SE83-2452 Wayne Tavares for Aleksandr Nemanov,2 Buttercup Lane, Pro posed construction of a dock within LSCSF, a coastal bank, salt marsh, and land under a water body. Discussion: The Watenruays and Shellfish Advisory Committee made multiple comments about this project at many meetings. ln the end, Watenruays voted not to recommend the project due to concerns about shellfish. DMF gave specific parameters including concerns about the lack of depth, large size of the dock system, and time of year restrictions. The dock is proposed at 13.3 feet from property boundary, while the requirement is 25 feet, but the neighbor did write a letter of endorsement for the project. The biggest concern for this project is the lack of water depth at mean low water. lt is currently at 1.6 feet on the plan, while the requirement is 3 feet. Mr. Tavares stated that the cross- section plan that was submitted has not been updated to reflect micro contours on the site, which are shown on the site plan. Even with these updates, only.2 feet would be gained, and the proposed project would still not meet the required depth. The CA stated that plans submitted must show accurate onsite conditions. lssues exist for the other open OOC for the house construction and include construction debris scattered onsite, the erosion control not being maintained, and the DEP sign not being present. These were all brought to the applicant's attention in March but have not yet been addressed. The CA recommended issuance of a fine. The commission were not in support of this project as proposed. The applicant requested a continuance to Nov. 21. Commissioner Bernstein made a motion to continue to Nov 21. SE83-2448 WRS Engineering for Jody and Paul Steel, 66 Grandview Drive, Proposed dredging, remova! of boat lift and installation of floats with stops within land under the ocean and land containing shellfish Presenting: Jay Norton from WRS Engineering 1 On LL/712024, on a motion by Commissioner Bernstein, seconded by Commissioner Mulhearn, the Commission voted 5-0 with 1 abstention, to approve these minutes as written. Discussion: The owners permitted a dock with boat lift in 2021. They would now like to remove the boat lift and dredge the area to reach the required depth to add a float. The owners would be willing to relocate the shellfish and pay in lieu mitigation into the shellfish account in the amount required by the Watenrvays committee. Mr. Norton said the present conditions make it difficult to operate the boat lift. Commissioner Bower asked about the life expectancy of the dredging- it would need maintenance dredging but the exact frequency is not known. The current regulations do not allow dredging to meet the minimum depth for new floats. Approval of Meeting Minutes. September 19,2024 and October 3, 2024 Commissioner Bernstein made a motion to accept the minutes from both meetings. Motion was seconded by Commissioner Bower The motion carried 5-0 Review of Reo ulation updates No one on zoom or in audience to make comments. Changes are being made to support the new Wetland Bylaw that was approved at ATM in Spring 2024 to include supporting regulations for vernal pools, updated tree replacement guidelines in flood zones, and some minor updates throughout. Commissioner Bernstein made a motion to accept the new regulations with an effective date of November 17,2024. The motion was seconded by Commissioner Bower The motion carried 5-0 8. The Coastal Zone Management sponsored COASTSWEEP volunteer beach cleanup event will be held on November 2,2024 this year. Check in at Smugglers beach.
