Request for TOY Incursion
April 1 – May 23, 2025
Good afternoon, All –
The Division reviewed the request dated February 14, 2025 prepared by Revoli Construction Company, Inc. for an incursion into the established Time of Year (TOY) Restriction (April 1
– August 31) required as part of the MESA (321 CMR 10.18) /WPA (310 CMR 10.37) review of this project for the protection of state and federally protected species and their habitats.
The 2/14/25 Revoli Construction Company request identifies the proposed scope of work during the TOY Restriction includes:
* Retaining the dewatering pipe with its support structures and water-filled barriers on the coastal beach through May 23, 2025.
* Motorized equipment access on the coastal beach will not occur after April 1.
* Work on the beach to remove the pipe and its supporting structures including water-filled barriers will be performed by hand, and any machine support will be sited within the existing
parking lot.
The Division hereby approves this work during April 1 – May 23, 2025, provided the following conditions are fully implemented by the permit holder/contractor to avoid a prohibited Take
of state-listed species.
Please be aware the start and/or the continuation of work after April 1 is subject to the restrictions identified below and will depend upon a) the availability of the monitor(s) to
inspect the site and b) the status/proximity of state-listed species.
1. Beginning no later than April 1, a qualified shorebird monitor (as determined by the Division) shall be contracted to conduct monitoring at this site at least 1-2 times per week for
the duration of the project. The frequency of monitoring may increase based on documented state-listed species activity at this site.
2. The qualified shorebird monitor(s) must survey all areas of suitable habitat within a minimum of 200m from the project area for any state-listed species nesting activity, including
pre-nesting scraps.
3. The qualified shorebird monitor must determine the location of all state-listed species, nests, scrapes and unfledged chicks. The status of symbolic fencing shall be noted and, if
necessary, adjusted or installed to ensure all nests and scrapes are protected.
4. If nesting occurs within 200m of the site, then all equipment shall be removed from the beach prior to the anticipated hatch date (as determined by the shorebird monitor).
5. If there is potential for unfledged chicks to occur within 200m (from a nest potentially located +200m away from the site), then all equipment shall be removed from the beach prior
to the anticipated hatch date (as determined by the shorebird monitor) or based on observed brood ranges.
6. If it is determined that state-listed coastal birds are disturbed by the activity, (1) all work must cease immediately and (2) notification must be provided to the MA Division of
Fisheries & Wildlife, NHESP program at 508-389-6364 (or amy.hoenig@mass.gov) and USFWS for further consultation.
7. A summary report of the coastal bird monitoring must be provided to the Division. Coastal bird monitoring is the process of observing and recording data on breeding activities without
causing disturbance to the birds under observation. Monitoring includes, but is not limited to, detecting and recording location of territorial and courting adults, locating nests and
incubating adults, locating broods, interpreting behaviors, and documenting observations in legible, complete field notes. Expect to determine the number of eggs in a newly discovered
nest, monitoring is done using binoculars or spotting scopes from a distance of approximately 50 meters. Monitoring is subject to appropriate weather conditions and tidal cycles.

Following up on the email below (and attached); with April 1 quickly approaching, we’d like to meet on site (or set up a call with all parties) to determine the plan moving forward;
it’s important to the Town that as much work get done before the Summer months as possible – allowing the dewatering to the Ocean to continue to (just before) Memorial Day would be
a big benefit to the Town.

Hello all and thank you for including Mass Audubon in this thread.
At this time, we do need more information relative to the monitoring requirements and protection plan that AmyHoenig/NHESP has requested in order to determine if we can provide staffing
coverage. We'd recommend also taking into account that Piping Plover chicks may breed within foraging range of the site at other beaches along this stretch.

Please let us know if any other information is needed; we’d request a site visit (or call if that’s more convenient) to review ongoing activities and work scheduled between April 1 and
May 23, 2025.
We’ve copied Lyra, Rose, Debra and Jamie from Mass Audubon should a qualified shoreland monitor be needed.
We appreciate your help in moving this important project to the Town forward; it’s beneficial to all parties to complete the pipe installation on South Shore Drive before Memorial Day.

Please be aware that requests for incursion into the TOY restriction are not guaranteed. Requests are reviewed individually and consider the project scope and site specifics.
Any proposed TOY incursion request necessitates a minimum review period of 2 weeks or more if additional information is needed or if requested during the nesting season.
The written request should specify the anticipated start, duration and cessation for all work activities that will impact the coastal beach/dune. Further, scope of work should be defined
and all equipment, vehicles, access routes, etc. that are necessary to facilitate the project or placement/removal of material should be defined. Information regarding a) what options
have been evaluated that would facilitate the project without the need for a TOY incursion, b) why the TOY incursion is being requested and c) explanation or rational regarding why
compliance with the existing established TOY restriction may not be feasible must be provided.
If there are impacts to the coastal beach/dune during April 1 – August 31, then a monitoring and protection plan for state-listed nesting shorebirds should be anticipated. A monitoring
and protection plan for state-listed species requires pre-approval by the Division and must be implemented by a qualified shorebird monitor. It may be prudent for the requestor to reach
out to a qualified shorebird monitor to determine their availability. The Division may require verification that a qualified monitor is available prior to approving a TOY incursion.
After the information specified above is submitted, the Division can evaluate the requested TOY Incursion and can identify whether the work is approved during the TOY and, if so, confirm
the conditions as well as the monitoring and protection measures for which work may proceed during the TOY.
Occasionally, if the remaining work is not located on the coastal beach (e.g., planting on the slope of the coastal bank), it may be approved without a monitor. This is why the request
for the TOY incursion should include as much detail regarding the project components, duration, and timeline as possible.
A qualified monitor must have direct survey experience with the subject species, the ability to identify tracks, scrapes, etc., and be able to interpret their behaviors.

The attached comments were issued for a temporary dewatering operation into the ocean associated with wastewater infrastructure installation along south shore drive in Yarmouth. The
contractors have requested that I reach out on their behalf to request reconsideration of the time of year restriction. They wish to continue dewatering through May at the Seaview beach
location only. This beach is armored with a grouted revetment and has no vegetation. We appreciate your consideration, and please let us know if you need any additional information.
