HomeMy WebLinkAbout1648H - Mod #2 - Definitive Sub TR Memo 111925 T O W N O F Y A R M O U T H 1146 ROUTE 28, SOUTH YARMOUTH, MASSACHUSETTS 02664-4492 Telephone (508) 398-2231, Ext. 1276, Fax (508) 398-2365 MEMORANDUM To: Engineering Division, Conservation Division, Health Division, Water Division, Fire Department, and Building Division From: Kathy Williams, Town Planner Date: November 19, 2025 Subject: Definitive Subdivision Plan 1648H – Modification #2; 63 Thacher Shore Road, Yarmouth Port ; and Assessor Map 122, Parcel 24.1 Please find attached a Modified Definitive Subdivision Plan, an As-Built Plan, and supporting documentation for land located at 63 Thacher Shore Road in Yarmouth Port (Assessor Map 122, Parcel 24.1), submitted by the current owner Brian Bassler. This single residential lot was originally created through a Definitive Subdivision (#1648H) in 2005, which was required due to the distance from Thacher Shore Road to the developable portion of the property. The Planning Board allowed for waivers from their roadway standards to essentially allow for a 12’ wide unpaved driveway with buried utilities. The Board also placed three conditions on the subdivision including the road remaining unpaved (12” of gravel and 2” of blue stone); that the road will remain un-named and no town services or maintenance of the road will be provided; and there must be a sprinkler system for any residential structure. The Definitive Subdivision Plan was further modified in 2017 (#1648H - Mod#1) to extend the timeline for completion for an additional 4 years, to specifically allow for country style drainage (swales with check dams and culvert) rather than drainage structures, and to allow for electric power/cable to be located outside the road layout (comes off Route 6A via an easement). There were also conditions related to the Determination of Applicability issued by the Conservation Commission and associated operation and maintenance of the drainage system. The owner has completed the driveway and utilities as shown in the attached As-Built drawing. Based on the As-Built information, the applicant did not construct the roadway as originally designed and is seeking additional waivers to: 1. Increase the road grade from 8% to 8.75%. 2. Reduce the cross slope from 1/4” to as low as 0% in some locations. 3. Eliminate the drainage swales and check dams on both sides of the roadway and provide vegetated shoulders along the pervious driveway. 4. Allow one boundary monument to consist of a drill hole in a large rock rather than a concrete or granite monument. Definitive Subdivision Plans were received by the Planning Board on November 12, 2025. The Planning Board Public Hearing is tentatively scheduled for January 7th. It would be much appreciated if you could review and provide comments by December 23, 2025.
