Mr. Johnson,
I have researched the records ofthe Yarmouth Fire Department and found record of no
Above-ground Storage Tanks (AST) tisted for any of the three properties.
For the property at 1282 Route 28, south Yarmouth, MA 02664, there are records of the
fottowing.
lnstattation of three (3) singte watt, steet, Underground Storage Tanks (UST) dated
May of 1952, each 3000 gattons capacity, a[[ used to store gasoline.
lnstal[ation of one (1) UST dated February of 1957, 4,000 gatlons capacity used to
store gasotine.
Remova[ of the four (4) above noted tanks. Additionatty, one (1) 550-gatton waste oil
and one(1 ) 550-gatton fue[ oil tank were removed.
lnsta[lation of three (3) doubte watt, fiberglass, UST, each of 10,000 capacities, to be
used to store gasotine, dated 11112/1987.
A report of a gasotine spitt of approximatety 25-30 gattons which was contained and
absorbed by the Fire Department on 0210711986. Disposat of the contaminated soi[ was
conducted by Warren Oi[.
A report that contaminated soil was identified and remediated at the time of the tanks'
removaI on 1O/2O/1987. Mark Netson IEP was named as the removat/remediation
co ntra cto r.
A report of a spitt of approximatety 40 gattons was identified and addressed by YFD, YPD
and reported to Mass Department of EnvironmentaI Protection and the EnvironmentaI
Potice on 06/27 /1997 .
There are no records of spitts or re[eases of hazardous materia[s for any of the other
properties in question, nor any contiguous properties.

Enctosed pteass find a Notice of Noncomptiance (Notice), an important tegal document, describing
the activities that ars in noncomptiance. This Notice tists the viotations and those actions that arerequired to achieve comptiance.

Received call for a 40 ga11on gasoline/diesel fuel epi1l from Tom williamson of EnviroErac,
508-543-9200 who had been contacted by Extrmart to respond and cleanuP the spill. On
locaEion found that the Bpill waa caused by draining a fuel tsank aE 0600 Hrs. Notified all
appropriate parEles per protocol- DEP ,Iulie Hutschinson, Darren Myer from YHD, Tom Troy
from
YDNR and SgE. Xzaros from YPD responded. Do Eo heavy concentration of vapors a fire detail
watqh was esEablished using FF Parker and che area was taped off'
Mr. ,foseph Gorham of 72
Studley Rd., S,Y. 39A4287, an employee of ExtramarE, came to tshe area after being cal1ed
and explained that he had come to rrork and relieved Mr. Bob Slritzer who had put diesel
fuelinto Ehe Eank of a dump t.ruck owned by Visceglio & Sons Paving Contsractors, and thaE tshe
vehicle waa supposed to be fi11ed with gasoline and there 'raa a verbal confrontaEion in
progress. Mr. Gorham, with help from lhe contractor, emptied the contents flom tshe fuel
tank
into 5 gallon contsainers and pour game on the ground Eo Ehe rear of Ehe Extramart - The
conLractor in6i8Eed that the tank be refilled and drained a second lime and the cootents
ldere poured on the ground tso the rear of the ExEramart and along the bushes separating the
abutting property. The tank was then refilled wiEh gasoline.
cleanup efforts were
