2. Commission hereby finds the project, as proposed, is:

wetlands regulations. This Commission orders that all work shall be performed in accordance with the Notice of
Intent referenced above, the following General Conditions, and any other special conditions attached to this
Order. To the extent that the following conditions modify or differ from the plans, specifications, or other
proposals submitted with the Notice of Intent, these conditions shall control.

C. General Conditions Linder Massachusetts Wetlands Protection Act
The following conditions are only applicable to Approved projects
I. Failure to comply with all conditions stated herein, and with all related statutes and other regulatory measures,
shall be deemed cause to revoke or modify this Order.
?. The Order does not grant any property rights or any exclusive privileges; it does not authorize any injury to
private property or invasion of private rights.
3. This Order does not relieve the permittee or any other person of the necessity of complying with all other
applicable federal, state, or local statutes, ordinances, bylaws, or regulations.
4. The work authorized hereunder shall be completed within three years from the date of this Order unless either
of the following apply:
a. the work is a maintenance dredging project as provided for in the Act; or
b. the time for completion has been extended to a specified date more than three years, but less than five
years, from the date of issuance. If this Order is intended to be valid for more than three years, the
extension date and the special circumstances warranting the extended time period are set forth as a
special condition in this Order.
5. This Order may be extended by the issuing authority for one or more periods of up to three years each upon
application to the issuing authority at least 30 days prior to the expiration date of the Order-
6- If this Order constitutes an Amended Order of Conditions, this Amended Order of Conditions does not exceed
the issuance date of the original Final Order of Conditions,
7 Any fill used in connection with this project shall be clean fill. Any till shall contain no trash, refuse, rubbish,
or debris, including but not limited to lumber. bricks, plaster, wire, lath, paper, cardboard, pipe, tires, ashes,
refrigerators, motor vehicles, or parts of any of the foregoing.
8. This Order is not final until all administrative appeal periods from this Order have elapsed, or if such an appeal
has been taken, until all proceedings before the Department have been completed.
9_ No work shall be undertaken until the Order has become final and then has been recorded in the Registry of
Deeds or the Land Court for the district in which the land is located, within the chain of title of the affected
property. In the case of recorded land, the Final Order shall also be noted in the Registry's Grantor Index under
the name of the owner of the land upon which the proposed work is to be done. In the case of the registered
land, the Final Order shall also be noted on the Land Court Certificate of Title of the owner of the land upon
which the proposed work is done. The recording information shall be submitted to the Conservation
Commission on the form at the end of this Order, which form must be stamped by the Registry of Deeds, prior
to the commencement of work._

10. A sign shall he displayed at the site not less then two square feet or more than three square feet in size bearing
the words,

11 Where the Department of Environmental Protection is requested to issue a Superseding Order, the
Conservation Commission shall be a party to all agency proceedings and hearings beforekiass DEP_
12. Upon completion of the work described herein, the applicant shall submit a Request for Certificate of
Compliance (WPA Form 8A) to the Conservation Commission.
13. The work shall conform to the plans and special conditions referenced in this order.
14. Any change to the plans identified in Condition 413 above shall require the applicant to inquire of the
Conservation Commission in writing whether the change is significant enough to require the filing of a new
Notice of Intent -
and The Agent or members of the Conservation Commission and the Department of Environmental Protection shall
have the right to enter and inspect the area subject to this Order at reasonable hours to evaluate compliance with
the conditions stated in this Order, and may require the submittal of any data deemed necessary by the
Conservation Commission or Department for that evaluation.
16. This Order of Conditions shall apply to any successor in interest or successor in control of the property subject
to this Order and to any contractor or other person performing work conditioned by this Order.
17. Prior to the start of work, and if the project involves work adjacent to a Bordering Vegetated Wetland, the
boundary of the wetland in the vicinity of the proposed work area shall be marked by wooden stakes or flagging.
Once in place, the wetland boundary markers shall be maintained until a Certificate of Compliance has been
issued by the Conservation Commission.
18. All sedimentation barriers shall be maintained in good repair until all disturbed areas have been fully stabilized
with vegetation or other means. At no time shall sediments be deposited in a wetland or water body_ During
construction, the applicant or his?her designee shall inspect the erosion controls on a daily basis and shall
remove accumulated sediments as needed- The applicant shall immediately control any erosion problems that
occur at the site and shall also immediately notify the Conservation Commission, which reserves the right to
require additional erosion and,'or damage prevention controls it may deem necessary. Sedimentation barriers
shall serve as the limit of work unless another limit of work line has been approved by this carder.
NOTICE OF STORMWATER CONTROL AND MAINTENANCE REQUIREMENTS
19- The work associated with this Order(the "Project") is ( I ) l— is not (?)W subject to the Massachusetts
Stormwater Standards. If the work is subject to Stormwater Standards, then the project is subject to the
following conditions;
a) All work, including site preparation, land disturbance, construction and redevelopment, shall be implemented
in accordance with the construction period pollution prevention and erosion and sedimentation control plan
and, if applicable, the Stormwater Pollution Prevention Plan required by the National Pollutant Discharge
Elimination System Construction General Permit as required by Stormwater Standard 8. Construction period
erosion, sedimentation and pollution control measures and best management practices (BNIPs) shall remain
in place until the site is fully stabilized-
b) No Stormwater runoff may be discharged to the post -construction stormwater BMPs unless and until a
Registered Professional Engineer provides a Certification that: i. all construction period BN4Ps have been
removed or will be removed by a date certain specified in the Certification. For any construction period
BMPs intended to be converted to post construction operation for stormwater attenuation, recharge, and/or
treatment, the conversion is allowed by the MassDEP Stormwater Handbook BMP specifications and that the
BhIP has been properly cleaned or prepared for post construction operation, including removal of all

construction period sediment trapped in inlet and outlet control structures: ii . as -built final construction
BA,IP plans are included, signed and stamped by a Registered Professional Engineer. certifying the site is
fully stabilized; iii. any illicit discharges to the stormwater management system have been removed, as per
the requirements of Stormwater Standard 10-, iv all post -construction stormwater BMPs are installed in
accordance with the plans (including all planting plans) approved by the issuing authority, and have been
inspected to ensure that they are not damaged and that they are in proper working condition; 11 any vegetation
associated with post -construction BMPs is suitably established to withstand erosion
c) The landowner is responsible for BMP maintenance until the issuing authority is notified that another party
has legally assumed responsibility for BMP maintenance. Prior to requesting a Certificate of Compliance, or
Partial Certificate of Compliance, the responsible party (defined in General Condition 19(e)) shall execute
and submit to the issuing authority an Operation and Maintenance Compliance Statement ("O&M Statement")
for the Stormwater BMPs identifying the party responsible for implementing the stornwater BMP Operation
and Maintenance Plan ("O&NI Plan") and certifying the following: i.) the O&M Plan is complete and will be
implemented upon receipt of the Certificate of Compliance, and ii.) the future responsible parties shall be
notified in writing of their ongoing legal responsibility to operate and maintain the stormwater management
BN4Ps. and implement the Stormwater Pollution Prevention Plan.
d) Post -construction pollution prevention and source eontro[ shall be implemented in accordance with the long-
term pollution prevention plan section of the approved Stonnw•ater Report and, if applicable, the Stormwater
Pollution Prevention Plan required by the National Pollutant Discharge Elimination System Multi -Sector
General Permit.
e) Unless and until another party accepts responsibility, the landowner, or owner of any drainage easement,
assumes responsibility for maintaining each BMP. To overcome this presumption, the landowner of the
property must submit to the issuing authority a legally binding agreement of record, acceptable to the issuing
authority, evidencing; that another entity has accepted responsibility for maintaining the BMP, and that the
proposed responsible party shall be treated as a permittee for purposes of implementing the requirements of
Conditions 19(f) through 19(k) with respect to that BMP. Any failure of the proposed responsible party to
implement the requirements of Conditions 19(f) through 19(k) with respect to that BMP shall be a violation
of the Order of Conditions or Certificate of Compliance. In the case of stormwater BMPs that are serving
more than one lot, the legally binding agreement shall also identify the lots that will be serviced by the
stormwater BMPs. A plan and easement deed that grants the responsible party access to perform the required
operation and maintenance must be submitted along with the legally binding agreement.
fl The responsible party shall operate and maintain all stormwater BMPs in accordance with the design plans,
the O&M Plan, and the requirements of the Massachusetts Stormwater Handbook.
g) The responsible party shall:
1. Maintain an operation and maintenance log for the last three (3) consecutive calendar years of
inspections, repairs, maintenance andior replacement of the stormwater management system or any part
thereof, and disposal (for disposal the log shall indicate the type of material and the disposal location),
?. Make the maintenance log available to MassDEP and the Conservation Commission ("Commission")
upon request; and
3. Allow members and agents of the MassDEP and the Commission to enter and inspect the site to evaluate
and ensure that the responsible party is in compliance with the requirements for each BMP established in
the O&M Plan approved by the issuing authority.
h) All sediment or other contaminants removed from stormwater BMPs shall be disposed of in accordance with
all applicable federal, state, and local laws and regulations.
i f Illicit discharges to the stormwater management system as defined in 310 ChtR 10.04 are prohibited.
j) The stormwater management system approved in the Order of Conditions shall not be changed without the

prior written approval of the issuing authority.
k) Areas designated as qualifying pervious areas for the purpose of the Low Impact Site Design Credit (as
defined in the MassDEP Stormwater Handbook, Volume 3, Chapter 1, Low Impact Development Site Design
Credits) shall not be altered without the prior written approval of the issuing authority.
I) Access for maintenance, repair, and/or replacement of BMPs shall not be withheld. Any fencing constructed
around stormwater BMPs shall include access gates and shall be at least six inches above grade to allow for
wildlife passage.

Project description: Proposed coastal stabilization expansion with additional fiber rolls in Riverfroni area, LSCSF,
and coastal bank.
GENERAL:
I . This Order shall apply to any successors and assigns in interest or control and any other person engaging in
activity on the property identified in the Notice of Intent.
?. The applicant/owner shall be responsible for always having a copy of the Order of Conditions on the job site
and shall be responsible for ensuring that all people performing the permitted activity are fitlly aware of its
terms and conditions. Failure to do so may result in the revocation of this permit, a fine or both.
3. This Order of Conditions shall be recorded at the registry of deeds"7and court and proof of the recording
shall be submitted to the Conservation Commission prior to the Pre -Construction meeting.
4. The Conservation Commission, its agents and employees, shall have the right of entry upon the job site at all
reasonable times for the purposes of inspecting for compliance with the terms of this Order of Conditions
until a Certificate of Compliance is obtained and recorded at the Barnstable Registry of Deeds. Commission
members and the Conservation Administrator may acquire any information, measurements, photographs,
observations and/or materials or may require the submittal of any data/information deemed necessary by this
Commission for that evaluation.
5. This Order of Conditions authorizes only the activities described on the approved plants) and approved
documents referenced in this Order of Conditions. Any other or additional activities in areas within
jurisdiction of the Conservation Commission require a separate review and approval by the Conservation
Commission.
6. Any change in the approved plan(s) which may or will alter an area subject to protection under the Wetlands
Protection Act (310 CMR 10.00) and the Town of Yarmouth Wetlands Protection Regulations, shall require
the Applicant to file, in writing, a notice of project change with this Commission and/or Staff prior to
implementing the change in the field to determine the significance of the change and determine whether
administrative approval or an Amended Order of Conditions or new Notice of Intent is required. Any errors
in plans or infonnation submitted by the Applicant or their Representative shall be considered changes, and
the above process shall be followed. Should the project be changed without permission or found by the
Yarmouth Conservation Commission to be altered in any way from the approved plan(s), all work will
immediately cease until the project is reapproved by the Commission.
7. The Order of Conditions is valid for three years from the date of issuance unless otherwise specifically
noted. Extension requests must be applied for at least 30 calendar days prior to the expiration date. Failure to
do so will result in a new Notice of Intent filing.
R. The Commission reserves the right to amend this Order of Conditions prior to the completion of
construction, after a legally advertised public hearing if plans or circumstances are changed or if new
conditions or information so warrant.
9. The Commission reserves the right to require additional information from the Applicant or his/her
Representative prior to completion of construction, after a legally advertised public hearing, if plans or
circumstances are changed or if new conditions or information so warrant. If the Applicant will not provide
such information, the Commission reserves the right to hire a third party applicant at the homeowner's
expense to obtain the information needed.
10. Noncompliance with these conditions shall constitute grounds to revoke this permit and/or for an
Enforcement Order and fines. Fines shall not exceed $300.00 per day/per violation.
PRE-CONSTRUCTON:
11. Prior to any site disturbance, a pre -construction meeting shall be arranged by the applicant to be held with
the responsible contractors (or those performing the work) and Conservation Administrator (CA) to review
the Order of Conditions, the work protocol and other required materials identified in this Order of
Conditions. Notice of work start and completion along with the name(s) and telephone number(s) of the
person(s) responsible on site for compliance with this Order shall be given in writing before or during the
Pre -Construction meeting. Work shall not begin until a pre -construction meeting is held, and the CA
determines the work can proceed.
12. Prior to the pre -construction meeting,
a. All sedimentation controls (i.e_ silt fences, and/or straw wattles at the work limit) shall be in place
and ready for inspection. The CA may instruct the contractors to modify the sedimentation controls

to protect wetland Resource Areas. Hay is not acceptable. It is the applicant's responsibility to
implement and maintain appropriate and adequate erosion controls measures until the site is stable-
b. Resource Areas, and strictures shall be staked in the field. Such markers shall be placed by a
professional Land Surveyor or Engineer. The engineer or land surveyor for the project shall take
responsibility for the placement of the stakes and refreshing the stakes as necessary to reflect the
approved plan until the construction is complete. No work shall occur on the Resource Area side of
the work limit line.
c. A sign shall be visibly displayed on the site showing the DEP and/or the Yarmouth Conservation
Division file number and shall remain posted until the issuance of a Certificate of Compliance.
d. A copy of this Order of Conditions and site plan shall always be kept on -site and visibly displayed
in a weatherproof container.
DEMOLITION AND CONSTRUCTION
13. Washing of equipmentltools shall be done OFF -SITE
14. No equipment shall be refueled, nor shall fuel be stored within 100 feet of a resource area.
15. Machinery and vehicles, when not in use, shall be parked on the existing driveway, unless otherwise
specified in the Order of Conditions or on the approved site plants).
VEGETATION AND MITIGATION PLANTINGS:
16. Any area that is disturbed shall be revegetated with suitable native plant materials according to the site plan
immediately or as soon as the growing season commences until permanent stability is reached.
17. The planted Mitigation and/or Restoration Areas shall be allowed to naturalize in perpetuity. The area must
be left undisturbed and there shall be no use of fertilizers, removal of leaf litter, subsurface irrigation
system, hardscape, structures of any kind, or creation of lawn. Periodic weeding of invasive vegetation is
allowed.
18. Mulch may only be applied under the drip line of each plant at the time of planting for moisture retention,
soil stabilization, and weed control during establishment. Native groundcovers will be utilized in the spaces
between larger plantings. At no time shall a mitigation or restoration area be sheet mulched.
19. Plantings shall be cared for to ensure their survival. Temporary above surface irrigation is permitted for the
first three (3) years for establishment.
20. Dumping Prohibited: There shall be no dumping of leaves, grass clippings, brush, or other debris within anv
Resource Area or associated buffer zones. This is an on -going condition that does not expire with the
issuance of a Certificate of Compliance.
21. The applicant shall notify the CA in writing when the mitigation or restoration plants are installed.
22. A monitoring report shall be submitted by November 15'h annually for three years after the coir logs and
plants are installed. This Report shall include a description of the site conditions and photo documentation
as appropriate to show any changes. The report shall also include an assessment of the planted areas, and
identify any management concerns and solutions along with the timeline of implementation if applicable.
23. The applicant must wait until the plants have been in place for at least 2 years before the Request for a
Certificate of Compliance is submitted. During this time, the CA may require additional plantings if it is
determined that any specimens are dead or dying and need replacement.
WATERFRONT:
24. There shall be no dredging in connection with this project. No pipes, drains, or outlets of any kind shall be
placed in or through the bulkhead.
�5. Piles placed below Mean Low Water (MLW) shall be mechanically driven to refusal, not jetted. Piles in a
sal marsh and coastal bank shall be placed by hand.
26. The project shall consist of using only non -leaching types of treated lumber. Creosote lumber is prohibited.
217_ The proposed pier shall be designed to allow for adequate public passage either above or below the stricture
between Mean high and Mean Low water lines.
218_ No heavy construction equipment, vehicles or barges shall be permitted on a bordering vegetated wetland,
saltmarsh or tidal flat during the construction.
29_ Between November I.' and April I" annually, any pier components, including but not limited to floats and
ramps, dinghies, kayaks etc... shall be stored in upland locations. There shall be no items stored upon salt
marsh, coastal beach, or coastal bank areas under any circumstances.
301 No additional floats of any kind (including but not limited to swim floats and jet ski floats.) shall be moored
from the dock, pilings or approved floats.

31. All shellfish within the footprint of the proposed structure shall be removed under the direction of the
Natural Resource Division at the applicant's expense. The shellfish mitigation fete shall be submitted as
required by the Natural Resource Division.
32. A copy of the Chapter 91 license from DEP Waterways shall be submitted to the Conservation Commission.
33. Beach nourishment material shall be of equal grain size and appropriate slope to avoid premature loss from
the beach and impacts to near shore bottom habitat. Grain size analysis shall be provided prior to
nourishment activity. All nourishment material shall be placed above the MHW line to facilitate a more
gradual distribution of sediment, allowing mobile organisms to avoid the area of impact and burrowing
organisms to respond to a smaller sediment load.
34. Approved nourishment shall be reported to the conservation commission in writing once complete with the
volume used
35. Wrack shall be removed by hand from new plantings and taken offsite. No sand fence shall be installed.
36. No heavy constriction equipment, vehicles or barges shall be permitted on a bordering vegetated wetland,
saltmarsh or tidal flat during the construction.
CERTIFICATE OF COMPLIANCE:
37_ Upon completion of the project. a Request for a Certificate of Compliance shall be submitted by the
applicant to the Conservation Commission for review.
38_ The request shall include the following:
a. A written statement from a similar professional as prepared the approved plan, such as a
Massachusetts registered professional engineer or land surveyor, certifying that a site inspection
has been performed, the date of this inspection, and that the work has been conducted in
compliance with the plan(s) and documents referenced above, as conditioned by the Commission.
Any deviation from the approved plans) shall be identified.
b. A stamped as -built plan including final contours, structures, resource areas and buffer zones, and
planted areas, prepared and signed and stamped by a Massachusetts registered professional
engineer or land surveyor.
39. This Order of Conditions shall be considered in non-compliance until the applicant has obtained a
Certificate of Compliance and it has been recorded at the Barnstable Registry of Deeds. A copy of the
recording information must be submitted to the Commission.
