Hello Aubrey,
To bring the property into compliance, a 10-foot buffer of native vegetation is required
along the edge of the wetland (like the green area on the attached image), and the fire pit
removed. The plant list you provided works for this, but the quantities must be sufficient
to fill the area to sufficient coverage. We can help identify the correct plant quantities.
Please send us that plant list when you get a chance. If you agree to complete this by
the end of June 2026, there may be no need to attend a conservation commission
meeting. If you’d prefer to discuss with the full commission, please plan to attend the Nov
20th meeting at 5pm. Please be aware that the commission may modify the
requirements listed in the violation notice if you attend the meeting.
To my knowledge, the commission has not granted a variance in the recent past for
hardscape within the 35’ no disturb zone to a wetland. While you may always submit an
RDA application; it is due 2 weeks prior to the meeting date, there are fees involved
($115), and since you are requesting a variance, it is likely to end with the same
outcome. If you still wish to pursue the RDA, the checklist for the application is linked
here. Please let us know if you have any questions and what you decide.

Hello Aubrey,
I visited the property on Friday, and there are quite a few invasive species
(bittersweet, multiflora rose, garlic mustard, phragmites) in the yard which also
contains a wetland. These were likely introduced when the area was cleared
and filled, resulting in the attached violation notice in 2021. The area was
required to be replanted with native species when the deck was permitted. I
would recommend working with a professional to permit an invasive species
removal and re-vegetation plan as required by the building permit under a
request for determination of applicability. If you chose to just plant native
species to satisfy the violation instead of also managing the invasives, please
submit a planting plan for review, the fire pit was also never permitted and may
need to be removed or relocated. For screening in this area, I would
recommend American holly and inkberry holly, with other deciduous native
shrubs such as sweet pepperbush and viburnums. Please let me know if you
