Hi Brittany,
We were scheduled to attend the Conservation Commission
meeting this Thursday, the 20th. We had reached out to Down
Cape Engineering for the updated site plan, but we have not yet
received a response. Without the updated plan, we won’t be ready
for the meeting.
Because of this, we’ll need to postpone our appearance. We will
be back in touch as soon as we hear from them and have a better
idea of our timeframe.

Good Morning Brittany,
It sounds like we’ll need Down Cape to add
the contours and other details that were
requested, and also to revise the square
footage to include the additional area shown
in your photo. My husband is taking some
time today to speak with Down Cape directly.
We’re not sure we’ll be able to get all of this
information from them in time for Thursday’s
meeting. Would it make sense to postpone
until we have everything finalized so we can
present a clearer plan?
We’d also like to represent ourselves at the
meeting to help keep costs down, if that’s
alright. We’re happy to do whatever is
needed to get everything resolved.

Hi Joe,
Yes our plan is ready. I had contacted Down
Cape last week to let them know that I had
moved a pile of landscaping pavers and
rocks that were within the conservation
buffer zone. They’re waiting for my
before/after photo so that they can adjust
the plan accordingly.
I’m sending over the photos to Down Cape
this morning, so I’m assuming the plan will
be revised this week. I’ll get it over to you
guys right away.

Hello Maria,
I understand, engineers and surveyors can be
expensive, but Down Cape’s proposal
includes more work than what we asked for.
As I said in my previous email, we are not
requiring a new application. That means the
work under “phase III” (filing, abutter
notice, hearing attendance) will not be
necessary. Work under “phase II” (prints
and revisions) should be minimal.
What we will need is an updated site plan
showing any new work in the 100’ buffer to
the wetland that was not on the previous
plan. It also needs to include an increased
mitigation planting area to account for the
structures in the buffer zone.

property at 17 Wild Rose Terrace. We’re
committed to completing the required
work and bringing everything into
compliance.
That said, the cost of the engineering
proposal we received (attached) is quite
high, and we also need to budget for the
restoration planting. We’re hoping you
could review the proposal and let us
know what’s absolutely necessary and
whether any of it can be done by us
rather than a professional.

Work on the
addition,
including
mitigation
plantings. A
preconstruction
meeting was
never
scheduled
prior to
work, which
would have
confirmed
that the work
limit line and
erosion
controls were
properly
established
and a sign
with the DEP
number was
visible from
the road. The
work on the
addition was
completed
over a year
ago, and
much of the
mitigation
planting has
been done.
To close the
order of
conditions
for this work,
you will
eventually
need to apply
for a
certificate of
compliance
after the
plants have
survived two
growing
seasons. This
includes a
letter from a
professional
certifying
that the work
has been
completed in
compliance,
and an as-
built site
plan.

2023
Enforcement
Order
Restoration
planting. The
enforcement
order to
address
unpermitted
vegetation
removal and
debris in the
buffer zone
required
restoration
planting,
debris
removal, and
a rail fence
or bollards to
establish a
“no disturb
zone”. A
plan was
approved,
and the
deadline for
planting was
extended
from May
2023 to Fall
2023 for the
work on the
addition to be
finished first.
The planting
in this area
has not
started, but
you indicated
your
intention is to
begin around
June this
year. Failure
to comply
could result
in additional
enforcement
orders or
non-criminal
citations.
Please let us
know when
this has been
completed.
Unpermitted
work in the
buffer zone.
The new
patio,
walkway and
firepit area
were not on
the approved
plan. These
structures are
at least
partially in
the 50-100’
buffer to a
wetland.
There was
also some
work done to
install plant
beds, and
while the
beds
themselves
are out of the
buffer zone,
there was
some ground
disturbed in
the buffer
zone. Any
activity that
may alter an
area within
100’ of a
wetland is
subject to
approval.
You can
attempt to get
this work
permitted by
filing a
request to
approve a
revised plan
under 083-
2375 after-
the-fact.
Please note
there is no
guarantee
that the
commission
will approve
such a
request. If it
remains
unpermitted,
these
activities
may result in
additional
enforcement
orders.
