The filing deadline is two weeks prior to the next scheduled Conservation Commission meeting for new applications. Failure to follow this Checklist shall result in an Administratively Incomplete Application and will not be advertised for a Public Hearing. Refer to the meeting schedule. The narrative shall include how the project meets performance standards per 310 CMR 10.0 & TOY Wetland Regulations, delineation sheets (if BVW or vegetated wetlands are present) or other resource area calculations, and supporting information. 1 100’ radius map, current abutters list identifying the property owners who are to be notified per 310 CMR 10.00 and abutter notification form. Abutters list must be certified by the Town Assessor’s office. The Assessor’s office requires 7 days advance notice. All abutters must be notified via certified mail. Certified Mail Receipts (PS Form 3800) for all abutters. (508)-398-2231 Ext. 1288 • Fax (508)-398-0836 • TTD# (508) 398-2231 DEPARTMENT OF CONSERVATION Notice of Intent 26 & 30 Bass River Terrace South Yarmouth, MA PROJECT DESCRIPTION 1.0 INTRODUCTION & BACKGROUND The proposed project located at 26 & 30 Bass River Terrace (the Site) in South Yarmouth, MA is to construct a single-family home, a detached garage, accessory dwelling unit (ADU), and associated amenities. This application is being submitted in accordance with the Massachusetts Wetlands Protection Act and the Town of Yarmouth Wetlands Protection Bylaw. 2.0 SITE DESCRIPTION The property located at 26 & 30 Bass River Terrace contains two wooded lots surrounded by forest and neighboring residences. The property is bordered by single-family homes to the south and east, a unnamed stream and its associated Bordering Vegetated Wetland (BVW) to the west and north. The wetland resource areas and areas of conservation jurisdiction on site that are protected under the Wetlands Protection Act and the Town of Yarmouth Wetlands Protection Bylaw include: • Bordering Vegetated Wetland (BVW) • Riverfront Area (RFA) • Coastal Bank • Land Subject to Coastal Storm Flowage (FEMA Zone AR, Elevation 11) 3.0 PROPOSED ACTIVITIES The purpose of this application is to authorize the following activities: Construction of Single-Family Home and Associated Amenities: The proposed project includes construction of a new 40 ft × 36 ft single-family dwelling (five bedrooms), a 30 ft × 26 ft detached garage, and a 24 ft × 32 ft ADU (two bedrooms). Work includes installation of utilities, a 3,000-gallon two-compartment septic tank and leaching field, grading, a low retaining wall, infiltration chambers, and a driveway. Approximately 57 trees (oaks and pines 8–26 inches DBH) will be removed for construction. A 1,200 ± square-foot native restoration planting area will be established just inside the 200- foot riverfront area boundary. All proposed work occurs within Land Subject to Coastal Storm Flowage (FEMA Zone AE, Elevation 11) and a small portion of the work (proposed ADU) falls within the outer (100–200 foot) Riverfront Area. No work is proposed within 100-ft Buffer Zone to Bordering Vegetated Wetlands, the inner (0–100 foot) Riverfront Area, or the 100-ft Buffer to Coastal Bank. 4.0 COMPLIANCE WITH PERFORMANCE STANDARDS UNDER THE BARNSTABLE BYLAW & REGULATIONS The project has been designed to comply with the performance standards set forth in the Massachusetts Wetlands Protection Act (310 CMR 10.00) and the Town of Yarmouth Wetlands Protection Bylaw as follows: Notice of Intent 26 & 30 Bass River Terrace South Yarmouth, MA 310 CMR 10.55--> Bordering Vegetated Wetlands: No alteration is proposed. The 100-foot buffer will remain undisturbed. 310 CMR 10.58--> Riverfront Area: No alteration is proposed in the 0–100-foot Riverfront Area. The work occurs within previously undeveloped upland with minimal impacts falling within the 100–200-foot Riverfront Area. Total alteration of 2,300 sf is less than 10% of the lot’s Riverfront Area (69,154 sf). Of the 2,300 sf of proposed impact only 33 sf are proposed for structure, the remaining 2,267 sf is required for grading. A 1,200 SF native planting area will enhance habitat and improve buffer functions. Due to the very limited amount of impact to the Riverfront Area, meeting the 10% performance standard, and the majority of the work being done outside of the Riverfront Area, the project is limited in alternatives. 310 CMR 10.57--> Land Subject to Coastal Storm Flowage: Structures are flood-vented, and proposed grades will not alter flood storage or impede stormwater flow. Runoff will be directed to on-site infiltration systems, and the project meets all applicable performance standings associated with the local bylaw. 5.0 ALTERNATIVES ANALYSIS No-Build Alternative: The alternative of not constructing the dwelling would avoid resource area alteration but would not satisfy the applicants’ goal of developing the existing residentially zoned property. This option is not practicable. Alternative Site Layouts: Shifting the proposed dwelling and garage farther inland or laterally was reviewed; however, existing lot configuration, topography, and zoning setbacks limit relocation. The proposed layout maintains required separation from Bordering Vegetated Wetlands and the river while using the smallest practicable footprint. Reduced-Scope Alternative: The project already avoids the inner 100-foot Riverfront zone and minimizes impervious area through on-site infiltration systems. Further reduction would not substantially decrease Riverfront alteration but would compromise building function and compliance with structural codes. The preferred alternative confines work to the outer (100–200 foot) Riverfront Area and previously disturbed upland. Approximately 1,200 square feet of native planting will restore and enhance the Riverfront Area. The project therefore represents the least environmentally damaging practicable alternative. 6.0 RESTORATION Erosion controls (straw wattles or similar) will be used along the limit of work line. Any debris going beyond the limit of work line will be immediately removed by hand and disposed of in a roll off container. The roll off container will be placed near the street and debris will be removed regularly to reduce the likelihood of windblow debris around the site. Notice of Intent 26 & 30 Bass River Terrace South Yarmouth, MA The proposed project includes 1200 SF of total restoration planting area with commonly occurring wetland buffer shrubs selected from the Cape Cod Cooperative Extension. Restoration is proposed to offset limited tree clearing and buffer disturbance and to improve site stability and provide habitat.
