished by a fine ofnot
more than fifty dollars for each day during which such violation continues after actual
notice ofthe regulation. rule or order. Such notice may be given by personal service or by
posting the same in a conspicuous place on the premises affected thereby. The superior
court shall have jurisdiction in equity to enforce any lawful rule, order or regulation of
the board, or any lawful order ofthe marshal or rule or order of the head of a fire
departrnent, upon application respectively ofthe marshal or the head of the fire
department.
527 CMR l:06;
( I ) Fire Code Violations. Whenever the marshal, the head of the fire
department or any person to whom the marshal or head of the fire
department has delegated his authority in writing, finds in any building or
upon any premises a violation of 527 CMR or any condition likely to cause
fire or any obstacle to easy ingress or egress from such building, they shall,
in writing, order the same to remedied. Notice of the violation shall be
served in accordance with the provisions of M.G.L. c. 148. $ 5, including,
but not limited to the following:
(a) Dangerous conditions which are liable to cause or contribute to the
spread offire or explosion in or on said premises, building or structure or
endanger the occupants thereof;(b) Conditions which interfere with the efficiency and use of any fire
protection equipment;(c) obstructions to or on fire escapes, stairs. passageways. doors or
windows, liable to interfere with the egress of occupants or the operation
ofthe fire department in case offire;
(d) Accumulations of dust or waste material in air conditioning or
ventilating systems or grease in kitchen or other exhaust ducts;(e) Accumulations of grease on kitchen cooking equipment, or oil,
gretrse or dirt upon. under or around any mechanical equipment;(0 Accumulations of rubbish, waste. paper, boxes, shavings, or other
combustible materials, or excessive storage of any combustible material;(g) Hazardous conditions arising from defective or improperly used or
installed electrical wiring, equipment or appliances;(h) Hazardous conditions arising from defective or improperly installed
equipment for handling or using combustible. explosive or otherwise
hazardous materials;(i) Dangerous or unlawful amounts of combustible, explosive or
otherwise hazardous materials;
0) All equipment. materials, processes or operations which are in
violation of the provisions and intent of 527 CMR.

Sir,
I hevc done an inspoction of yotnr storc and found your kitchcn hood to be in
violation of fire laws. Your cooking equipment hes no hood suppression system.527 CMR
10.03 (8) strtes your system must be maintained in accordance with NF?A 95,2001 edition.
Replacing the cooking equipment on the line with newer enerry eflicient appliences
13g!g, you to meet the UL 3(X) standard for hood supprrssion systcms.
Also, the rephcement of this equipment now pnts the [ood in violation of current building
and mechanicel codes.

Re: Follow Up, Fire Protection Equipment
Dear Lieutenant Matthew Bearse,
On Saturday April 23, 2005 you said I was in violation due to having no hood suppression system. As
far as I know, I have been "grand fathered" under the Massachusetts laws. The Yarmouth Fire Department has
inspected me in the past, and found me at no violations. The only thing that I have found recently is that a K-
Class fire extinguisher may be an upgrade. I was formally ignorant as to what the "K-Class fire extingusher"
was. After research, I have found that it is basically a hand held ANSUL system. I indicated in the past that I
have a hood depression system, and I was informed on many occasions that installing this system would be
oversize for my operation. I immediately gathered this equipment up and installed the canister holder and firing
system on the wall on April 24i, and designed a small plan and an outlay of how the system would work.
I then called you at your office the following day, April 25s, and was told you were on vacation and
would be gone for one week. During the following week, Andrew Amault, sign inspector, entered and made a
list of my equipment and took the dates offof them. I have indicated through Mr. Amault that none of this
equipment is new, and has been here for at least 15 years. He said he would contact you and get back to me. On
May l0 you arrived at the store lat€ in the aftemoon, around 4:00 p.m., and asked one of my clerks if you could
go upstairs. You disregarded the fact that I have started to work on a hood depression system. This system is a
ANSUL R-l02 Wet Chemical Firing Depression System. Under Massachusetts code, this system is in
compliance. I contacted your office and had a brief phone conversation with you around 5:00 p.m. on this same
day, Tuesday, and was asking you ifthis system would meet your criteria. You indicated to me that I had
replaced equipment. However, none ofthis equipment has been replaced, each piece was bought and installed
new.
I apologize for cleaning my kitchen and maintaining my equipment since you believe it is new. I have
been inspected on several occasioffr in the past by different fire deparment memhrs, none of which have found
me not in compliance.
I have made an attempt to come up with a system that I believe I can afford to install which meets your
criteria. Since this establishment is 116 years old, and we've been serving food for over 75 years, we have
accommodated all cunent health codes. We would like to cooperate within the means of the output of this
establishment. It would put my business and my financial position at a loss to upgrade this kitchen for a benefit
ofa new code. Safety has been tested over the last 1 16 years. The layout of this store, the inadequate parking,
the 16+ seats, and the no restrooms are a lot to overcome. You don't invest where there is no retum. I believe I
am still under a grand fathered law. Nothing has been updated.

The ventilation systems in use do not meet current standards as per 780 CMR, Massachusetts State
Building Code.

grease-producing appliances in the kitchen. According to the owner, Charles Clark, the deep fat fryer
dates from 1996, ttre griddle dates from 1990, and the range (witlt cooktop) dates from 1993.

We met today and discussed the configuration ofthe kitchen, and the nature ofyour
business as it is currently configured. That discussion was based on previous
communications from and to the fire department relative to those issues in an open file. It
was my understanding that you have discontinued deep frying and cut back drastically on
your menu availability.
I also understood that the present configuration has been in place for about l7 years and
no substantive changes have taken place in that time. Due to these factors I see no
immediate need to order upgrades to the equipment in place. I would reserve the right to
order changes if the nature ofthe business changes or ifanl'changes in configuration are
undertaken.
I would like to thank you for your understanding in this matter, please contact me or my
colleagues if we can be of an1' assistance in the future.
