Nitrogen Aggregation Filin g
The applicant is proposing a gas station and convenience store on a 51,280 s.f. vacant
property with an 800 gallons per day design flow. Since the site is located wiltin a
State Zone Il, the Title 5 440 rule is in effect. This regulation (3f 0 CMR: 15.214)
limits sewage flow to 440 gallons per day per conventional acre ofland. The 800 GPD
design flow will reqfire 72.,728 s.f, to achieve this requirement. The applicants are
proposing to deed restrict the 25,846 s.f. property located at 446 Station Avenue
against man-made nitrogen sources to make up for the required area. This propertv
is located within the same well area and is under control ofthe applicant. The
combined 77 ,126 s.f. of the two properties will exceed the 72,728 s.f. required, The
draft restriction documents are attached for review. Note that a portion of487
Station Avenue will be combined with the locus lots to make up the 51,280 s.f. area of
the proposed gas station lot. This lot at 487 Station Avenue will remain in compliance
with the 440 rule with 264 GPD flow on a 34,497 s.f. lot. This project has been
approved by Site Plan Review and the Zoning Board of Appeals, the applicant would
sincerely appreciate the Board finding favorably on the application to allow
aggregation of the site's flow as discussed above. Please do not hesitate to contact me

As part ofthe neighboring gas station project 173 & 479 Station Avenue, the
applicant is proposing to purchase 7,306 s.f. ofthe property at 487 Station Avenue. A
variance was approved for this office building by the Board of llealth and deed
restricted to a 264 GPD flow back in 1998. Since the site is located within a State
Zone ll, the Title 5 440 rule is in effect. This ordinance limits sewage flow to 4
bedrooms per conventional acre ofland. The264 GPD design flow will require 24,000
s.f. to achieve this requirement. The remaining area of 487 Station Avenue will be
32,497 which will exceed the required area to meet the state requirements. We
respectfully ask the Board of Health modifo this variance to account for the smaller
lot size as it will still be adequate to meet the Title 5 Zone II requirements. A copy of
th€ ANR plan showing the conveyance parcel and the remaining land is attached for
reference.
