I explained to you that I have no experience with required fire and building codes in relation to this type ofbusiness. [n order for me to review your business I need plan submittals as if it's a new business. I can only REVIEW, ask questions and then issue permits (if required) on any project. I recommended that you hire an engineer who is qualified in your field to guide you through the process. Any plans submitted must have an engineer's stamp which is standard for plan submittals. The Yarmouth Fire Department, Fire Prevention Office sfives to be business fiiendly. I spoke with you after the fire and offered any help I could provide. Unfortunately I can only provide help through a process of permit submittal. Once we have the proper documentation I will review as quickly as I can to help move the process along, but it starts with a permit submittal and plans. This is an excerpl tiom an email from Building Inspector Brandolini who was on scene right after the fire:- I advised him that permits were required for the re-construction of the dust discharge storage area and for the re-installation of mechanical systems. He was advised that plans/sketches, specifications and calculations for the mechanical systems shall be provided with the permit application and that said plans, specs and calculations shall be designed and provided by a qualified person for this discipline. I further advised him that the proposed systems were to be code compliant and that the qualified design professional was to insure that issue, via his review, calculations and effectively reflected in proposed new systems. When asked by Mr. Massarelli as to whether he could temporarily remain open using a "portable" vacuum unit, I advised him that I could not determine whether the unit had the capacity to extract the volume of saw dust particles for the equipment that would be generating the dust. Accordlngly, he was advised to provide such information furnished by a qualified individual in that discipline. Until such time he would not be allowed to use the equipment that generates the quantities of saw dust in his day to day operation Until such time as you can provide Insp. Brandolini the information he requested on any tlpe of temporary vacuum system you cannot operate any power equipment. Per 527 CMR 1.03(8) the Yarmouth Fire Department is ordering you to cease and desist immediately, any operation that produces wood working dust or particles. I Per 527 CMR 1.03(8) Duties of the Head of the Fire Department: Whenever the maintenance, operation. or use ofany land, building, structure, material or other object, or any part thereof, including vehicles used in the transport of hazardous materials constitutes a fire or explosion hazard which is dangerous or unsafe, or a menace to the public safety (including, but not limited to, fires, explosions, hazardous material incidents. motor vehicle accidents, structural collapses, mass casualty incidents and emergency extrication incidents) and the action to be taken to eliminate such dangerous or unsafe condition or conditions which create, or tend to create, the same is not specifically provided for in 527 CMR, and unless otherwise prohibited by [aw, ordinance, by-law, regulation, the head of the fire department is hereby authorized and empowered to take such action as may be necessary to abate such dangerous or unsafe condition or conditions (directing employees ofother city or town departments and agencies) and including the evacuation of buildings andior the transport or hazardous materials, the speed, routes, amounts, and hours of transport through the city, town or district shall also be regulated. In ordcr to precede you must submit proper permit submittal applications with required engineered plans through the Town of Yarmouth Building Department. Any temporary measurcs to operate the shop equipment must be approved by the Building Department and Fire Department. The speed in which you reopen for business depends on you and your engineer; until such submittals are reviewed I do not see any value in any type ofdiscussion.
