W-M Sent: Tuesday, December 9, 2025 3:39 PM BOARD OF APPEALS To: Fallon, Dolores <dfallon@yarmouth.ma.us> Dear Board Members, Thank you for allowing me to express my concerns regarding the petition for a variance to allow for an inground pool at 43 Webster Rd. My name is Don Palaia, and while I don't abut the rear of the property, I am an abutter to the front, having owned 44 Webster Rd since 1988. This part of Webster Rd, characterized by small capes and ranches on small lots, has long been a peaceful neighborhood. However, the construction of a large rental property at 47 Webster Rd in 1995 disrupted this tranquility, and the addition of another rental property at 43 Webster Rd in 2021 only added to the concerns. Despite assurances that 43 Webster Rd would not become another "hotel house," it is now listed as a four -bedroom rental property that sleeps 10 people while 47 Webster advertises it sleeps 20. oppose the variance for several reasons. The Town of Yarmouth Zoning Bylaws for Short Term Rentals aim to protect the residential character of neighborhoods, yet this has not been the case. Noise disturbances have been frequent, and I am no longer willing to overlook them. Additionally, a four -foot -deep pool poses safety risks, especially to unfamiliar tenants. The property owners live out of town and the addition of a pool would only attract more short- term renters, exacerbating parking issues and affecting the neighborhood's quality of life. So referencing the Town of Yarmouth Zoning Bylaws for Short Term Rentals I am not in favor of the variance. 1. "Protect and maintain the residential character of existing neighborhoods". (sec 418.1.1). There have been numerous occasions of loud and after hour noise. (No, I haven't called authorities.) However this is a neighborhood, not a resort with a pool and a separate detached media/game room or a night club. 2. "Protect the Public Health and Safety" - (sec418.1.2). How can a 4 ft deep in ground pool be safe? What happens when the child of a tenant dives head first into a 4 ft deep pool they aren't familiar with and gets hurt? 3. "Enable residents to better afford to live here, maintain their properties and contribute to the community". (sec418.1.3). The owners of this property live out of town and the property is an income generating property, not a home. That's why it's listed as a four bedroom rental when the property card and the plans list it as a three bedroom. This has nothing to do with making an affordable home in town. Adding a pool just makes it more attractive to would be short term renters. The owners don't experience any of the inconveniences to the quality of life that the abutters do. 4. "Adequate on -site parking shall be provided, with a minimum of one space/bedroom. There shall be no parking on lawns, no overnight street parking and no street parking that impedes traffic or traffic safety at any time". (sec 418.5.2). My understanding is that a parking space in this context must be un-impeded, thus not a spot blocked in by another car. That condition does not exist. Further on many ocasions overnight street parking is happening. There simply has not been enough parking at 43 Webster to support the number of cars there. I have to do two point turns to exit my own driveway due to the narrow conditions when cars are lining the street. Further I cannot enter or exit my driveway with a boat in tow when cars are parked on the road in front of my driveway. Adding a pool to the property will draw more guests and more cars to Webster Rd. 5. "Shall not adversely affect the residential character of the neighborhood nor interfere any reasonable person's enjoyment of their residence." (sec 418.5.4.c). This property at 43 Webster is opertated as a business, not a residence. It is an income generating property with the pool intended to make the property more desireable. The people living in the neighborhood have to deal with the consequences; the crowds, the noise and the traffic and cars. The property owners don't. Sometimes it is like living in the middle of a motel parking lot with all the cars. I'd urge the Board of Health to undertake a study of advertised capacities at some of the "Short Term Rentals" that have become prevalent with the advent of online booking sites. am opposed to this variance as conditions are currently. If adequate arrangements are constructed to mitigate the parking situation and confirmation as to occupancy can be established, then I would reconsider my stance. I will leave how saftey is addressed to the town. However at this point in time I am opposed. In closing I strongly urge the Town of Yarmouth to continue their evaluation and planning process related to STR's. The market has gotten ahead of the regulations through the use of Internet sites such as Airbnb, Vrbo and other applications. Once quiet neighborhoods are being overrun by these Short Term Rentals and the clients who rent them, many of whom feel entitled to behave without regard for local regulations. Our once quiet neighborhood has been permanently compromised until, or unless, the Town of Yarmouth is successful in implementing better oversight with the proposed revisions being evaluated now.
