The Board of Health has reviewed your request for a variance at the Decernber 1,2025 Board of Health
Meeting.
The Board of Health has determined that the following varianceiapproval shall be denied:
310 CMR 15.223 - Septic Tanks
A domestic garbage grinder is prohibited in facilities that do not meet Massachusetts State Title IV
requirements including: a septic tank two-hundred (200%) of the design flow with a minimum tank size
of one-thousand flve-hundred ( I ,500) gallons and a two (2) compartment tank or two (2) tanks in series.
The septic system located at 97 Helmsman Drive, Yarmouth Port, MA 02673 does not meet the above
criteria to allow a garbage grinder.
@!!&!q On December 1, 2025, Assistant Health Director Barry Lewis granted the property owner,
Nancy O'Connor three (3) months to hire a licensed plumber to pull conect permits and remove the existing
garbage grinder. -Proof that the garbage grtnder has been remot'ed shall be provided to the Yarmouth
Health Department by March l, 2025.
