CONSERVATION COMMISSION MEETING MINUTES Members Present: February 20,2025 Ed Hoopes (Chairman), David Bernstein, Bradford Bower, Patricia Mulhearn Jack Frost, Paul Huggins (Vice chair)Absent: Staff:Brittany DiRienzo Start Time:5:00 pm Continued Notice of lntent 1. SE83-2460 Cape Cod Engineering for Lighthouse Realty Trust,1033 Great lsland Road, Proposed bank stabilization with sand bags and reconstruction of concrete sea walls within a coastal bank, coastal beach, and the velocity flood zone. Representative: Bob Perry, Cape Cod Engineering; Stephen Lee, Wilkinson Ecological Design Discussion: The wall return at the western end was removed and replaced with a sand berm. Mr. Lee discussed the seaside goldenrod and oaks that were added to the planting plan as requested. CA stated annual monitoring reports are required along with brief reports after significant storms to assess' potential damage. Commissioner Bernstein made a motion to issue an OOC with the special conditions including annual monitoring and storm reports for the life of the permit. The motion was seconded by Commissioner Bower. The motion carried 4-0. Notice of lntent 2. SE83-2463 Cape Cod Engineering for Rosangela Caloiero,59 Ovster Cove Road easement , Proposed construction of a dock in Coastal Bank, Coastal Beach, Salt Marsh, Land Containing Shellfish, Land Under the Ocean, LSCSF, and Riverfront Area. Discussion: Commissioner Mulhearn must recuse herself. Only 3 commissioners remain, so no quorum is present. CA spoke with the representative Attorney Wall on the phone earlier today informing him of the quorum issue and the continued hearing date of March 6,2025. Chairman Hoopes tabled the item to March 6,2025. Continued Notice of lntent 3. SE83-2458 BSC Group, lnc. for Robert and Maureen Kelly,146 Mavfl r Terrace, Proposed construction of pier, ramp and float system within LSCSF, coastal bank, salt marsh, land under the ocean, land containing shellfish and the buffer zones to a salt marsh and coastal bank. Representative: Kieran Healy, BSC Group, lnc. Discussion: Mr. Healy stated the requested revisions were made including removal of the revetment work and fill and shortening of the dock. A new variance is needed for float depth, they have 2.1 feet at MLW at the seaward end of the float. Float stops are proposed. The board discussed the DMF comments including the required time-of-year restriction. On 03/0512025, on a motion by Commissioner Bernstein, seconded by Commissioner Bower, the Commission voted 4-0, to approve these minutes as written. Commissioner Bower made a motion to issue an OOC with special conditions including all DMF conditions. The motion was seconded by Commissioner Bernstein. The motion carried 4-0. 4. SE83-2452 Wayne Tavares for Aleksandr Nemanov,2 Buttercup Lane,Proposed construction of a dock within a coastal bank, salt marsh, riverfront area, LSCSF, Iand containing shellfish, and land under the ocean. Discussion: Commissioner Hoopes read a letter requesting to withdraw the application without prejudice. Notice of lntent 5. SE83-2461 Environmental Consulting & Restoration, LLC for Brian and Patricia Clifford, 36 Bentbluffs Lane, Proposed addition in the buffer zone to bordering vegetated wetland. Representative: Brad Holmes, ECR LLC Discussion. The commissioners noted that the proposed work area including buffer zones and proposed addition were not staked prior to their visit as is required. They reiterated the importance of this and let Brad know it is listed on al! the application checklists, and they may choose not to hear the project until it is staked. The commission agreed to hear this proposal this time. The CA summarized site history including an unpermitted patio and hot-tub being installed within the 50' buffer in 2020 since the last permit was closed out in 2016. These require permitting and impact the placement of mitigation plantings in the 50' buffer. Commissioners Bernstein and Hoopes stated that hot tubs are not usually approved within the 50' buffer, and would at least require a drywell for draining. Options for rectiflTing the violation are to issue an enforcement order and handle separately or attempt to permit or modify them in conjunction with the addition with a revised plan. Mr. Holmes requested records of the OOC for the construction of the house and the timeframe for the unpermitted construction, the CA will provide this information by email. Commissioner Bernstein made a motion to continue to 3/2012025 for plan revisions including more information on mitigation plantings relocate them adjacent to existing buffer, and modifications or proposed mitigation to attempt to permit the existing unpermitted hardscape The motion was seconded by Commissioner Bower. The motion carried 4-0 6. SE83-2462 Down Cape Engineering, lnc. for Win Kyaw, 10 Buttercup Lane, Proposed fixed dinghy pier with steps in land under the ocean, coastal beach, coastal bank, riverfront area, LSCSF, and land containing shellfish. Representative: Craig Ferrari, DCE Discussion: Commissioner Hoopes brought up the Chapter 91 requirement for five feet of clearance at MHWfor public passage below the structure, which is not currently provided, and the proposed steps which extend below MLW. The CA discussed the steps potential to become storm debris while being this far out and located below MLW, and requested the steps be seasonal. Both these issues can be remedied by relocating the proposed steps closer to the bank. The old steps will be removed prior to other work. Discussion returned to access issue at MHW and a set of steps on both sides of the pier closer landward was again suggested. Mr. Ferrari requested to continue until two weeks to review options with the client. Commissioner Bower made a motion to continue to 31612025. The motion was seconded by Commissioner Mulhearn. (Continuance requested to 3/6/2025 by the applicant) Discussion: Commissioner Hoopes read a letter requesting a continuance to 31612025 due to scheduling conflict with the owners Commissioner Mulhearn made a motion to continue to 31612025. The motion was seconded by Commissioner Bernstein. The motion carried 4-0. Request for Gertifi cate of Compliance 8. SE83-1 477 Lisa and James Valone, 9. SE83-2383 Lisa and James Valone, Commissioner Bower made a motion to issue certificates of compliance for both projects. The motion was seconded by Commissioner Bernstein. The motion carried 4-0. Other Business 10. Approval of Meeting Minutes: December 6,2024 and February 6,2025. Tabled lo 31612025 for lack of quorum. 11. Other business not reasonably anticipated. CA: an article about the Chase Brook Park project was posted today 2.20.2025 in the Cape Cod Times. There will be a meeting of the open space land use team regarding the Mattacheese utilization project on Tuesday 212512025 at Spm. Commissioner Mulhearn asked about communication with waterways, CA receives the minutes from the wateruays committee regarding the projects at their meetings. Sometimes they are much earlier than ours so the engineers can address comments before filing an NOl. Commissioner Hoopes mentioned the importance of staking and other on-site requirements which are clearly stated in the application checklists which must be initialed by the applicant, and that they should hold this regulation firm.
