WHEREAS, COLBEA ENTERPRISES, L.L.C., a Delaware Iimited liability company whose
address is 2050 Plainfield Pike, Cranston, zu 02921, owns that certain land commonly known as 446
Station Avenue, South Yarmouth, Bamstable County, Massachusetts ["Premises"], shown on the plan of
land entitled "Plan ofSurvey in Yarmouth, Mass. for Shell Oil Company by Stanley Engineering, [nc.",
dated May, 1975 and recorded with the Bamstable County Registry ofDeeds in Plan Book 297, Page 38,
and further evidenced by that certain deed recorded in said Registry in Book 233 12, Page 156, and
WHEREAS, COLBEA ENTERPRISES, L.L.C., as the owner of the Premises, has agreed with
the Town of Yarmouth to restrict the future use of the Premises from the sale of motor vehicle fuels.
NOW THEREFORE, COLBEA ENTERPRISES, L.L.C., hereby places the following restriction
on the Premises lor the benefit ofthe Town ofYarmouth. Massachusetts:
l. The Premises shall not be used for the sale ofmotor vehicle fuels
This restriction shall run with the land and be binding on Petro Realty Corp and all of its
successors in title.
