Oman. It appearing that notice of said hearing has been given by sending notice thereof to the petitioner and all, those owners of property deemed by the Board to be affected thereby and that public notice of such hearing having been given by publication in The Yarmouth Sun, the hearing was opened and held on the date first above written. REASON FOR DECISION The petitioner requested a Special Permit, pursuant to 5202.5, use F2, to operate a taxi cab office and dispatch business at the site, located at 908--922 Route 28, South Yarmouth. The petitioner proposes to move her business operation from a site in West Yarmouth, where she is currently operating pursuant to a decision of the Board in case #2697, which permission is due to expire on June 1, 1990.The _petitioner _represented..that_none -of-her -cabs or vans used in the operation of the business will be parked at the site in the regular course of business, and will • w only occasionally be present at the site, and then only for short durations. No more than two persons will be present at the site for the operation of the business, and only two parking spaces are allocated to this unit. The Board expressed serious concerns as to the overall u site conditions and uses. However, based upon the occupancy limit if two persons, and therefore two parking spaces, for the unit, the board was satisfied that no undue nuisance, hazard or congestion would be created by this proposed use, and that there would be no substantial harm done to the established or future character of the immediate neighborhood. On motion duly made by David Reid and seconded by David r B. Oman, to grant the special permit, with the restriction of parking and occupancy being limited to 2, and on condition that the cabs and vehicles used in the operation of the business not be parked or stored nor directly dispatched from, the site; and to extend the expiration of decision #2697 for an additional 30 days. Members Donald Henderson, Joyce Sears, Fritz Lindquist and David Reid, voted in favor of the motion to grant and member David B. Oman abstained from voting. Therefore, the motion carries the requisite four affirmative votes, and grants the petitioners request as restricted. No permit issued until 20 days from date of filing decision with the Town Clerk.
