Request to Extend T.O.Y Ocean Discharge Date
Dear Mr. Casey,
As you are well aware, after exhausting all means to discharge the project dewatering in compliance
with and as required by the contract, Revoli Construction Co., Inc. (Revoli) proposed a change to the
dewatering discharge by directly discharging to the water body (the ocean). In a joint effort, Revoli
received approval through Mass DEP, and the Town of Yarmouth received approval from
Conservation and the NHESP to direct the dewatering discharge into the ocean. One of the
conditions of the NHESP approval was that the temporary discharge equipment be removed from the
beach by April 1 st.
Due to the work area being located in a highly sensitive tourist area, the contract restricts work from
taking place on South Shore Drive between Memorial Day and Labor Day, leaving Revoli with
September, October, April, and May as reasonable construction months. Therefore, the NHESP work
restriction of April 1 st will result in delays to the project and irreparable financial hardship to both
the Town of Yarmouth and Revoli due to the inability to work on South Shore Drive for essentially
the last two months of the 2025 spring work season. This will prevent the project from being
completed within the contract time frame. Continuing work on South Shore Drive is not feasible
without the ability to discharge into the ocean. As such, Revoli kindly requests an extension of the
T.O.Y. restriction to Memorial Day, which will coincide with the contract time restriction.
Please note that the discharge pipe, as constructed, follows the path of beach goers and is not
affecting the beach grasses and other vegetation (see attached photos). Any impact is minimal, which
helps prevent disruption of wildlife habitats and nesting areas.
Thus far, the ocean discharge, as constructed, has resulted in minimal disturbance to the beach area.
Should an extension be granted, and in order to avoid future disturbance when the discharge
materials are removed, Revoli will modify its current discharge setup.

The modification will include the removal of the concrete barriers prior to April 1 st, since this
will require equipment to remove them at a later date, and replacing them with polyethylene
water -filled barriers, which can be installed and removed manually without equipment entering
the beach. The discharge pipe will then be pulled from the Seaview Beach parking lot. When the
discharge pipe is pulled from the beach, Revoli will utilize pieces of pipe (as needed) under the
discharge pipe, acting as a roller to prevent any disturbance to the beach (revised detail attached).

Water -Wall barrier to be 72" long x 32" tall x 18" wide and molded from linear low density polyethylene.
Water -Wall to be NCHRP-350 TL-1 tested and passed as a barrier. Individual wall shall weigh 80 lbs. empty
and 1,110 lbs. filled. Standard colors are white or orange. Water -Wall sections are connected together with
galvanized steel T-pins passing through a double wall knuckle which minimizes breakage at hinge points. Wall
shall pivot up to 30 degrees when connected. Water -Wall to have one 8" diameter fill hole for quick fill and
a twist lock cap for closure. Water -Wall will have molded thru holes to provide easy movement. Drain plug
to be offset to protect against cracking or breaking and have course buttress threads for quick removal and
